Hi All,

 

I don't know if anyone can help.

 

In 2009 i had a payday loan from Rapid Cash based in Manchester.

My husband had just been made redundant and we were majorly struggling.

 

In the end they lodged a CCJ against me which is for £325.

I want to make them a one off offer of settlement as i need it to show as satisfied on my file for my mortgage application but i can't get hold of them !!

 

Are they still trading and if so is there a website for them?

If i can't get hold of them to pay,

what do i do about the CCJ as its on there until next year and i really need to show it as paid :(.

 

Any advice would be grateful.

 

There must be other instances where a company lodges a CCJ then goes bust themselves leaving the defendant with no way of paying it off!

When the CCJ is paid in full, you can apply to the court for a certificate of satisfaction. This will show the CCJ as paid, but it will still be on your file for the remainder of 6 years.

Ring the court and explain that the Claimant cannot be traced - I think you should be able to pay the court.

Wouldnt the court have an administrator? Not sure they could pay the court as the money would still have to go to the claimant.

If they have a CCJ : it can't be statute barred.

Statute barred is when sufficient time has passed that they can no longer institute action to obtain a CCJ :

but they have one already.

The court has no discretion if you can show a statute bar.

 

If they haven't taken action to enforce a CCJ,

then it may be that they reach a point at which they would need permission from the court to enforce a CCJ :

but this isn't a "statute bar".

The court retains discretion as to if it allows enforcement of the CCJ.

If the CCJ isnt on your files, then its likely unable to be collected. Check trustonline.
