      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Had a letter from Barry Ellershaw as follows:

 

Having the opportunity to review this matter, I have determined that the loan of £300 was originally issued to you by Mr lender in Oct 2012 and we purchased the debt in May 2013. We therefore legally own the debt and the current balance of £528.00

After reading this letter I found the last email from Mr Lender, can anyone help as getting nowhere with MMF I have stated happy to clear as per my last statement from Mr Lender but MMF just refuse

Well I have wrote to MMF regarding the QQ/Gothia debt and enclosed letter refusing home visits but they still email as follows:

 

Mr, please contact MMF to discuss repayment. Failure to respond will result in transfer for a Home Visit. Call 01138876876, ref

 

They just don't get it do they, I have not been told they now own the debt from MMF not Gothia so going nowhere fast, I have also asked for proof of debt as well yep no reply

Well had another letter from MMF:

 

Debt : Mr lender Debt Assigned to Motormile Finance UK Ltd

 

We have been notified by our accounts department your agreed repayment arrangement has fallen into default.

 

The matter has now been returned to this department to set up a fresh repayment arrangement or to work towards having a DOORSTEP AGENT VISIT YOUR HOME

 

Before we proceed with the collections process, if you wish to resurrect the repayment arrangement that has fallen into default, please contact us immediately and we will re-honour the prior arrangement. This offer is open for 5 days, after which it will lapse and we will begin preparing the file for the home visit department.

 

Again, we would remind you that we will accept a lump sum payment of £422.40in full & final settlement.

 

 

After reading the letter and not shocked at all, my offer was 286.86 lump sum to clear the debt, which is the amount that was stated by Mr Lender I have emailed them 5 times stating I will repay the amount as per the repayment plan which I was repaying and they ignore the emails. my question is should I repay the correct amount £286.86 and tell them to kiss my ass for the fees they are adding or just wait.

 

don't get me wrong I will repay the correct amount and not their extra fees.

Just had an email from MMF regarding a QQ Debt, they claim to own the debt but nit confirmed any assignment notice, i have wrote stating no home visit, yet they have cinfirmed the file is ready to pass to their IN house law department.

 

Complete joke get no replys from email or in writing, i have wrote to QQ as well and they have not replied.

Well just checked my credit file to find a company called Express finance ltd have listed an account ( 252.00 ) their is no address listed, also Gothia have listed a default and marked the account satisfied this is the debt Motormile claim to own.

 

Is Express finance Motormile ????????????

This lot are prone to default accounts immediately prior to sale of loan accounts.

 

They do also have a debt collection/financial services function I think.

Express finance (Bromley) are the money shop and payday express

 

I have not had any loans from Money Shop nor Payday Express, nor sure how to sort this out. The only payday loans I had as follows:

 

Minicredit / Opus : Now Cleared

Wonga : Now own by Motormile but not had any information from Wonga or Motormile

Wonga / Gothia : They marked credit file as settled, but Motormile claim they purchased the debt.

Toothfairy : Chased by NDR,MH Appletons

Payday UK: Now Cleared

Well this is the email from MMF regarding the QQ debt they claim to own, it was own by Gothia who marked the defaulted mark on my credit file as satisfied, as Gothia list the account as default on 06/04/2010 can MMF list another default ? but as yet their is nothing on my credit file relating to MMF
