    • To start, my address both on my logbook and with the DVLA are correct.  The first I knew of the bus lane fine was when a woman on another floor in my building posted a photo of a letter addressed to me but with her address on it, on the building's facebook group. I obviously recognised my name so contacted her. She said she'd been receiving these letters for me for months but only asked in the group if anyone knew me when the bailiffs were at her door.  I contacted the debt collection agency and Manchester Council and was told to appeal. So I did and explained what happened said I was more than willing to pay the original fine but its now at over £400 and I would have paid straight away if the letters had gone to the correct address. Months have passed and I have just been told (with no reason) that my appeal was unsuccessful and I need to pay the full amount.  Any help would be appreciated! It just seems so unfair!
    • Exactly right Bank!  I had an email this morning from HM Courts and Tribunals Service Civil Money Claims: Dear Mr xxxx Claim number: 527MCxxx Parcel2Go.com has been given an extra 14 days to respond to your claim. They need to respond to your claim before 4pm on 4 June 2024.  Anyone would think you've been through this before!
    • OK, understood. The second decision to make, given PE are wobbling, would be whether to reply to them (well after 8 May to show you're not scared of them), ridicule their offer which is no offer at all, and ask them to make a serious attempt to settle.  You never know, they might offer a few quid as an out-of.court settlement and it might save your mum having to do court. Just an idea.  Something to consider.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Link bought four of my barclaycards with average amount of debts over £10k each

and I am paying £1 one of them and the rest of £55 each

 

I had the cards for a long time over 12 years but nine month ago they have sold it to Link

 

Link wrote to me at the time and said they are happy for me to carry on these payment

 

And so I did pay on time since and they have not said anything so far.

 

MY debts is about £50k and this was mostly due my business

 

But the good thing about this is There is NO DEFAULTS on my file with any of my barclaycards

 

I am wondering why this is

 

or any suggestion what i should do

 

I am happy to carry on with the payment for next few years but where would that ends

that's strange they did not default them before sale.

not got heaps of charges have you

but I pay on line to link and I know that the amount is decreasing and there is no interest adding

If CCA them i am sure they do not have any thing to produce but what happens next what can i do next

One question. How much have you paid in total to link?

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Can we have more info :-

 

1. When were these cards taken out.

 

2. When did you become unable to service the required monthly minimum payments.

 

3. How and when did did you come to an arrangement to make reduced payments for the cards.

 

4. Between the dates in 2 and 3 above, did you incur penalty charges, which you can reclaim.

Hi

I had Barclaycards for a long time

 

 

the first one most probably 15 years and

then after few years they gave me one after another and

I can not remember I had signed any document at all mind I was very good customer at the time

 

I think it was in early months of 2013 I could not pay the payment as they were very high

 

 

I wrote to them sample letter and they Froze the interest

after two month they accept my payment and they kept the statement going and I have all the correspondence and statement

 

And after 5 or six month I had Letter from Link saying they have bought the debts

and send me four letter one after another three of them .

 

and in their standard letter mention that they are happy with the the same payment which was £1 and £55 and £55 and £36

 

I must point out that The £1 payment was originally £55 with barclaycards but they made a mistake and was asking £1

 

There was interest added for two month or may be more but when they accept my offer they stopped

 

I am just about ok to pay them and If I CCA them and SAR where this is going to take me

 

would it be a chance for link to drop the debts or would it be better for negotiation to reduce the amount

to a 10 to 15 % for Final settlement of the debts

 

Any suggestion

if they have no paperwork it would put you in a VERY strong position to low F&F

but you MUST get them to either REMOVE the account totally

or

mark them SETTLED not Partial settlement.

Because you serviced the a/c's up until relatively recently (2013), and because you were quick to get an arrangement(s) to pay, there will have been little or no penalty charges. So reclaiming these will not be a useful option.

 

Proceed with the CCA requests to Link and you can decide what to do in light of their responses.

Today i have received three letters from link saying that if i do not come up with better term of payment

they will default my file as barclaycard has not done so by mistake last year

 

And I have 28 days from 9-12-2014 either contact them and give them better term of payment or add the three defaults to my file

 

refresh your memmery my debits are

 

£13800 , £13500 ,£9200 and my payments £55 & £1 & £36

 

I would like to settle with them in order not to get the defaults and i have 15% that is max i have

 

or the time has come to CCA them first as I was going to do it a month ago
