TM legal? why didn't ovo do this themselves as they do but chose to sell the debt on for 10p=£1? funny debt you state you reived a letter of claim, why did you not reply too it.? also is there is no indication of the date this bill comes from on the claimform? how do you know its from 2022? what other previous paperwork have you received? please scan page 1 of the claimform and bothsides of ALL previous letters upto one mass pdf read upload carefully. .................. pop up on the bulk court website detailed on the claimform. [if it is not working return after the w/end or the next day if week time] . When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’. Choose ‘Create sign in details’ to register for the first time. You will be asked to provide your name, email address, set a password and a memorable recovery word. You will be emailed your Government Gateway 12-digit User ID.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

a quick summery ,

 

conditional sale agreement taken out with them 26/11/2014 around £13k total i think

monthly payments £217.58

only got certain parts of my agreement with me as I've mislaid them,

not up to 1/3 payment, that amount is £4279.07

 

had the car from november 2014

only had 1 late payment due to bank account change issue and so far all up to date,

 

 

i rang them in april and explained my circumstances have changed

and i can no longer afford the payments

and asked if there anything they can do to help,

 

 

the guy on the phone changed my dd payment date- i sort of got a month off payment,

which in the agreement i can do this anyway,

 

 

I'm self employed and been though a bad patch since i had the car,

and obviously got crap credit as I've turned to them in the first place.

 

I'm around £25000 in debt without the car been added on and the situation is now dire,

 

 

I'm getting behind on my rent and council tax payments

and the payments i make on the car would be better used to pay more pressing arrears.

 

whats the best plan for me to return the car to moneybarn?

 

im not going to lie,

ill either be in forced or voluntry bankruptcy by the end of the year as its got to much to ever pay back

and survive with the money i earn.

 

just need some advice on where to go

From previous experience, if you return the car, it will be auctioned off and the proceeds used against the balance you owe. Ther should be a rebate of interest if the agreement is ended early but not always the case. Either way you will have an outstanding balance which they will chase you for, this can then be placed into the BR if thats the route you go down.

Not always the case that BR is the answer, depends on more than just the amount you owe to all your creditors

you need to VT the car.

 

 

follow this:

 

 

Section 99 of the Consumer Credit Act gives the debtor the right to terminate a hire purchase agreement,

simply by giving written notice of termination.

.

The right to terminate applies at any time before the final payment becomes due, unless the creditor has already terminated.

.

contrary to the line taken by many finance companies,

.

the debtor need not have paid half the total amount payable,

.

and nor do they have to pay any arrears,

.

before exercising the right to terminate.

.

Sections 99 and 100 set out the debtor's liability on voluntary termination. The sections are complex,

.

but their main effect can be summarised in brief as follows.

.

.If the sum of payments made and arrears before termination exceeds 50% of the total price,

than the debtor is only liable to pay the arrears.

.

Otherwise, the debtor is liable to pay half the total price, less any payments already made.

.

so the debtor can terminate at any time if he has reached the 50 % mark

.

the debtor can terminate at any time before the 50 % mark but would be liable for payments still to reach the 50 % mark,

.

does not matter if the account is in arrears at the time or request to do a voluntary termination.

.

you need to specifically nail them down that this is a VT and NOT a VS [volutary surrender].

dont get caught out!!

take extensive photos of the car inside and out

and underneath and in the engine compartment ALWAYS.

if they try and charge a repo fee or collection fee they cannot:

173 Contracting-out forbidden.

(1)A term contained in a regulated agreement or linked transaction, or in any other agreement relating to an actual or prospective regulated agreement or linked transaction, is void if, and to the extent that, it is inconsistent with a provision for the protection of the debtor or hirer or his relative or any surety contained in this Act or in any regulation made under this Act.

This term is covered by the above section of the CCA 1974 in that it breaches this:

99 Right to terminate hire-purchase etc. agreements.

(1)At any time before the final payment by the debtor under a regulated hire-purchase or regulated conditional sale agreement falls due, the debtor shall be entitled to terminate the agreement by giving notice to any person entitled or authorised to receive the sums payable under the agreement

In other words nothing can stop you voluntarily terminating.

The only charges you must pay are the ones contained in the legislation and itemised in section 101, the charge mentioned is levied after the agrement is terminated and is void in any case. All it means is that no one will collect the terminated car(their car), well that is ther problem it is no longer yours , you attachment to the car ha been terminated.

and with regards to the car been returned, it wasn't in showroom condition when i had it, so will they try to make me pay to restore it?

As dx said. Take photos and video of every part of the vehicle.

 

You only pay up to 50% of the car value and any arrears. If you are already 50% and over with no arrears, you pay nothing else. You certainly dont pay for any collection fee, any admin charges etc.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

They cant charge you for recovery agents. It's their problem to collect the car if you VT'd it. Not yours.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I have VT'd a couple of cars and as DX has said make sure you get loads of photos and/or a video of the car,

go with the person when they do the inspection,

 

 

minor wear and tear is acceptable, they will not be getting a show car back.

 

The last one I VT'd reckoned the car was damaged when they received it

and didn't make it's estimate at the auction so they actually lost money and wanted me to pay the difference.

Hi all. Well the cars got 85k on it and 6 years old.

 

 

So as any other car it's got dings and marks everywhere.

Most of which were already on it.

 

 

They also asked for the service book.

Which I never had when I got the car.

 

 

I worked it out I owe around £2400 to make the 50%.

 

 

I'm paying no more.

 

 

I'll let you know when I get another update
