    • Hey guys, just wanting to double check since it's been a a year since my last claims mediation, this is the best stance to have during the mediation right?: "I am willing to be flexible by not taking Evri to court to get a judgement against  them and i'm willing to settle now. but I'm not here to compromise on my rights or the amount i'm owed as I have all the rights in this claim and Evri know this, despite what they may say now. I do not wish to waste the courts time and our time, it's Evri who are being inflexible and they are just wasting evryones time if the are not just paying up now. they should just offer the full £ and we can proceed The function of mediation is not to persuade you to give up some of your rights. The function of mediation is to help you obtain what you are entitled to without having to go to court and without having to inconvenience or trouble anyone further. The benefit to the defendant is that they are saved the expense and the inconvenience of going to court." I can also bring up that 1. they no showed this court in our previous mediation call and wasted all our time, and 2. they already settled in full with me last year on an identical parcel and case so we're going down the same road?
    • Regarding SARs - does the recipient provide hard or digital copies of info?  I sent out a request recently. All the info was digital and I'd like it sent digitally - for expedience -  but they want to post hard copies.  Can I demand digitally?  If it's hard then I will have to labour over scanning it all back in to my computer - which is a waste of my resources.  I had this issue recently with a lawyer - they said they had too much info to send by email. Yet miraculously found a way within 2h. (It would be useful to have hard copies too - but in terms of short-term follow up communication digital is best for me)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It was border line. I was on JSA in June last year. I started claiming ESA around the same time, I think...

 

 

It sounds like you where placed with work provider before claiming ESA.

 

You need to contact the job center and get them to suspend your participation in the work programme. Inform them [the job center] you are now on ESA assessment and should not be mandated to work programme.

I may have worked out why you're on the work programme; as the same happened to me - the job centre may not have informed them and until they do, you have to attend. Well, that's what I was told - I am required to attend until job centre tells them otherwise.

 

I was originally given a fit note from 2nd July - 2nd August. Because GP had written 1 month, they took that as 4 weeks and tried to call me on July 30th.

I was in the Salvation Army at the time we are talking about (i am not a criminal, I lost my home and had no choice)

 

The initial Work Provider called the DWP upon being requested by my then Project Worker at the Salvation Army. The DWP stated to the initial Work Provider..... "its the Work Providers decision" should they feel they want to include me.

 

They obviously did. I don't think my Project Worker at the Salvation Army hostel did me any favors. They colluded I feel.

 

Now I am this situation... With being referred to the 'secondary work provider', the addiction one if you know what I mean.

 

Am I fkd here Down and Out.

There is no point in treating your alcoholism until they treat your anxiety effectively.

 

I've seen this with schizophrenics who use alcohol to manage their condition - until the schizophrenia is medicated effectively, they will always use the alcohol.

 

Have you seen a psychiatrist about the anxiety?

I have being on ESA since July, ATOS medical failed in Nov, advised in Feb I received Nil points. I appealed. Got tribunal docs in April. I sent them back requesting a hearing. Still not heard anything from the tribunal regards a date, even tho I couldn't attend through my anxiety issues.

 

Has this secondary work program organisation being taking the **** out of me since November last year?

So your saying this work based organisation is taking the piz out of me? Whilst being on the ESA assessment rate?

 

I have done what they told me since Nov last year.

 

However they never really pressed me apart from they told me I must attend AA or its sanctions.

 

They stated two weeks ago if I didn't do what they say... They class that as being NON COMPLIANT... And they have the right to sanction.

 

I don't want to say the name of this organisation fearing they maybe watching.

If you are on the assessment phase of your ESA claim, then nobody can tell you what to do. If you want to use all of your money to buy 'coke' & booze there is nothing that will stop you.

 

In the work group, yes you can be made to go to work providers, but they cannot make you do anything other than comply with maybe writing out a CV or such like.

 

They certainly cannot force you to take medication, have surgery or attend a detox clinic.

 

Maybe others on here can confirm this for you.

 

i would say that they will try and do it, even to the point of saying that your benefit may get stopped, but they are overstepping their responsibility.

 

Why not go down to the jobcentre and ask the question down there telling them that you are being forced into undergoing counselling as a conditon of you receiving your ESA.

 

Personally, I'd like them to tell me that I should be having an operation that could reduce the length of time that I am able to claim my benefits for!

Only if they would promise to pay my wife £1m if I pegged it on the surgeon's table!

I suggest you all be very cautious about the advice you are giving here and until I'm sober lol refrain from it as you do not know exactly what the OP has agreed to nor what the OP's provider can do for them.

 

Call me paranoid but as soon as what the provider could do was mentioned the OP asked for all provider details removed!

 

This was then taken from here and spread to another site! Where this second thread exactly as it is here was started.

 

You can not answer the OP's question without knowing what exactly the OP's provider is offering and the fact that several new/silent posters are in support here is telling. Plus the fact the OP is out right refusing to accept the advice that they should ask there provider says wind up to me.

 

The provider they're withs website as somebody who's fighting alcoholism (I have no choice I need a holiday from my head) anxiety etc is like a gift from the gods for what they offer so....

It's catch 22.

 

My Doctor will not prescribe anything whilst being an Alcoholic.

 

He states the meds if combined with alcohol could be fatal.

 

However I manage my anxiety with alcohol.

 

Tbh... I am getting worn down by it all.

That sounds like they will be treating you as a voluntary participant in the work programme (once you volunteer, it then becomes mandatory)

 

Contact the job center. Explain you are now on ESA(assessment). Ask them to send the work provider "Form wp11" to suspend(cancel) your participation in the work programme.

They made me sign forms upon initiation with this Organisation.

 

I don't know what I signed.

 

I didn't get any copies.

 

I have always being intoxicated to be able to attend these meeting with THIS SECONDARY WORK PROVIDER.

 

Can I fk this lot off?
