    • I had to call an ambulance for my wife, but one of the paramedics was not happy, about the condition of our house, as it's cluttered. And he  would only see to my wife, on the ambulance itself. After diagnosis they took my wife to hospital. My wife was ill for a few months, and received help from the district nurses. We then got a call from a social worker, who wanted to visit us, and discuss ways to make my wife more comfortable. When I asked for more details, she became vague, but could give us a phone number, if she visited. I politely declined her offer, as I was coping, along with my daughter in caring for my wife. Then a letter arrived from another social worker, saying similar things, to the first. I didn't bother to reply. Another letter has just turned up, from the social services legal department, which doesn't say anything specific, but refers to the other social workers trying to visit us. Coming from a legal department, has badly upset my wife, who's recovery was on going, and she now fears that someone will be coming to the house, to do whatever. Do we have to respond, or take notice of these people. Also we recently had a fire prevention officer come and fit, smoke and heat detectors. He didn't voice any concerns with the conditions at the property. Worried, Paul.

    • 05.05.24 Ever so sorry if I have entered this in the wrong part of this website.   My grandfather is in his 70's and retired.  He asked me to help him find a work pension that he was paying into when he was working. From 1967 - 1982 he worked for a Fabric Dying Company, Celanese, Spondon Derby UK. I have already used the GOV.uk Trace Pension Scheme. It listed a few pension companies : Akzo Nobel (CPS) Pension Scheme formerly Courtaulds Pension Scheme.  I do not fully understand how this works but I think this scheme is administer by a company called Willis Tower Watson. We have called this company, got through to the pension department submitted all my grandfather's details (D.O.B. , N.I. no. etc.) but that agent tells that they have no record of my grandfather and ask what is the name of the pension scheme. Here is the problem, his home was burgalled in 2005 and a briefcase which contained his legal documents was stolen. So he does not know who was the Pension Scheme company. I have a this phone number 01332 681 210 for Celanese but it just rings and never gets answered. So I am asking for help if anyone can tell us where we can try next. I am also hoping for a massive long shot that one of them members on this website, worked for or knows someone who worked for British Celanese Spondon Derby and could tell us of any pension company. Thanks for any help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I was moved to wrag from i.b on filling esa50 with out atos medical as I do suffer with lots of health issue. I do have unstable angina and this medical condition is should be under support group.

Upon taking advice from cab I call dwp and ask for gl24 last week.they stop my payment this week.

Is it true if you appealing then they stop your payment? I was getting payment under I.B:???::???::???:

The new rules on ESA appeals if they come in ? dont start until April 2013.

 

I did read somewhere that payments dates for IB on Mondays,where changed to Tuesdays when people moved to ESA could be that

 

Reading posts on CAG there are sometimes delays in payments anyway given the amount of people beaning reassessed on IB .

 

You need to ring them up at BDC center,the 0845 number shown on top of award letter ...

Yea I used to get my IB on wednesday even though my pay day for benefits was supposed to be thursday (when done by NI no. instead of benefit type). When I got awarded ESA it changed to thursday without warning, and although I had written and hone confirmation about getting ESA I was still very worried when no money appeared.

What benefit are you on and what are you appealing?

Sorry did not put enough information I was on I.B fill esa50 no medical.

Put on WRAG up on taking advice from CAB as I do have unstable angina and lots of other medical issue inc. Heart failure on third stage.

Sent my gl24 on 3rd Dec. was wondering by the way I did went for my Interview with J.C+

If the rules haven't changed since last time I sent one, if you haven't received a reply within a month you should/could send them a letter asking what is going on.

It was more than two years ago, eventually I won the case. I contested my JSAg and I got money back in arrears, but it took two months. Try to get the address of your relevant DMA and write directly to them. If you call your Benefit Agency they must give you the address.

Thanks I do have phone number and full address I will contact them in new year as I have sent my gl24 on 3rd dec12 will one month and see what happens

On the Esa 72 that you have received, There are 2 boxes, And one of these boxes should be marked with an cross or tick...

This would explain which group you have been placed into!! WRAG or SUPPORT....

It should also give you a date when your case will next be up for review....

Had you originally been found 'fit for work' ? because if you had, Then receiving the ESA72 & being placed in the 'WRAG' group would mean that you would have won your appeal and the ESA72 would indeed be in reply to your GL24...

Yes I was put on wrag even though I have unstable angina and many other medical issues.

therefore I did sent gl24 with help of cab and I did went to job center plus and have given me 18 months for next appoitment

It is vary confusing

so do you think this esa72 is replay to my gl24?

what should be my next setp?
