I thought that they had to provide the information that I have requested, and also provide me and the court with a copy of their witness statement? Does that mean if/when my court date arrives I will have to go without knowing what they are going to say?

Refer back to your N157 Notice of Allocation and what the court will do if a party fails to comply with the courts directions.

now you have VCS thread running with the same date so is this the same case?

who runs the car park, VCS or Excel? if you are being sued by one and the other runs the place then it is an easy win, the claimant has no standing and no cause for action so no case to answer.

 

You have failed to give us any information about how thsi all came about so you will miss oput on a lot of help but it isnt too late as you can talk about the points you have written about and beef them up but you wont be able to introduce new evidence other than to rubbish their WS

I got home to a letter from Excel Parking Services,

 

The case has been dropped 🙋🏼‍♀️

Result !!

excel have been known to pull this stunt before so you don't turn up.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

So if Excel sent the letter, then not cancel with court to ensure defendant doesn't turn up, would that be grounds for appeal, as they misrepresented their case?  Would have thought court would take a dim view if victim  fought back, or rather could afford to fight back.

Plus, how about sending a letter to the court to ask for full costs for unreasonable conduct under CPR27.14(2)(g) as Excel hadn't respected PAP and hadn't sent you an LBA?  Their approach was to hope that you didn't defend the claim and thus get a default CCJ, which is an abuse of legal procedure.  As soon as you defended, they dropped the claim.  You may get nowt, but hey, it's the price of a stamp, and if the judge agrees, you get your next holiday for free 😀  Obviously your have to properly list your costs.
