      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I wrote to Mr Sands regarding telephone harrassment and the fact that MMF rang my work and told the switchboard operator I was in debt and that was why they were trying to contact me and could they pass on to me that 'Mike' (the phantom collector) was going to be calling at my house! Mr Sands wrote back to say he would review my complaint and would replywithin 50 days. That was 138 days ago!!!

 

My guess is Sands is snowed under by complaints, so just make it worse, a formal complaint must be replied to within 56 days and must answer the complaint and amount to a final response, your are now free to report to The FOS.

well just had email from MMF stating they will now accept the repayment plan from Mr Lender, and not the £623.56 they claim.

Still need to chase them up about contacting you at work and the fact they tried to extort more money from you

Here is the latest offering, by email:

 

"We note that we have not heard from you in response to our earlier communications. Your file is shortly scheduled to be transferred to one of our Home Visit Divisions. We are happy to try to resolve this matter without conducting a Doorstep Visit and would ask you to contact us by telephone or email to discuss repayment terms. Please note that if we do not hear from you, then you will be visited to assess your personal circumstances with a view to passing your account to our Legal Department. We would, lastly, advise that if you are able to make a lump sum settlement offer, then we would be willing to allow a 25% discount on the outstanding balance and to waive the default costs and interest that have not yet been added to your account balance"

 

They have been told in writing to stay away and in this missive they have admitted that they are going to add default costs and interest if I do not take up their kind offer!!!

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

They have got to be joking now, QQ payday have sold the old loan to MMF, I have been trying to get QQ to arrange payment plan on a loan of 350.00, and today this is the email from MMF ( looks like they have purchased debts from other payday lenders ). where do I stand as QQ refused a repayment plan and MMF demand more, just feel like writing and say see you in court

This sounds like another totally false claim in reference to the placing of a default RO, check CRA files QQ should have defaulted the account before sale to MMF.

This needs close watch as MMF may well attempt to place a default from the date on which they acquired the account.

I'm travelling at the moment, but can draft a letter later when I get home if you wish.

it wasn't a flash blue one was it as these muppets despite being told that I no longer lived there turned up and in this instance the twollie was extremely mouthy to an elderly ex neigbour pretending he was a bailiff and was photographong the old house.

orry my first email is such a one but a very unpleasant, huge chap pulled up outside half hour ago and was banging on your old door. I ventured to tell him the people living there were away - as they are in Poland getting married - and he said did i mean Rose. I said you didn't live there anymore and had been gone 3/4 weeks but I had no idea were too as we were away at the time (true). He asked was I sure (yes) and said "never mind we;ll put a trace out".!!! Don't like the sound of that so thought I'd best let you know. Hide all your stuff as I'm sure, thinking about him, he's a bailiff!

I knew no bailiffs as we had absolutly no debt warrenting bailiff action she went on when actually chatting to her that he was very manacing taking photos and threats of stalking. I got hold of his mobile number and boy did he get a mouthful from me, The mr Page sent me a mail stating that I was violent and threatening to him verbally. AAAAAAAAAAAAAAAAAWWWWWWWWWWWWWWWW Poor thing a 5'2 girly told him to go away and hee was scared LOL

Will check my credit file asap, to see if QQ listed default, will let you know asap , also MMF have called my mobile 6 times today regarding the QQ claim and the Mr Lender loan as well. first they call regarding the QQ hang up and then call regarding the Mr Lender account. did write to MMF about the Mr Lender claim and had no reply from MMF.

just tried Noodle and they could not find my report, will renew membership regarding credit expert on Friday when I have funds. Last time I checked QQ never listed default in fact nothing at all regarding the debt and the debt is from 2010, I know its old but trying to sort out as its been hard life over the last few years. But will get it sorted fingers crossed.

Hi all,

 

I was dealing with Gothia regarding a debt I owed a while ago (three years ago) which I totally forgot about. It was my fault for forgetting. Gothia hadnt responded or had no interaction with me for the past two years.

 

Last week MMF got in touch with me and suggested that they now own the debt, me being suspicious I requested they send me evidence to suggest that the debt has been passed onto them. They sent me 'evidence today' stating that they have been assigned the debt from Mackenzie Hall (never ever been contacted by them EVER) and the letter was dated 9th July 2013 i.e. TOMORROW. It was also on their own letter head and everything. It appeared more a declaration which was obviously factually incorrect (mackenzie hall never had the debt it was Gothia)

 

Three things,

 

Firstly - does this sound dodgy? seeing as I have never ever had contact from Mackenzie Hall EVER.

Secondly - when I had informed them about correspondence with Gothia, MMF mentioned that they recieved nothing from Gothia - if my debt has been assigned to them surely they would have my file with all the correspondence?

Thirdly - I have a default against my name for the debt, can MMF change the default date to, for example, today? Or is the default date the original date?

 

I am hesitant to pay MMF and have been hard hitting with them informing them that I have my supsicions of fraudulent behaviour and would like additional clarity.

Hi anything emanating from MMF is very suspect.

 

MMF CANNNOT change the default date!!

No MMF will have absolutely minimum data, your name and address, account details amount outstanding.

Send MMF a CCA request addressed to Mr Rob Sands Compliance Director, £1 PO or cheque for statutory fee marked clearly for 'statutory fee only'. Use the template from the CAG library, they have 12 +2 working days to comply.

Disregard their delusional threats of authority they are just a 3rd rate DCA/ cum debt purchaser.
