    • Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about about as I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy? Red lots of different threads on here. And unsure what true and what isn’t.

    • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I have recieved a letter today from Mortimer Clarke Solicitors,

stating that they are solicitors instructed by Cabot Financial

and are instructed to start Court proceedings against me over a debt.

 

I have not seen anything from Cabot Financial at all, didn't even know they existed before today,

and now i get a letter saying that they are taking me to court?

 

The letter states that i owe Lloyds TSB 931.39 pounds.

 

From what information i have, the only money i have ever taken from Lloyds was a 50£ overdraft back in 2007,

as i had left the country in 09/2007 (and returned in 2009)

- this is the first ever communication I have recieved since then in my name.

 

The credit reports in my name state that the debt was defaulted in September 2008,

so, technically, it will become statute barred only in September.

 

Is there anything I can do about this apart from coughing up?

 

As over 900 pounds seems unreasonable seeing that no payments or acknowledgements have been made since 09/2007.

DON'T part with a single penny!

 

I'm thinking whether a SAR to Lloyds would be a good Idea, all though I am unsure as to when they would have closed the account?

 

The marker on your file is just when it was defaulted and placed on their, it may well be SB already?

If you know 100% that you haven't acknowledged this in writing or made any payment toward it since '07, then it is highly likely this will already be SB.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I would suggest that you write back (recorded delivery) to Mortimer Clarke saying that you have no knowledge of any debt that is outstanding,

which would not be subject to the statute of limitations act 1980.

 

Ask them to arrange to supply original creditors statements of account, showing when the last payment was made

and when the account technically went into default according to the accounts terms and conditions.

 

If you are sure that the last payment was made Sept 07, I don't think it is reasonable for the default to only be marked a year after i.e Sept 08.

 

I would have thought that the default should have been noted within say 3 months,

as it would be wrong to continue adding charges for a year, before issuing the default notice.

 

I think if you ignored this letter and did not write back, that they will probably issue a court claim, hoping to get a default judgement.

 

Better to get them to prove that the debt is not statute barred.

Send the prove it letter. If cabot are involved, be very wary.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

You could send the SAR with £10 to Lloyds, but they could take up to 40 days to supply the information.

 

If it were me, I would try to phone Lloyds to get hold of the last payment information and when the account should have gone into default. I would then send Mortimer Clarke a letter. Don't just send the SAR off, without sending a letter to Mortimer Clarke.

Don't just send the SAR off, without sending a letter to Mortimer Clarke.

Send the prove it letter. If cabot are involved, be very wary.

 

They know what the debt is, as they have checked their credit record. It appears to be their only debt. Ideally they want to find out the last date of payment to Lloyds and when it should have gone into default. They can then challenge that the debt is statute barred.

In my first response to you, I suggested what you could say in a letter. I don't think I would send a standard template letter. You seem pretty sure that the last payment was made in Sept 07, but I would suggest that you try to phone Lloyds to find out if this is the case. Also ask them, when the account should have gone into default. I don't think the Sept 08 default on your credit record can be correct, if your last payment was Sept 07.

Your actions should be as already advised..

 

1: Telephone Lloyds - find out when the Formal demand for payment was made.

2: Letter to Cabot along the lines of Uncle B's suggestion in post # 3

 

The letter you require can be accessed using the following link. It would be best if you use this only as an outline and follow Uncle B's suggestions.

Sorry about asking twice about my course of action, I just wanted to make it absolutely clear before I proceed.

I will call Lloyds on Monday and send the Letter to Mortimer Clarke the same day and see how it goes.

There is also a question as to who owns this alleged debt, whether Cabot are acting on behalf of Lloyds or they have bought the account. That would be another question to ask Lloyds (over the phone), although if it has been assigned, they should have volunteered the information
