  1. So, as the car has already sold at auction without any work be carried out on the car. They will be a bit silly trying to bill be for anything! STRANGE..... I checked my bank account this morning and Moneybarn have refunded me by BACS a full months instalment. BAFFLING ?!?!???!! **UPDATE** So, not only a refund from Moneybarn, I received a letter today. Dear drob Further to recent correspondence, we are pleased to confirm that the billing has been completed on your account. Having completed all the adjustments required, we are pleased to inform you that there is nothing further outstanding for you to pay and your account has been closed.
  2. *UPDATE* I received a letter from Moneybarn on 13th July 2018 explaining that the final balance on the account is now being calculated. FINAL BALANCE In accordance with the terms and condition of your agreement, various charges may be applied to your account before the final balance can be established. These may include Replacement V5 Admin Fee, MOT Replacement Fee, Replacement Keys Fee. Repairs or Refurbishment Fees and Loss of Value (If you have not had the vehicle service to the manufacturers recommendation this will reduce the resale of the value). So, I was able to download the BCA Appraisal Report off the auction website and to my shock they have added various bodywork blemished in addition to the initial inspection report they did when collecting the car. 1. The car sold at auction on 18th July so no work highlighted in the original inspection or additional appraisal report has been carried out on the vehicle 2. Any bodywork blemishes or imperfections are in my opinion general wear and tear or there before I purchased the vehicle. Now it's time to sit and wait for Moneybarn to entertain me with their FINAL BALANCE!
  3. No proof whatsoever ........ The driver turned up later today to take the car and he did another inspection and report!!! He checked windscreen wipers, tyres, coolants, oils, lights, seat belts and CD Player
  4. BCA have been to inspect the vehicle today with his magnifying glass!!!! He has 2 items on his report. 1. OFF-SIDE SILL DENT 30MM to 100MM 2. FRONT WHEEL ALLOY Scratch/paint defect over 125mm The car is 9 years old so would this be general wear & tear?
  5. So, BCA (British Car Auctions) are collecting the vehicle on 4th July. BCA said make sure there is fuel in the car and that it has car tax!! a) Car Tax runs out on 1st July and I am not renewing just for them! plus I have already transferred the car back to Monerybarn. b) They can pay for there own fuel!!

(Being kept off the road and will be SWORN on 28th of this month) 2. Please note that if you fail to return any of the above items, we will charge you for costs incurred in replacing them. Please be advised we are able to claim from you any loss we suffer as a result of your failure to take reasonable care of the vehicle and service the car to the manufacturer’s recommendations. (Open to interpretation)
  7. So, sent my VT notice off last week and Moneybarn have sent me an email today. It looks like things are going smoothly so far, so let's hope I haven't spoken too soon! Dear drob, Your contact details will now be passed to a company called BCA (British Car Auctions) who will contact you directly to arrange the inspection and collection of the vehicle, which we will agree to carry out free of charge. Please note they will be only able to inspect and collect between the hours of 9am until 5pm weekdays only. BCA will now contact you within the next 2 working days to arrange the appointment and the appointment must be carried out within a period of 7 days from them contacting you. Failure to action this will mean the appointment of recovery agents, the cost of which would be billed to your account. If you wish to contact BCA you can phone them on 0333 2414 208. Please note that you must keep the vehicle fully taxed and insured until it has been returned. You are required to also return the following items. 1. The Registration Document know as a V5 2. Service History Book / With FULL service record to Manufacturers schedule 3. MOT certificate if applicable 4. Spare keys 5. Sat Nav Disc if applicable Please note that if you fail to return any of the above items, we will charge you for costs incurred in replacing them. Please be advised we are able to claim from you any loss we suffer as a result of your failure to take reasonable care of the vehicle and service the car to the manufacturer’s recommendations.
  8. The yellow slip (V5C/3) has a declaration that must be signed by both the registered keeper and the motor trader, finance company, insurer or auctioneer. The registered keeper must then return it to the DVLA. i take it that whoever collects the vehicle must sign the yellow slip and that I can't inform the DVLA until the collection date?
  9. Yes, I will send it recorded delivery. I have had no issues with Moneybarn, YET apart from the extortionate 60% apr, however I can see them being awkward regarding the VT. I have taken lots of pictures (date stamped) but no videos yet.
  10. Re: V5 Registration Document I am about to send my VT Notice off to Moneybarn. What do I do with the V5 Registration Document? Do I transfer the ownership to Moneybarn once they have acknowledged the VT?

