    • sorry but that letter needs to be much much better. you need to express that it was a stilly youthful mistake trying to be the big man and jumping the turnstile to look big infront of your peers. TfL prosecutors are on the email address on their first letter. get the court form sent back to the court , (but copy it first) stating you plead guilty and wish to attend to address the judge in person face to face to show your genuine remorse for your stupid youthful exuberance.      
    • I thought I should send the begging letter to the prosecutor. Does the hearing means the time I need to send back by? I hope that I could teach the lovely students again, which may not be allowed with a criminal record. I would please ask that you would please provide me a single opportunity to settle all outstanding sums owed outside of court without the need for legal proceedings which would have a determinantal impact on my teaching career.  I sincerely apologise again for my crime.     • Utter Rubbish!! lowell dont write and beg for deals once they start court. as for your attitude, we'll thats nothing new for you.😎 you wont be quizzed, it's not like TV, simply refer to your defence/WS when answering anything the judge may ever ask. well it involves chickens. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, my partner has decided to hold out and wait for the full amount, accepting their offer as partial payment only. :)

 

So, my plan is to write back to Colin, (who made the offer) explaining that i will be accepting as partial payment only and will settle in full and final when the remaining £350 has also been paid.

However, I have a couple of questions:

 

1) A charge of £45 is due to be applied on the account tomorrow. Can I add this charge on to the schedule and explain in the letter that I would also like this returned?

 

2) I received confirmation from the Court (today) explaining that the claim was deemed served on 6/12/06 and HSBC had until 20/12/06 to reply. However, I called the court on Monday as I hasn't heard anything and I was told HSBC had acknowledged on 8/12/06. (The letter was dated the 11th)!!! I know that's quite confusing but I'm not sure whether they've acknowledged now or not!!!!

 

Last question you'll be glad to know!!!

 

3) The Court letter has the 'Request for Judgement' section which I need to fill in and return. Now, as I am going to be writing to Colin re: his offer, do I need to return the request for judgement? (If I do, what do I need to put?)

 

 

Sorry that this is so long winded.....I just really want to be as accurate as possible.

 

I would greatly appreciate any guidance/advice.

Just to add to what Michael has said Lisa, this offer letter you have received is not in response to your court claim - it will have been in response to your prelim or LBA if its from Colin. Thats why it doesn't include court costs. Hold out and you will be hearing from DG solciitors in due course who are handling the claims once they've gone to court.

Even though I read people's success stories on here every day, I still can't help feeling quite anxious now!

I feel exactly the same Lisa so don't worry. After submitting my MCOL last night (after hours of trying to fit it on to 24 lines) and paying my court fees, I have received a partial offer in the post this morning!!

 

I too am tempted just to accept this offer but since my LBA letter I have incurred more charges of £125 plus court fees now of £120 so that alone is worth fighting for. It would be nice to get the money over Christmas too but I want it ALL!!!

 

My friends are telling me to quit now whilst I'm ahead so I need some encouragement to go for the whole hog. Will I be the one they decide to take all the way?

 

We must follow each others claim as we are so close now.

I definitely agree Slouhart we'll have to keep an eye on each others progress.

 

The way I see it is that my partner is still owed £400. If when I started looking into this i found that the total amount of charges was £400 - I would have still gone through the process to get it back. So why now, when they are offering £400 short of what I've asked for should I settle??

 

It's a good offer but it's just not good enough. If my partner were to get the full amount he'd be less than £200 short of completely clearing his dreaded Credit Card bill....this is what's making him hold out.

 

I'm glad my partner's decided to hold out and wait and hopefully we'll get back what's rightfully his :)

Yes I know. I'm at work too!

 

I have just posted my letter to Colin Langdale refusing his offer and confirming my intention to go ahead for the full amount. If I accepted now I would be nearly £1000 down after interest has been added and that's our holiday next year paid for!!! (wish it would cover my credit card!!)

 

So I am going the whole hog too.

 

Drafting out letters for my husbands account now too as he didn't think it was possible so we might just dig out our old accounts too. Every penny counts!!

I posted the letter to Colin this afternoon :)

 

I also received the acknowledgement of claim from the court in writing too.

 

I was wondering, do I need to send a breakdown of charges to DG now or do I wait for them to request it?

Phew, I'm glad it's not just me.

 

I recieved an offer yesterday from HSBC, but had already served notice on them through MCOL. I was a bit confused as to what to do.

 

I shall now send my no thanks letter to Colin and let the courts decide. They have until the 30th.

 

Lets all go for them!

 

By the way, my Husband has started hic claim against RBS and in the New Year we will go after the joint account.:D

Has your claim been acknowledged by HSBC?

 

The advice I was given was to send charge schedule to DG Solicitors as soon as you receive confirmation of acknowledgement of claim.

 

Mine's going today :)

 

Can't believe how exciting it all is!! It's not even my money I'm reclaiming lol!!

I thought what better way to cheer myself up than to read of other people's success stories?! I've been reading through loads of posts with people giving the same advice, 'send your charge schedule to DG Solicitors as soon as you receive confirmation that your claim has been acknowledged'. I did this and although I sent it recorded delivery and it's been signed for, the acknowledgement of claim didn't have a particular person's name on from DG......does this matter?? I just addressed it to 'DG Solicitors'.

 

Anyone???

No they will pass it to the relevant person, and you have a signature to prove they recieved it.

Excuse my ignorance, I am just going through the MCOL stages as we speak. The claim was acknowledged on 15/12/06. It is a claim on Barclays. Is it the same 'DG solicitors'???

dg solicitors is hsbc "in-house" legal team, so, no, lloyds will use different solicitors - we start talking about the dg people like we know them - just throwing out names we've seen and sometimes dealt with Debs, Alan and Rachael are current favs. I'm sure the Barc. group have their own talk about the solicit. from theirs. good claiming to you!

Hi Guys,

First I'd just like to say Happy New Year to you all!!

 

Just a quick update.....'nothing's happened'...see I said it was quick :razz: !!!!

 

They've got until the 5th to file their defense so right now I'm just waiting, I guess the AQ will turn up soon :rolleyes:

 

They acknowledged on the 8/12/06 so am i right in saying they have until the 5th? or is it the 4th?

 

Anyway, it's this week.

 

I'll keep ya posted.

Hi Guys,

I called the court today to check on progress and a defense was entered on 29/12/06. The bloke I spoke to said it goes to the district judge then it comes back to the court and they proceed with it from there.

 

Just waiting for that Allocation Questionnaire any day now.....

 

Just wanted to say cheers for all the support and advice up to this point. I know I would be very nervous by now if it wasn't for you lot :D
