Well mmf claim to own 2 payday loan, mr lender debt which according to mmf stands at 623.86 they state i have never paid. I have proof of payments, since i sent them proof they have stopped chassing the debt.

 

The gothia debt which mmf claim to own but they have sent proof nor confirmed any paperwork. I have sent letter refusing doorstep visits and asking for proof but todate they have not sent anything. I have wrote to oft & fos regarding both matters.

At the moment then all I can suggest is sit tight. You have made a formal complaint to MMF and after 8 weeks the Fos can investigate. Of course if they turn up you just politely tell them to go forth and multiply. I am not sure what else to suggest as apparently they do issue claims. I suppose one idea may be to send a CCA request . I know it will hardly be difficult to get a copy of your agreement but as they are so efficient I can see them taking a few weeks during which time they can not get enforcement.

 

I think that a court claim if defended could be quite interesting as I know from experience they send assignment notices by email and I can not believe that the law can accept this is a provable delivery system to you.

 

Just going back a step, when you asked for proof of their right did you head it formal complaint?

 

 

Did you get the express finance thing sorted?

Have just read all 16 pages, seems a lot of similar advice , letters to send etc etc.

 

So all that is outstanding is the QQ/Gothia/MMF account that MMF say they own and have never sent you a NOA?

You have written to them asking for proof but no reply

You have also complained about them to FOS and OFT

 

As suggested last post, if it hasn't been done , one last letter headed Formal complaint

Ask for proof they own the debt

Proof of the amount of the debt.

Complain about the frequency etc of calls

Threaten action for harassment

When communicating with MMF, you need to contact Rob sands. ALl other methods of contact will go ignored or unrecorded. They WILL say and do ANYTHING over the phone. They normally ignore emails to their main point of contact.

Frankly if it is headed formal complaint and is sent signed for it doesn't matter where it is sent so long as they receive it.

 

Renegade do you have that on cut n paste as I have read it several times on this thread.

 

Rob Sands seems to be as much a waste of space as all other contacts

 

If you write the letter on the PC then i would also email it to them as well on as many email addresses as you can rob@ neil@ barry@ [email protected]

MMF will ignore all contact, or simply fob you off. Many people have had luck with their compliance director, but there seems to be a long wait for his response as he is undoubtably snowed under with complaints. Plus the OFT know all about MMF and are encouraging people to complain about them.

Frankly it doesn't matter if they ignore it as after 8 weeks you go to the Fos. I am not saying don't go to Rob Sands but he seems to be as much use as a chocolate teapot.

 

Personally I got replied from Barry Ellershaw.

I have also not said anuthing about not complaining to the OFT

Oh i agree with the FOS route. But the PO method covers your back and knocks down any argument MMF could try against you. Plus it has the added bonus of reducing the debt.

I tend to agree with you however there is a huge difference of opinion about this on the forum. Some have said that Neil Petty is a puppet and to write to Rob Sands.

 

My personal view is when it is like this to write to whoever with signed for delivery heading it Formal Complaint but also email it to whoever needs it. In this case as I have said, by all means write to rob sands but also email the letter to

[email protected] (although not sure if that one works)

 

I have nothing but contempt for the whole motormile business and strongly feel that they should lose their CCL asap. The problem as far as I see it is that people go off half cock and do not follow the complaints procedure . There has been a raft of mis information given about the correct way to complain

Formal complaint to MMile along with complaint to credit services association >>if not resolved go to the Fos as well as emailing the OFT and contacting citizens advice consumer service.

If everyone who had a problem did that then all the evidence would be available to the necessary authorities

 

Maybe I am wrong however I feel that I have no choice other than to follow the correct path

Just had email headed c c j action, they have stated the file us now being assessed for court action vua my local court. As i have refused to confirm the debt.

 

What should i do now, i have wrote requesting proof of debt but had no reply in writing just threats now court threat.

I don't know mate, but there are cases where a DCA gives an old address to the court and you never find out until it's too late.

Do they have your current address?, all I remember from your posts are emails from them.

If not it might be worth paying for mail forwarding just in case.

Yes apparently they have issued court claims .

 

I wouyld treat this as a letter of claim but i do not know how to word it.

You could try something like this

"Dear Sirs

 

Re your email dated xxxxxx.

 

Thank you for your letter, the contents of which I have noted.

 

Since your letter clearly refers to the threat of litigation, I am treating it as a formal letter of claim, albeit an entirely defective one.

 

I refer you to the Civil Procedure Rules Pre-Action Protocol practice direction, in particular Annex A and Annex B. You will note your letter fails spectacularly to comply with either of the aforesaid Annexes.

 

I therefore request that you send me, within 7 days of receipt of this letter

1) A copy of the alleged credit agreement

2) A copy of the default notice

3) A copy of the Notice of assignment

4) A statement of account

 

Failure to supply any or all of these documents will be brought to the attention of the court

 

 

I assume that you have sent the official complaint to them as well.

 

As it is not entitled as a letter of claim you may wish to ignore it, Others input would be gratefully received

They are shocking. Considered opinion is to send the letter I posted above. Send it royal mail signed for and email it as well. After that I would ignore totally unless you get a claim through the post

They just dont give up, had my first letter at my home address same threat call and pay the debt. If i refuse to make an offer they will visit my home to assess my assets with a view to remove goods. I have sent 5 letters recorded mail still they have not sent the fetails. I have reported to OFT had nothing from them as yet.

Its been about 8 weeks since i wrote to mmf, never got a reply. I did get reply regarding another account they claimed to iwn. They stopped all contact regarding that issue. And started chasing the old gothia debt.

In that case then i would give the Fos a call, log your complaint. I assume that you still have a copy of the letter you sent them?

 

You can download a complaint form from the Fos website to fill in and post off

well just had email which states the file has now been passed to the door step department. they state they intend to contact my employer. i have wrote but they dont reply, i have sent the door step letter refusing consent . what next !!!!!!!!
