    • Thanks for that, Bazza. It sheds some more light on things but I’m still by no means sure of the OP’s father’s likelihood of successfully defending the charge. This in particular from the guidance stands out me: He does not meet all the s88 criteria. S88 is clear and unambiguous: It makes no provision for either the driver or a medical professional to make a judgement on his fitness to drive under s88. S92(4) and the June 2013 guidance you mention defines in what circumstances the SoS must issue a licence. It does no modify s88 in any way. However, delving further I have noticed that the DVLA provides a service where the driver can enter a relevant medical condition to obtain the correct documentation to apply for a licence: https://www.gov.uk/health-conditions-and-driving/find-condition-online I haven’t followed this through because I don’ have the answers that the OP’s father would give to the questions they will ask and in any case it requires the input of personal information and I don’t want to cause complications with my driving licence. It is possible, however, that the end result (apart from providing the necessary forms) is a “Yes/No” answer to whether the driver can continue to drive (courtesy of s88). With that in mind, I should think at  the very least the OP’s father should have completed that process but there is no mention that he has. But the significant thing which struck me is that it is only the least trivial version that does not require a driver to report his condition to the DVLA. But more significant than that is that the SA Trust makes no mention of continuing to drive once the condition has been reported. The danger here is that the court will simply deconstruct s88 and reach the same conclusion that I have. I accept, having looked at the DVLA guidance, that there may be (as far as they are concerned) scope for s88 to apply contrary to the conditions stated in the legislation. Firstly, we don’ know whether there is and secondly we don’t know whether the OP’s father would qualify to take advantage of it. Of course he could argue that he need no have reported his condition. The SA trust certainly emphasises that the condition should not be reported until a formal detailed diagnosis is obtained. But the fact is he did report it. As soon as he does that, as far as I can see,  s88 is no longer available to him. Certainly as it stands I maintain my opinion that he was not allowed to continue driving under s88. The only way I would change this is to see the end result of the DVLA exercise I mentioned above. If that said he could continue driving he would have a defence to the charge. Without it I am not confident.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi guys, I need some help please.

 

I recently returned from a family holiday to the Gambia,

where on our first day we attended the TC Rep's Morning Reception Talk to give us an overview of the resort etc.

 

We booked 2 excursions which totalled approximately £297 but they took £3100'ish which took me overdrawn

and of course i've been hit with costs and several returned DD's which compounds my problem.

 

The main problem was the fact I didn't have an overdraft facility,

so firstly i've hit the bank for an explaination why they allowed £3k to be taken when a facility wasn't in place

and secondly to TC to complain and recoup the money plus costs.

 

As this happened on day 1,

it didn't actually leave my account until day 8,

in which time i'd spoken to several departments in my bank only to be landed

with a foreign muppet who didn't have any concept of my situation.

 

This has ruined our holiday as i've not been able to access any funds for the second half of the holiday

until my wife rang her bank to ensure she could use her Debit Card abroad

without the fraud dept stepping in etc.

 

We had to eat at the hotel for a couple of evening meals whilst my wife sorted her bank out a

nd the telephone calls on mobiles and landlines from the room are clearly being added to my complaint.

 

The TC Rep kept telling me that the bank were going to return the funds etc

but as yet it still hasn't been returned and i'm not building my hopes up that this will happen to be honest.

 

Hopefully you guys can advise how best to complete my complaint to both the Bank and TC.

yes, on a hand held terminal and then signed for on the receipt . . . however the receipt didn't carry the ££ or Dilassi value and the point of my entering my pin number didn't display the value either, so I didn't pick up on it . . .

Get chargeback from the bank they should refund it straight away and investigate afterwards

 

But sometimes they like to investigate it before any refund

 

You may need to change any income into another bank for now to prevent bank taking fees out of it

hi guys, this is still dragging on!!!

 

I had all but the cost of the trip refunded by the banks in question,

 

 

however, Thomas Cook is another thing . .

 

 

. we incurred £270 costs for bank charges, including various bounced DD's etc, telephone costs to the UK

and several extra meals at the hotel whilst we sorted an alternative way of getting some money . .

 

 

. so all in all TC have offered me £400 in Cash or £800 in vouchers . .

. really not sure i'm happy with that seeing as though this happened on Day 1 of a 2 week holiday

and in fairness put a dampener on the entire holiday and joking aside

it was stressful knowing i couldn't do anything about it until we got back to the UK . .

 

 

. just want to know whether TC can increase this offer as a general rule of thumb?

 

 

any advice guys?

 

 

TC aren't budging at the moment . .

 

 

. they're waiting for my next play

yep, actually hard fact losses were £270, i've asked them for that in cash and £1250 in vouchers for the stress of it all but they're saying £400 cash or £800 vouchers as full and final settlement . . . but don't know what rights i've got to demand real compensation

You can claim for the £270 'hard loss' (that loss which was not refunded by the bank and was incurred as a result of TC's / its agent's actions if they were negligent)

You can claim for the loss of enjoyment.

 

In general (case : Addis v Gramaphone) you can't claim for disappointment under UK law.

However, holidays are an exception (as the main purpose of the contract is a holiday, that is for enjoyment) (case: Jarvis v Swan's tours).

The holiday was £5k and actual costs were £270 so £130 compensation doesn't really sit well . . . I know after the event now we are home and no real harm has been done it seems petty, but at the time trust me there was real stress as one of the bounced DDs was to HMRC . . .

They're great links from BazzaS. But personally I think you would struggle to get a much greater amount of money if you took TC to the small claims court. I can appreciate why the experience was deeply frustrating and stressful, but your losses were limited and the holiday itself was presumably delivered as advertised (unlike Mr. Jarvis' 1970s ski holiday!). Might be time to draw a line under it and move on.

Except that due to TC's agents error, the holiday wasn't the stress free relaxation anticipated, but had the enjoyment ruined by the stress of the bank issues, which resulted directly and in a foreseeable manner from TC's agent's actions ...... So, the argument is that they didn't deliver a stress free holiday!

 

As this is a "non-pecuniary" loss, it is hard to quantify.

One of the courts roles is to decide IF there is fault, and if so then a further role is to try (as best anyone can) to put an estimated value on any loss.

 

It might be worth researching the awards made in similar circumstances .

 

£5k holiday?? How about £1k cash

(Don't ask them for vouchers : if they ruined one holiday it looks odd to be planning on using them again - if they want to offer a sum in cash or double in vouchers, let them .... It gives you an idea of the margins they are making, though!)
