    • Thank you for taking your time and helping me on this. Would you recommend I also send a letter tomorrow to both BMW and Motonovo?
    • she and  johnson need to be kicked off the taxpayers credit card - for starters I'm certain there is cause - taking up 'jobs' when they shouldn't, bringing the nation into disrepute with their antics .. I'm sure it would be a very popular act from a new labour guv
    • Please have a look at this draft letter. It is modelled on yours but I have cut out a load of the unnecessary information. Also, the responsibility lies with the finance company because the vehicle was brought on hire purchase. You send it to them and a copy to big motoring world.   Let us know if there's anything that you disagree with, which is wrong, which you think should be added
    • According to Alastair Campbell on Twitter, anti-Le Pen parties are pointing to RN's fiscal policies and saying they'll cause a 'Truss-style market meltdown'. Liz Truss charged taxpayers for Amazon Prime subscription - Mirror Online WWW.MIRROR.CO.UK The subscription costing £95 gives the ex-PM free shipping from the retail giant, as well as the ability to stream films and TV shows such as My Fault...
    • Thank-you @BankFodder, your statement is a correct understanding of my position and I agree, it is actually really what I was looking for in starting this thread, as I too believed that the maximum I could claim for is that which I sold it for, even though this was substantially below market value at the time. And so, this sold value is what I shall be claiming for + the other expenses. @dx100uk I get your point, but this is just not what I want to expose myself to. Unfortunately I was one of the unlucky ones to have my details stolen in the Peoples Energy hack, and in 2020 I discovered that those details had been used to take out car insurance, and that the insured was then involved in a collision and my details were dragged through the mud. Despite Aviva cancelling the claim and treating as though it never were, even though I have the letters from them to say that they have removed this claim from the insurance database, I still get refused insurance and credit products to this day until I send across the letter from Aviva which explains that I was a victim of fraud. So you'll forgive me for not jumping up and uploading my data to a server utility for which I have no control over its retention policy, or where the server is located globally, its legal jurisdiction, or its security protocols.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The Paper presented to Parliament 12 months ago says:-

"As the UK leaves the European Union (EU) and we bring free movement to an end, different rules to the current ones must apply to migration here by EU citizens. We will take full control of migration by bringing all of it under UK law and institute a new border and immigration system, to serve the UK public and the economy, and to enable those who come to the UK to integrate and make a positive contribution. Everyone will be required to obtain a permission if they want to come to the UK and to work or study here. This does not mean there will be no immigration – as we take full control, we will continue to welcome law-abiding people from around the world who help make the UK a diverse society and dynamic economy. But the end of free movement gives us an opportunity to reset the conversation on migration."

Most EU railways are part owned or subsidised heavily by their governments, but in 2023 the Forth rail package comes into force which will force those governments to replace some of the routes with private ones.

The fourth package is intended to reduce state subsidies and empower state regulators and universal quality standards

 and open up the market

.. a process which given the lack of proper regulation has failed miserably in the UK

The present franchise system in the UK has definitely failed.

I guess that depends on where you live and which franchise you used. Living in the midlands, Cross country (DB) we’re generally good, Virgin West coat was good while London Midland was beset with problems on its cross city route in Birmingham with lack of capacity and cancelled services. The new operators have fared little better.

Northern (Arriva)  seem ok around Manchesterbut further north and in Yorkshire are dire.

All these companies make profit which goes to shareholders while the state picks up the cost of network rail. Seems wrong to me

The start of a new decade outside Europe with a determined government and real power, so here's to you all a happy and prosperous new year.

Britain can do this, you'll see.

I wish I shared your optimism. The £ is still struggling and foreign holidays are going to be expensive.

I think negotiations are going to go very badly with Europe and they're already talking about an extension. If we go in with the same attitude as last time, it's going to be very slow or we crash out with a disastrous no deal Brexit and wreck the economy.

Lets hope some common sense comes in, EEA/EFTA is best way to exit,  but Johnson talks of Brexit as an Event not the long process it is.   Johnson seems fixated on stitching stuff up with Trumpster rather  than being serious about EU links.

We could do with some help from you.

I hope you are right I truly do but not only do I share HB’s concerns I also fear for the many. Post 1979 Conservative governments do not have a good record on Social Policy such as education, the NHS . One by one they will knock down the protections against the five giants

Daniel Hannan hit the nail on the head  -

Freedom includes the freedom to fail. We could become a Singapore, or we could become a Venezuela – or we could become somewhere in between the two, and that will be our decision. That’s the great thing about responsibility as an electorate, that I would rather live in a country where people are free to make mistakes than live in a country where officials who are immune to public opinion tell me what I’m allowed to choose.

I’ve a good feeling about this decade, we have a good Prime Minister and a new Government one that has the strength to get things done and not have to argue the point with the very left wing Labour party.

Of course we won’t always agree with what they do but we will be free to make our choices and can now forget the continual arguments about remain or leave which has ripped this country apart, we will at last obey the voice of the people, all pull together and make this country great again.

This country has been great for many years. It is thanks to the EU we got out of the mess of the early 80’s. In the north and midlands there are countless projects funded in part by the EU.  We didn’t need to leave the EU which only makes ya stronger imho.

I am not sure about a good PM. Being a proven liar and buffoon are not great qualities for a man to lead the country.

The EU aren't funding anything except their own pockets, that is just pennies of the £billions we pay into them being returned.

Mate, it's new years day.  Do I have to go through the news articles and link them here for you.

A recent one - 350 million per week for the NHS, which wasn't true.

Saying there would be no customs checks in Northern Ireland with his deal, even though there would have to be.

What about the lie he told his wife?
