Hi dx,

Thank you very much,

I could not believe that document i was sent is not classed as an out and out CCA,

i be very interested to hear what i should have expected.

 

My understanding at the moment, Terms and Conditions sent to me should have included my name,

whereas it's just a standard T&C's print off.

 

The document they sent to me as a CCA, is not actually a signed agreement as a CCA should be,

but more like the signed application, also there are no rate charges listed.

 

I look forward to any updates, many many thanks for all the help!

Excellent find, Halifax sent me exactly that, looks nigh identical lol

 

Only thing is .. what is the final verdict, is it deemed enforceable or not?

 

I read the posts and seems no direct answer thus far :(

As yet they have not been in contact, I will keep you posted anything surfaces.

 

What i have recently received but in relation to a different CCA request for an old BOS account,

is a request via a text message from the DCA (Idem Servicing) for me to contact their offices by telephone.

 

The letter of reply to my CCA request stated .

 

.. unfortunately, we are unable to supply a copy of the credit agreement and we acknowledge that until we do so the agreement cannot be enforced.

 

However, the balance of the account is still outstanding and we will continue to pursue this debt which will include registering any arrears with the Credit Reference Agencies (This account has already served the 6 Years as a default account)

 

I have not made any reply to this whatsoever thus far,

 

the words in their own letter NOT ENFORCEABLE says it all in my opinion :)

yep and if the default is over 6yrs old

the account will not now ever show on your credit file either.

Yes dx that is correct, none show on my record at all now, all cleared now.

 

all were defaulted and all showed as defaults for the 6 Years,

originally as i said Halifax were very late to default,

so that went on my file later than all the others did about 2 years later,

but that has also served it's 6 Years now,

and that off my file now too, so finally got a credit rating again :)

I have just received a 3 page A4 letter from PRA Group informing me that account has now been transferred to the Investigations and litigation Department.

Please see the images i have attached with my personal details edited.

 

I have not communicated with Pra concerning this.

 

Any advice on this would be very much appreciated as always

''Investigations and litigation department'' You have to love the names they give themselves, why don't they just call themselves as they are, 'desk 1', 'desk 2', 'desk 3' 'broom cupboard' yadda yadda yadda...

 

Atts not attached, but IMO, and without seeing their puerile missive, I say ignore.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

that you might owe money..

not a letter before action.

CCA That i received was sent as 2 A4 Pages .. Please see attached.

 

Hi dx,

 

Their Investigation - Litigation Letter states it triggers certain time limits that effect me.

 

1. you are expected to acknowledge and answer this letter before claim by 05/06/16;

2. you are expected to respond to the invitation to refer this matter to ADR (alternative Dispute Resolution) by 05/06/16.

 

Should i not be replying?

Thank you dx for sorting my post,

makes total sense to now have the Halifax stuff on its own, away from the other debts i originally quoted it with!

There are lots of things we're 'expected' to do, like looking before you cross the road, putting litter in bins, having lights on your bike at night etc etc etc.

 

IMO this is simply them trying to appear professional and failing, miserably, that CCA is hilarious!
