      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This is todays email from MMF chasing the old Gothia/QQ debt, I have wrote requesting information relating to their claim but had no reply

I am also confused but if gothia sold the debt they would then mark the credit file as satisfied and usually mmf would then place their own defaukt against you although the date must be the same.

 

That's my thinking as well, however MMF have not made any entry's and not confirmed any of my requests relating to proof they own this debt

They only email threats relating to this debt. So far nothing in writing, i have wrote but get no reply. They were chasing the balance from a mr lender debt as well. But they have stopped. I think they may issue court action lets wait and see

Judge wont deal with OFT guidelines, as theyre just guidelines, not law. You need to be contacting the regulators and issuing full formal complaints, so IF you are taken to court, you have a clear and full paper trail to show the court.

Nope. But it helps as the DCA has 8 weeks to investigate your complaint before you get the FOS involved.

To be frank isn't it better to avoid court . If the debt is legit and enforceable you would lose and have costs added

 

MMF rarely deal in enforceable debts. THey DO, but not as often as you think. They prefer to use tactics such as threats and extreme harassment to force you to pay regardless of the status of the debt.

Unfortunately no the case, MMF are indeed starting litigation through various 3rd parties and now have a 'solicitor' on the staff, we have not seen many here but it is happening in the world outside CAG, so caution is needed.

Like i said brig, they DO deal with it, but i doubt it is a common occurance. Same with a few other DCA's. MMF seem to be like a little terrier dog. All yap and no actual movement.

Todays email, I have checked my credit file and MMF have not entered any searches nor added any records, the only change was virgin media who entered the wrong debt amount.

MMF are chasing the Gothia debt which is marked on my credit file as satisfied

Maybe my eyesight is going but which OFT guideline have they broken?

 

As said before I suspect the Gothia debt will be marked as satisfied because to Gothia it is...they have sold it on. MMF do not always report to CRA's and didn't when they briefly held a debt of mine

Sorry but am not really up to speed on this one. You may have noticed that the Brig has left us ao what will happen to the so called super complaint he was putting together I really do not know.

Have you written to them at all?

I know from experience that they are a bit slow at matching details up, the phrase left hand not knowing what the right hand is doing could have been created for them.

 

If you have not written I would write with a no doorstep letter and also instructions to by snail mail only ( How do they know that you have access to email all the time).

Can you remind me what the dispute is exactly, I will try to read back and check

Whatever you do, you have to send it to Rob Sands who is their compliance officer. You will be completely ignored otherwise.

Well had an email this mirning, stating they are passing the file to their doorstep dept. To call at our house and assess my income. Also they are passing to their inhouse solicitor for legal action. Very threating email, i have wrote twice now requesting proof of this old qq debt and so far they have never replied.

 

Think i would like them to issue action and see how would action in front if the judge. And explain why they do not reply to letters etc etc. Has anybody ever hsd court papers from this company ?
