My wife received a PCN from VCS for stopping for 10 seconds at JLA in Feb 2015.

We ignored this and subsequent letters from Wright Hassell but have been receiving demands for £154 from BW legal since April.

I've responded with the "No keeper liability" letters but they are now saying their client (VCS) don't rely on the POFA so my points are irrelevant.

Does this mean we can simply say we don't know drivers name and address or should we now ignore.

They've given us 7 days to pay or will seek instructions for county court proceedings from VCS.

Leave it there

 

If/if not you get a claimform is potluck

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

no, they dont rely on POFA so they cant claim from keeper. Simples

 

However, dont respond to their letter as all that will happen is you will invite them to make assumptions about the liklihood of your paying them or not.

 

It will be up to VCS to make a claim via the courts but that is easily defeated.

However, they play the numbers game and 85% of people dont defend a court claim so if you do get a N1 and defend, they are likey to drop the matter as it will be throwing money away for them.

 

There are dozens of reasons why any claim against anyone at JLA will fail, they dont ahve the right to make a claim being the main one, it is land covered by its own byelaws and they trump VCS' greedy tricks

18 months after the last contact from BW legal we've received a letter offering a 40% discount if paid by April. No intention of paying but is this their normal policy and should I just ignore?

Yes. Ignore and await the next desperate for money begging letter....

Unusual if they are saying a % figure

Its usually minus extra fees added

 

Just dont ignore a letter of claim or a court claimform
