Do you mean that your friend has a CCJ and then a Charging Order was granted and registered against her home?

 

There is no standard amount. Pluck a figure from thin air and try it. 10%? 25%? 50%? Take your pick!

Who is the judgment with...whats the amount...whats the history...how long as it been in place ?

 

Is the CCJ in your friends name only ?

 

Is it a joint mortgage ?

Judgement is with Lloyds Bank

 

CCJ placed because she couldn't maintain monthly loan repayments

 

Loan was for £50K

 

Been in place since 2013

 

Is the CCJ in your friends name only ? Yes

 

Is it a joint mortgage ? No

Are Lloyds Bank the actual claimant ?

 

Or is that just the name on the original debt and the CCJ is in a DCAs name ?

As your friend come into some money ? :-D

 

50K is a considerable amount for one debt to be secured against a property...considering that no offers of payment have been made in the previous 4 years or at the time of judgment...I doubt the claimant will be greeting any offers much less than the full amount.

 

Do you know the Sols that dealt with the claim?

Ok, but that's how its been. They didn't set out anything when judgement was passed. She is selling her house so hence why judgement will be cleared. She would like a bit of equity to put towards another house though hence wondering if she can make an offer

If there is enough equity in the house to fully pay off the Charging Order it's doubtful that any reduced offer would be accepted.

 

Depends how desperate the Claimant is for their money or your friend is to sell though I guess.

 

Like I said, pick a figure and go for it. Nothing to lose.

Also make sure 50K is the final balance and that no post judgment interest is applicable.
