    • I have recently found myself in financial difficulties and with the help of forum members in another thread regarding this, I think I can get myself sorted. My query here is how to deal with a Cifas marker that has been logged against me by one of my creditors for "evasion of payment". Admittedly yes I did get a £5000 loan with them and have not paid any payment but at the start of the year, which is when the loan landed, I realised I was going to be struggling to repay that and other debts and I contacted MCB to ask if there was any way I could extend the loan from 24 months to 36 months. I explained my situation and that I was going with a DMP and asked them if they could help me with this. They did not reply. I then emailed them again a month later explaining that my DMP was going ahead and could they confirm that the direct debit was indeed cancelled. Again, they did not reply. The DMP fell apart and so did everything else thereafter. My bank withdrew my overdraft and said I could not stay with them (I thought initially that it was because of the DMP) so I opened another account (Starling) and set up all my direct debits etc with the new bank. A month into being with the new bank, they contacted me and said they were closing my account in three months. So I started applying for other basic accounts and every single one of them either refused or revoked.  Through the help in the other thread, I requested a SAR from Cifas and discovered that I have this marker against my name for "evasion of payment". I have logged a complaint with MCB on the advice of other forum members, but my query really is do you think the marker is fair given that I did ask them for help and I did explain that I was going to be struggling financially to repay the loan over the original two years, and is there any way that I can get it removed? I fully admit that I have yet to make a payment to them and I suppose in my naivety and panic I thought if I emailed them early on they could extend the loan and help me out, but they didn't even reply  I did manage to open an account with Monzo before the marker was in place, but I am very concerned that if Monzo do what Starling did, I will have no bank account to pay my bills or get my wages paid into.  Realistically based on the information I have given here, what do you think my chances are of getting this marker removed? Any help/advice on this would be greatly appreciated x
    • Thank you dx, that is what I intend to do now. I have gone through all the SAR documents, a lot of which I am seeing for the first time! As per my previous post #116 letters and statements alleged to have been sent to me, as recorded on their system notes I have not received. Letters I have sent requesting information and account statements have not been recorded as being received by them, all were sent either by Recorded or Special Delivery. I have all the proof you menrtioned from my files for payments and from their SAR info for fees added. Thanks t
    • In my experience (not with car payments) but with many other things, my partner has been ill and signed off in the past and we have been unable to meet various commitments.  Naturally if you ring the call centre they are going to fob you off and tell you you must pay, that's why that never ever works. I would obtain a note from her GP listing all her health issues plus medications plus side effects, then write to the finance company with a copy of it, explaining the situation, as you have here, asking for a payment holiday. Perhaps mention that the car is very much needed for hospital appointments etc. It's likely the finance company would rather you pay till term end than, chase you for money they will never see, and sell the car at auction for a loss,  You can search some of my threads going back years, advising people to do this for Council Tax, Tax Credits, HMRC, Even a solicitors company and it always works, because contrary to popular belief people are reasonable.
    • Sorry, I haven't ever seen one of these agreements. Read it all and look out for anything that says when she can withdraw and when she is committed to go ahead. If it isn't clear she may need to call the housing provider and simply say what you posted here, she doesn't want to go ahead and how does she withdraw her swap application?
    • Thank you! Your head is like a power bank of knowledge.  Her health issues are short term, due to a relationship breakdown she took it pretty hard and has been signed off work on medication for 3 months. She only started her job in February 24 so does not qualify for any occupational sick benefits, which is where the ssp only comes in. (You will see me posting a few things over the coming days, whilst I try and sort some things for her)  I sat with her last night relaying all this back and she does want to work out a plan, she was ready to propose £100 for the next 3 months and then an additional £70 per month onto of her contractual to "catch up" but Money247 rejecting the payment holiday and demanding £200 thew her, which is why I came on here.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Close to American check in desk.

Timed for the busiest time of the day.Many people on business,going on holiday etc.

More bombs found as people were being evacuated.

Another tragic day.Watching things unfold.

Developing situation.

Terrifying it must be for those in Brussels today.

Just heard on BBC,talking of the Metro.

Fog of war,everything will become clear.Police,cars,army,fire,talk of new explosions on underground.Confusion.

Now Belgian media is reporting that an explosion has been heard at Maalbeek metro station.

 

Maalbeek is about 400m from the Berlaymont building, which houses the European Commission headquarters.

 

Other reports suggest there were explosions at the Arts-Loi and Schuman stations.

 

The Brussels metro system has been shut down and the country has raised its threat level to 4.

Yes i have heard that as well.

Maelbeek station reportedly hit.Near European Quarter.

Reports of injured being taken on luggage trolleys to ambulances.

Airports across Europe rapidly tightening security.

Airport,rail links,and eurostar affected.

Talking now of suicide bomber.

Coordinated attacks.

Nightmare, possible multiple attacks,some are saying another Paris.

Explosion Metro near EU institutions.

May be many dozens of injured.

Threat level 4, only second time since world war 2-allows Belgium army to organise .

Subway shut.

Developing ongoing situation.

All public buses transport closed.,EU diplomats told to stay put..

I have a feeling that there could be attacks like this accross Europe this summer, as the conflict from Iraq/Syria expands.

 

This will not help the referendum on the EU, as some will naturally believe that isolating the UK from mainland Europe would help with security. In reality, you cannot isolate yourself, as terrorists don't recognise borders. The UK relies on having a lot of surveillance and security services acting before attacks happen.

We could do with some help from you.

I can't understand these people, they have to be thick. Surely the gratification of such an act is to see the aftermath of what you have done, suicide bombing makes sure you don't have that pleasure.

