Hi all, my wife as had to send her phone to Samsung because it stopped working, she took it to 3 store where we have our contracts they looked at the phone and said it was in exhalent condition they said they thought it was a soft ware problem.

Samsung have come back and said there is a crack in the screen, so the warranty is void, we didn't see any crack and nor did the shop my wife has been very careful with the phone, when it stopped working it was in her bag, with her kindle and glasses, and was in a good case to stop it been broken, my wife said it must of been do in transit they say it's not transit damage so could someone please tell me where we go from here. Thanks

What had stopped working on the phone?

Was it ringing? Did the display suddenly stop working?

"Cracked screen" does not mean you can see a shatter or a crack in the outer glass, the screen is beneath that and a crack is not always visible, Especially on the top of the range Samsung's as they use a specially treated glass (called gorilla glass), however beneath that, the display element is still very fragile.

On items over 6 months old the sale of goods act states there is "reverse burden of proof". This means you need to prove that it is faulty due to a manufacturing defect. Expensive case or not, a cracked screen you would have a mountain to climb. How much are they quoting for repair?

"Visibility" of a cracked screen, if you know what you are looking for you can see it. It looks like a black hair on the black screen under the glass... it is not an easy think to spot.

Take your argument up with Three, but I think they will say what the manufacturer says goes.

You have no contract with Samsung, you have a contract with Three.
