    • is the side street solely for access to your garages? who owns the land and thus the road? dx  
    • A local business has been parking on an off-street parking space in front of my garages (in a side street).  I wasn't using them for a while so didnt bother to do anything.  But now a second local business is also using the osp - taking it in turns with the 1st biz.  This has started to nark me.    The employees choose to drive to work.  There is no private parking in their business's street.  But there are some underground secure garages in their street - which cost apx £2.4k/y to rent - which works out apx £6.60/d. (I believe one of the biz owners already rent one for storage purposes).  If the employee had to park on a meter it would cost them £6.60/h - £66 for 10h and have to move every 4h.  They just don't want to pay for parking. I haven't confronted either of them.  Instead I just put 2 clear "no parking" signs in front of the garages. And a note on one of the cars specifically saying that as they don't live or rent in the street and it's private land could they stop parking.   They ignored that.  And just put notes on their dash with a # to call if one needs the car moved.  There is a sign and they've been told in writing to stop parking. And they are just ignoring it.    I don't what a confrontation.    I don't want to go to the expense of bollards (other than maybe traffic plastic ones - but they'll probs just move them).  Council won't do zilch cos it's private land. And police won't get involved - unless I clamp/ tow the cars and then they'd be after me, not the drivers!    What's the best thing to do?

    • Yes, send a message to the purchaser but keep it very friendly and simply that you noticed that the package has now been delivered.  I suggest that you ask them if they want to keep the package still or if they would rather return it and that if they want to keep it then please will they return your payment to you to your PayPal address. Keep it as polite and friendly as possible and then we will decide what to do if he doesn't reply or refuses.  Meanwhile I will have a look at Google earth and see if you are able to spot the gas meter outside the house to get an idea if the delivery is real.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I'm new to this group but really need some help I've fallen trap of the Payday loans and don't know which way to turn!

 

I've taken out 3 in the space of 2 weeks but really can not afford to clear them, my husband knows nothing about them - problem no. 1!!!

 

I'm going to contact each one to offer a repayment plan but judging from your threads this doesn't always work!!

If I cancel my card at the bank will they still be able to take money out by other means??

 

I have every intention of paying them but just got myself in too deep at the moment, rolling the interest over isn't an option just genuinely can not afford to pay them this side of Xmas.

 

The lenders are Peachy, Cash Genie and Swift Sterling.

 

Any help would be greatly appreciated, I'm tearing my hair out and am virtually bald :|

Ring up your bank and report your card as lost NOW! That's my advice, others will be along to advise on the ins and outs of paying the lenders back xx

That's what I was going to do, I can pay one this week but it's the other 2 I have no means to clear them this side of Xmas. Thanks for your reply xx

Tell your bank you want a new card, AND you want the CPA's cancelled on your card. Either put it in writing, or get confirmation in writing. Just Cancelling your card will NOT work.

 

Once your finances are secure, enter into a repayment plan. You do NOT have to pay them off in one go if you cant afford it, even though the PDL's will say otherwise.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I wouldn't leave myself short tbh, don't pay them if it's a struggle, there are loads of posts on here giving advice what to do and how to deal with the PDLs x

I have only been able to cancel the CPA on 2 of the loans as they have previously been paid from my account. I have to wait until I make an actual payment to the third company before my bank will help me - is this correct?? I have contacted all 3 companies, Cash Genie have been by far the most helpful. Peachy and Swift Sterling I had to email and am still awaiting a reply. Can someone please advise if this is correct about the CPA, my bank dealt with this with no questions but I am still concerned. I have cancelled my card too.

No its not correct. Your bank can block the transactions completely before they happen.

I would say best to be safe than sorry and get a new bank account for your wages to be paid into. You can get an easy cash account from halifax with no credit check and no overdraft. Telling your bank not to pay the CPA's does not always work.

Stay away from halifax if you have issues with PDL's. Faaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaar away.

Telling your bank not to pay the CPA's does not always work.

 

Under UK law, the bank MUST comply. If they dont, then they are in serious trouble and must refund the account holder AND revert the account back to how it was before the transaction. They also have to pay any charges accrued on the account as a result of their failure to comply.

Count how many times on this forum that someone has told their bank to cancel the CPA and yet the money still got taken out of their account... and if you can claim it back how long does that take, and what do you do in the mean time while you have no money?

And as far as I know there is nothing wrong with Halifax and PDL's, as I currently have both.

You can get it back instantly. You just need to keep pushing higher and higher and make sure you note names and numbers. Remember, every single employee that says no can be called as a witness in any legal action you may take. They can even be named as co-defendants if they have issued a point blank refusal contrary to the regulations.

 

The problem people on this forum have, is that they dont know their rights and have no clue what to do when something like this happens. That is of course, why they are on CAG in the first place.

I've been in the same situation with PDLS! Worried that much that I can't sleep!! Couldn't tell my husband as he would go mad! I contacted swift sterling today by phone advising that I couldn't pay my loan back at the end of the month! They were no help at all!! I emailed and emailed them all day with a repayment plan thinking they wouldn't agree to it! To my amazement they AGREED TO A PAYMENT PLAN ON MY TERMS. Agreed not to contact me by phone, email contact only. All collections activities have ceased they have even given me their bank details to repay by standing order!! I'm amazed- can't stop smiling as I feel quite victorious!!! My advice is stick to your guns and you will win!!! Good luck! X

I contacted swift sterling today by phone advising that I couldn't pay my loan back at the end of the month! They were no help at all!! I emailed and emailed them all day with a repayment plan thinking they wouldn't agree to it! To my amazement they AGREED TO A PAYMENT PLAN ON MY TERMS. Agreed not to contact me by phone, email contact only. All collections activities have ceased they have even given me their bank details to repay by standing order!! I'm amazed- can't stop smiling as I feel quite victorious!!! My advice is stick to your guns and you will win!!! Good luck! X
