    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am really worried about all this. I am not in a position to loose any more money. I have been reading lots of threads on everything from DPA request to mercantile court. I am really confused on the court process and how mercantile affects me and my claim. This morning I thought I was ready to submit court papers but now feel totally deflated.

 

Can anyone help ? Is there a simple guide ?

 

Must sound a complete dunce But I am genuinely worried. You guys seem to be very well informed and very confident. I wish I could afford to be.

 

Apologies for posting in general but I think my issue is not specific to mrcantile section.

Like you,the vast majority of us when we first came on this site knew very little about unlawful charges, the Data Protection Act etc etc.

I assume that you are thinking of using the Mercantile Court because of the

size of your claim? If so, you can split the claim in two, perhaps by first claiming for 2000-2003 and then 2004-2006 to get round the problem.

 

Don't give up however, there are too many who have reclaimed all their

unlawful charges on this forum for you to become despondent at this stage.

 

Just go for it. And if you need something specific-just ask us. Make sure

you have read the FAQS and the step by step guide, along with threads

in the section of the bank you are reclaiming from to see how they react

to our letters.

When you get your money back we will all send you our begging letters.:D

The amount is £4,239 from HSBC. I have sent first letter and also the letter prior to court proceedings. I am the stage Where I am about to submit the MCOL form and I cant believe I bottled it.

 

It is to do with all this mercantile procedure (it worries me) and the whole process of court totally dumbfounds me. AQ's and the like. Have read loads of other articles at the court pages and a lot of threads / FAQ's from this site. The more I read the more confused and less confident I am.

Let's worry about one thing at a time. Only a tiny number out of the thousands of claims are being heard (well, actually they're not being heard at all) in the Mercantile Court. You can only be transferred to Mercantile by a judge.

 

You are below the £5000 limit and therefore small claims track. If, by the smallest chance, you were transferred to Mercantile since it would be by order of the judge, it is likely that the small claims 'no costs' principle would still apply, but that there would be Standard Disclosure ie the banks would have to reveal their costs, which they won't do. So they settle, rather sharpish.

 

And the next worry is...?

submit the claim, mke sure that you have a schedule of chrges and send a copy to the bank and the court, and keep a copy for yourself

Thanks, nice to get a bit of encouragement. It is very daunting if you do not know how these things work. I got a lot of encouragement from the Money porgramme.

 

I have now done the MCOL the worst that can happen is lose £120 and not get back what the g*ts took from me, which I lost already.:cool:

 

14 days. Cannot wait. Bring em on.

Oops meant to put this in the previous. Spoke to MCOL they said they allow 5 days postage. I keep seeing less time than this. Any one know about this ? as it would mean total of 19 days before judgement.

 

Ps Michael I am not claiming interest so I assume I just take out section ref interest.

Hi,

 

You might prefer to have this thead moved to HSBC so that other customers can compare their progress against yours. You don't have to but I think that most users tend to have their threads in the relevant bank forum. :) All you have to do is PM one of the MODS - and if you want your title changed you can also ask them to do that as well.

LOL, a long wait!

 

Just wait for the 28 days and then either they'll file a defence in time or they won't, you'll get excited, press the judgement button and they'll submit a late defence anyway - they are sneaky!

 

Anyway after that shenannigans you'll get a) an Allocation Questionnaire to fill in and give them more time to dilly dally around or b) a letter offering the full amount or perhaps c) both within a day of each other and then its a race to get the money before you have to file the AQ!

 

Its all fun!

Just had a thought.

 

Does anyone think it would be possible to claim the interest as a seperate claim or does it have to be included in the initial claim.

LOL thanks Flunky. Umm as far as I'm aware it all goes as one....you do know you aren't claiming for the 8% until court time don't you? Best to ask Mammie Lateralus or Bong...they are some very helpful ladies who in fact must be the 2 halves of the fountain of knowledge!

I am not claiming interest (sounds of Boo, Hiss me thinks).

 

Was not really sure at the time of how and where and I admit this was an error on my part.

 

If they play up then I would consider starting again and going for a higher amount. I would of course let them know this. So hope they pay QUICKLY.

 

This is why I am wondering whether I can get JUST interest as seperate claim later.