Dear Sir, I am writing to notify you that I am exercising my right to terminate the above Agreement under Section 99 of the consumer credit act1974. . You will understand that the aforementioned section permits the debtor to terminate the agreement at any time before the last payment is due. . There is no restriction regarding the exercising this statutory right, particularly none in respect of any perceived arrears or monies due on termination . I understand that I shall be liable to you for the amount calculated under the formula in Section 100 of the Consumer Credit Act 1974. . **As I have/have not paid more than the amount calculated under the formula in Section 100 the amount due is £XXXX/zero. . The above agreement will be terminated 14 days from the date of this notice. . Please send me details of how the vehicle can be returned to you. . You will be aware that statute prevents you from levying a charge for the recovery of this vehicle; guidelines also state that if you require me to deliver this vehicle it must be no more than a short (reasonable distance) from my registered address. . Please confirm receipt of this request in writing within 7 days of receipt. Why do I give 14 days notice? I was on the understanding that once you have given notice then that's that.
  12. My plan is to send the VT letter by recorded delivery on Monday and via email. Once they have signed for the VT letter on the Tuesday I then want to cancel the Direct Debit which is due to go out on Friday 15th June. I estimate that I will have to pay £93.00 to bring payments to 50%. shall i enclose a cheque or wait for a final bill from Moneybarn?

  14. The creditor is Moneybarn ... I have a payment of £195.00 due to go out on the 15th but wanted to VT before the payment goes out. My plan was to send the VT letter on Monday and then cancel my DD before the 15th.
  15. As i understand it I can Voluntary Termination at any time but will be liable to 50% of the total agreement. I intend to VT my HP agreement however I am £93.00 away from 50%. If I send notification of VT on Monday along with a cheque for £93.00 would this be accepted?

  17. The particulars of the claim was very basic: "The Claimants claims payment of the overdue balance due from the Defendant under a contract between the Defendant and Capital One dated on or about October 20 2009 and assigned to the Claimant on Sep 30 2016"
  18. The alleged default date was October 2016. As to date Cabot have not been able to provide any documentation as asked for in my defence.
  19. Several months ago Cabot allegedly purchased an old Capital One account. I disputed the alleged account and Cabot issued County Court Proceedings. I submitted my defence and received no response from Cabot so at the moment the case is stayed. After checking my credit report, Cabot have added Legal Fees & Legal Costs to the alleged outstanding balance. Can they do this?
  20. I had a disputed Credit Card account with Monument and the alleged debt which i disputed became statute barred. I haven't heard anything from Monument for a couple of years, however I received a letter this morning. Dear drob Thank you for your recent correspondence ( I haven't corresponded with them recently) We have reviewed your account and can confirm that yoy subscribed to the Payment Break Plan product. Without admission of liability, and as a gesture of goodwill we are prepared to adjust your account with the fees plus compound interest. Payment Break Plan Charges: £179.04 Account Rate Interest: £86.72 8% Statutory Compensation £35.80 Total Adjustment to Account £408.96 I am just wondering if I should be cheeky and ask for the cash, should they be applying the Payment Break Plan refund as an adjustment???
  21. After my latest dealing I am not going to ring them, they always wind me up and I end up losing my temper... I have wrote them a letter... Dear DWP I am writing in response to your undated letter which I received on 23/01/2015. In your letter you have asked if there was a reason that I failed to report a change in my circumstances promptly. You have asked for me to contact you no later than, however no date was given in your letter. Your letter does not outline or give any information as to what circumstances I have failed to promptly notify you of and I am bemused as to why I have received this letter as I have always reported any changes in my circumstances and have acted with honesty and integrity. If you require any more information regarding this matter do not hesitate to write to me outlining what further information you require. Yours Faithfully drob

Update Well, just to add insult to injury I received a letter from the DWP this morning asking for an explanation as to why I did not inform them promptly to the changes in my circumstances. * In the letter they have asked me to respond by: (No date given, just a blank space). * They have asked for an explanation but have not given any information as to what I am meant to be explaining about. I'm bemused & baffled!!
