What response do I sent the others who are now threatening pre-court action.....I have already replied to the SD....taking unclebulgarias advice in offering a token payment but now I have another 4 to deal with who have just suddenly come out of the woodwork :(

 

What debts are these ?

 

If they come under the Consumer Credit Act, then if you have sent the companies chasing CCA requests before which have not been complied with, I would suggest that you remind them of this in a letter. If you have never sent CCA requests to these companies, then send the CCA request.

 

It would probably be best to start a new thread for each debt in the Debt Collection folder on CAG, as there will be questions asked about each debt. With more information, you might then get more tailored advice.

Yes , ok will do that as I guess its confusing talking about 5 different debts sorry...will start a new thread for each. yes all covered by CCA requests all sent, but none complied with fully.

All the debts are pre 2000 ....

I think what Andyorch might be getting at, is that if you have much overall debt, you should really be approaching debt specialists such as Stepchange to see what options you have. Perhaps there is a debt relief option that is available to you, for which you will have more control over and it might stop Lowells in their tracks. You definitely need to do this urgently.

You can get general advice using online forums, but it is not really always possible to get a rounded view of someones financial position. Sometimes better to get confidential advice from debt experts such as Stepchange, as they will ask for more information to understand your overall position better.

had a reply from lowells...they said they could NOT accept the offer of payment as the account was "outsourced" to BWLegal and gave me their address (I sent a duplicate letter to BW same day as I sent the Lowells one telling each that I had sent copy to other) however Lowells did not return the postal order I had enclosed in their letter.

....so where do I stand now?..it is 16 days since I received the SD.

.....even though I told them they still sent reply to the wrong address again!

Wait for BW Legal to respond.

 

What postal order did you send to Lowells i.e what was the purpose ? Any payment towards the debt should have gone to BW Legal.

So what happens now ...Ive gone and sent it to the wrong ones! It was the £5 postal order I was told to send. I sent a copy of letter to each and put the £5 postal order into the Lowells one....and wrote in the BW letter that the Postal order had been sent to Lowells. Does this mean I need to send another?

I did tell you to send payment to BW Legal. Hopefully Lowells will send the postal order on to BW Legal. I would not worry, you have sent payment and offered a repayment, which is the main thing.

 

What happens is that Lowell still own the debt, but they have contracted out collection to BW legal. Lowells still have responsibility as the debt owner, to send on any payment. You have proof of sending the letters and payment, so you have done what you needed to do. You did not realise what BW Legals role was as such.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