 

If they just hang on a few years, there will be enough of them in Europe to be elected to our parliaments. This plays fully into the hands of the right wing parties like the English Defence League making them stronger and stronger.

We have seen that in the recent local elections in Germany.

 

There will be a revolution in the not too distant future and all Muslim will suffer because of a few nutters.

Brussels attacks: Latest travel advice following blasts at Zaventem airport and Maalbeek Metro station

The Foreign Office is warning British travellers: “Stay away from crowded places and avoid public transport at this time. The Belgian Crisis Centre has given the Belgian telephone number 0032 2753 7300 for concerned family/friends.”

 

The attacks in Brussels have had immediate travel implications.

There was a security expert on a radio programme saying that if you are catching a flight from any airport, go straight to check in and get through security ASAP. The safest part of an airport is near the gate to the aircraft.

Cities that have suffered multiple terrorist attacks, such as Istanbul, Nairobi and Bombay, already screen passengers and their baggage before they are allowed into the main terminal building. The problem for European airports - especially crowded and constrained Heathrow and Gatwick - is that very significant remodelling would be needed to allow that to happen.

 

Hmm, so is this going to be the clincher to allow either expansion or another airport ?

The worse part of this is that Sky will now be reporting the same thing with the same bits of video 24 hours a day for the next week and all under the banner of 'Breaking News'.

 

I knew it, turn on the telly this morning and there is 'Breaking News' on Sky - a bomb has gone off in Belgium - what is it with them and their breaking news.

Brussels, Belgium (CNN)In grainy images from surveillance footage, a man wearing light-colored clothes and a hat pushes a baggage cart through the airport.

 

It's one key piece of evidence authorities are looking at as they search for suspects after two explosions at the Brussels airport and another at a busy metro station in the Belgian capital Tuesday killed at least 30 people and wounded 230 others.

 

ISIS claimed responsibility for the coordinated attacks, but authorities said it's too soon to say for sure whether the terror group was behind the blasts.

Two of the suicide bombers who carried out attacks in Brussels on Tuesday have been named as brothers Khalid and Brahim el-Bakraoui, Belgian nationals.

 

The federal prosecutor said Brahim was part of the attack at Zaventem airport that killed 11 people. Khalid struck at Maelbeek metro, where 20 people died.

 

Two other attackers at the airport have not yet been identified. One of them died, another is on the run.

Apparently there are two police forces who speak different languages who simply do not share information ?

The Brussels terrorist attacks are raising serious questions about why Belgian security forces were unable to protect high-profile targets like the city’s airport, despite warnings from their own intelligence services that Islamic State militants were poised to strike.

 

Fears of a possible terrorist attack in Brussels have been running high for months. The Belgian government went so far as to lock down the capital last year after receiving specific intelligence that a group of extremists were plotting a bombing and gun assault in the style of the Nov. 13 attacks in Paris that killed 130 people.

 

The lockdown was lifted after four days, but the government’s performance fueled criticism that it was behind the curve on the terrorist threat. Belgian security services also came under fire for having monitored and tracked several of the Paris attackers without informing their French counterparts about the suspects.

 

 

 

 

Concerns about Belgium’s ability to counter the terrorist threat were reinforced after it took authorities four months to track down the most wanted man in Europe, Salah Abdelslam, who was hiding in the Molenbeek neighborhood of Brussels. Abdelslam is believed to be the last surviving member of the Islamic State cell that carried out the devastating attacks on Paris, and authorities had repeatedly raided the neighborhood before apprehending him.

 

 

 

Counterterrorism experts said Belgium now finds itself confronting a terrorist infrastructure that has planted deep roots in Belgian society as the war in Syria has escalated. According to figures assembled by Belgian terrorism researcher Pieter Van Ostaeyen, as many as 562 Belgians have fought in Iraq or Syria. At least 124 hail from Brussels. With a population of 11 million, Belgium has sent more fighters per capita than any country in Europe to the charnel house of the Syrian civil war. According to Van Ostaeyen’s figures, at least 75 Belgians have returned to the country — making it nearly impossible for the country’s small and under-budgeted security services to track them all.

 

“The bigger problem is that such a thriving terrorist infrastructure was allowed to establish itself in the first place,” said Bruce Hoffman, the director of the Center for Security Studies at Georgetown University and a counterterrorism scholar. He added that “key operatives and senior [islamic State] commanders are based in Brussels,” where they’re able to draw “on a network of operatives and also sympathizers.”

I have a feeling that there could be attacks like this accross Europe this summer, as the conflict from Iraq/Syria expands.

 

This will not help the referendum on the EU, as some will naturally believe that isolating the UK from mainland Europe would help with security. In reality, you cannot isolate yourself, as terrorists don't recognise borders. The UK relies on having a lot of surveillance and security services acting before attacks happen.

 

You have to ask yourself who is benefiting from that. Surely not the Muslims.

 

I wouldn't be surprised if one day we discovered there is Vladimir's hand on it. It's not a secret that Russia is rooting for a break up of the EU. They have pretty much created the cause for the exodus of refugees from Sirya, then facilitated their entry into Europe, so they can break the EU from within.

 

Imagine the EU is broken, Russia can then invade the ex Communist countries, plus Greece and Cyprus, why not Italy, after all they are broke and bankrupt.

 

Then they can put their missiles on friendly soil and point them towards Germany and Britain.

apparently belgium were informed of one of the twats' high status by Turkey when they deported it. and were also known by other agencies as very suspect. some belgium ministers offering to resign as a result. bbc.

wld've thought there is a global share amongst allies re such intelligence info? either in or out of the EU?
