    • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Natural immunity ignored

It is an amazing fact that natural immunity is completely disregarded by health authorities around the world. We know from SARS- CoV-1 that natural immunity is durable and persists for at least 12-17 years [17]. Immunologists have suggested that immunity to SARS-Cov-2 is no different. The human population has encountered and co-existed with a great number of coronaviruses throughout evolution. Most of us have cross-reacting T-cells, B cells and antibodies derived from encounters with common cold coronaviruses that can recognise SARS-CoV-2 [18-20]. A survey of more than 100 immunologists, infectious-disease researchers and virologists working on the coronavirus, who were asked whether the virus could be eradicated, showed that almost 90% of respondents believe that the coronavirus will become endemic [21]. The four human coronaviruses that cause common colds are also endemic, without there ever having been a vaccine for any of them. The existence of related viruses might explain that approximately 40% to 45% of COVID infected people are asymptomatic and about 80% of COVID cases are mild infections. In some cohorts, the asymptomatic infection figure jumps as high as 96% depending on the age and cross-immunity imparted by other viruses such as beta coronaviruses HCoV-OC43 and HCoV- HKU1, which have been proposed as a mitigating factor in the spread of SARS-CoV-2 [22-23].

Did you miss/ignore/or not even look, to miss that the experiment that resulted in that particular mutation was one of a range of tests/experiments done because that is the the sort of thing that the virus is doing in the wild?

Of course it has to be noted that the opinion of any health care professional, GP, Virologist, Cardiac Specialist who differs from the narrative of the WHO, big tech or big pharma , the narrative that you have swallowed hook line and sinker , is ridiculed and dismissed

I'd rather go with the weight of scientific opinion including those who are experts in a specific field.

 

Taking the risk of not being vaccinated, would be like driving a car without a seatbelt, hoping not to have an accident.

That is a huge issue with coronavirus - the mechanisms we have apart from and over and above vaccine, aka masks, cleanliness, distance, not coughing in peoples faces, depend on the competence and sense of others more than yourself, and right wingers do seem to be notoriously self centered

Just an aside TJ regarding masks, do you consider it sensible to drive in a mask on your own in a vehicle?  Saw someone yesterday alone in an SUV masked up, nearly hit a pedestrian in Aldi car park, glasses steamed up apparently as mask not worn properly.

We could do with some help from you.

Even an occasion mask wearer can rarely occasionally be as utterly stupid and senseless as the deniers and mask refuseniks eh?

Times article today with some fact-checking of MPs' statements on the vaccine.

 

Andrew Bridgen, the MP for North West Leicestershire, questioned why “the [coronavirus] vaccine was given to people who had natural immunity because they had probably contracted the virus”. He also cited debunked statistics, claiming that there was an “84 per cent increase in the relative incidence of cardiac-related death among males aged 18 to 39” following vaccination.
The study to which Bridgen referred — which has not been peer-reviewed or published in an academic journal — was widely criticised by public health experts for lack of evidence and potential methodological failures. Fact-checkers described the study, conducted by the Florida Department of Health, as misleading.
Chope, who was criticised by the UK Statistics Authority in June for making baseless claims in parliament about the safety of coronavirus vaccines, used his speech to encourage those present to watch a film he took part in produced by Oracle Films, an antivax conspiracy group that had their account suspended by Paypal last year after claiming that vaccines could alter DNA.

What that is trying to claim is that excess deaths are caused by the vaccine because there are still excess deaths as vaccines roll out

 

We have of course already debunked that here with official figures that show once significant vaccinations had occurred, hospitalisations and deaths have occurred in the unvaccinated at multiple times of those that have occurred in the vaccinated, despite the mutation rate of the virus.

 

Further vaccine evasion by mutated strains and lowering of booster takeup are confusing the issue somewhat, so expect more of this utter shite posted by the few.

There are already signs that twitter is becoming an open house for this sort of crap again.

Some may not be aware that Covid, and other arguably more deadly disease monitoring is carried out by sampling human poo.

So here is that human poo being discharged into our waterways and coastlines where children swim and play

- and the right wing presses attitude to that
