And the reason you don't fill in the postal order, is because they will always return it claiming that the recipient is wrong,

so leave it up to them to find someone who can write to fill it in.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Thanks DX - That makes me feel a bit less anxious. - I sent the CCA yesterday (by recorded, havent had a chance to view the boards so missed the advice on Spec Del!) So will see what happens in the next couple of days.

Signed, SAR's are the only document that requires your written signature.

This will hopefully negate their attempts to frustrate the process by saying they cannot ID you.

There can be no other reason that to delay things. I don't like sending postal orders, if they are filled in with a payees name, they are a devil to get money back on.

Being empty of a payee means they can fill in whatever or whoever they want, so this is just to delay things. Perhaps they haven't got what you want and hope you wont ask again.

there is no need whatsoever to sign a CC request

nor enter the payee on the Postal order

just cabot being obstructive

Well if they had sent it back claiming that it needed to be filled in, I would have held on to it, and ignored them entirely as they failed at the first fence.

 

Did you say you have now filled it in like they demanded and resubmitted it?

remember to start the 12+2 from the first time you sent it. Not the second.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Yes definitely!

 

However now you've sent it, and followed their orders, they're likely thinking they have a mug to fleece, so from now on, they dance to your tune, you certainly don't dance to theirs.

 

Even though they will be outside of the time limit (12+2 working days) you don't need to inform them of this.

Just sit on your hands and wait for them to magic up an agreement.

DCA have come back (after 12 days!) with a letter saying they don't have all of my information on file

they have requested the agreement from the OC and will contact me when they have something.

 

From what I've read on other threads i was expecting them to make reference to the process taking 40 days etc,

 

 

but theres no mention of this so not sure what to make of the letter i have and whether this is a good sign or not!

I believe Cabot have had their hand smacked by the authorities about this last week

Theyll come back with something that is very vague and doesnt meet the requirements, but will try and say they do.

If you could establish for sure when the last payment was made, then add on a couple of months then you could work out if this is or about to become statute barred.

 

You say the account was sold to DCA in 2006, so did you make payments to them ?
