Hi, I have a CC Claim to deal with and

have sent a Sect.78 request to the creditor 1st Credit and a CPR34.14 to Moonbeever.

My defence is due and I have had no info to date,

please see all correspondence attached.

One last thing I ticked the wrong box when returning the cc claim form, I

ticked 'defend part of claim' but meant to tick 'defend all claim'.

I am going to phone the court in the morning to explain.

Not sure what to do about the defence though.

Thanks in advance for your help.

What are they on ? They have issued a claim they cant simply "put things on hold" there is now a court timeline involved and that is what you have to adhere to.

Have you another thread with the details of this claim in ?

No associated sheets of any T & C have been sent, just the uploaded unreadable CCA with some statements and a change of legal rep from moonbeever to 1st credit.

so you have consistently used this card since 1994?

theres PPI here [have you got the statements?]

for a card from 1994 a PPI reclaim will easily wipe the claim sum out I bet

though sadly this cannot be directly used as a defence.

Yes this card has been used since then but not an awful lot. Do I contact 1st credit and arrange a settlement figure or payment plan? Put a PPI claim in progress as well? I realise that any PPI would go to 1st credit though.

no it wouldn't it would go to your pocket the debt has been sold

however, as said ppi cannot directly be used as a defence to a claim.
