for the past two weeks i have been bombarded with telephone calls from CC company at first i would ignore them and add number to blacklist,but they seam to call from another number

 

have spoken to them for past four days refusing to go through security as they failed my security questions!!

 

i have told them to put it in writing and i look forwards to hearing from them.

 

They told me they cant stop the calls despite me asking them not to phone me.

 

I told them the level of calls revived from them is harassment they have said it is not as it is within my contract for them to phone me.

 

What would be the best way forwards on this.:frusty:

Who are these fools?

 

Send them this http://www.consumeractiongroup.co.uk/forum/content.php?493-Harassment-by-telephone-response-letter get "Proof of posting" from the PO counter, keep a diary of events as to their continued criminal offence of harassment with a view of reporting them to the Police.

Get in touch with your phone provider and go through their malicious calls procedure, also report them to Ofcom for abusing the telephone network.

 

If they ring in future laugh and hang up, DO NOT even entertain them on the phone.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Just ignore them. There is no legal obligation to talk to them on the phone..

There is a telephone harassment letter in the Cag Library

you can send.

 

The OFT Guidance 2003/2011 says in section 33(j) & (k)

It is unfair to ignore or disregard debtors' reasonable requests

in respect of when, where and how to contact them.

It is a credit card with santandere but when they phone they are phoning on behalf of santandere

 

I believe Santander collections is westcot credit as if i make a payment to them on my card it shows up as westcot credit

Again this is a breach of OFT Guidance Section 3.3 © Those contacting debtors not making clear who they are, who they work for,

what their roll is, and the purpose of the contact.

Did you have a Notice of Assignment stating that the debt had been passed to westcott?

it has not been passed to westcott still with santander

 

I also have a mortgage with santander which has been passed to collections and recovery's from time to time and that too is westcott collecting payment for santander as bank statement say westcott credit.

I am sure not many people are aware that Santander not only cant take card payments but also pass on your details

 

 

I have missed a few payments on CC that is why they keep phoning cant think what debt collector they will pass it on to if i don't bring account back to order!!

That's odd Westcott Credit Services is a debt collection agency!!

They are still out of order with the calls.

 

Amex used to get RMA to phone anyone running behind on their debts even just a payment or two behind and not defaulted.

 

Get that letter sent, they can deny / lose telephone conversations asking for contact only by post... its much more difficult if you've sent notification by recorded delivery/signed for :)

So you owe santander money, for you Mortgage yes? AND for a Credit card yes?

 

It does not matter WHO phone you regarding any of this, YOU DO NOT deal with financial matters over the phone. You MUST keep everything in writing.

 

Your mortgage IS A PRIORITY, credit cards and unsecured debts ARE NOT! (council tax, court fines are)

Just ignore them. There is no legal obligation to talk to them on the phone..

Tell them to stop and remove your number from their records or you will report them for malicious calls, abuse of how they hold your data, to the police for harassment and then to your phone provider ask them to monitor the calls and block their number. It may be worth for a couple of months to pay for a small fee to be able to block the calls yourself and have them deleted. You could also filter the calls, by having an answer machine pick up all calls, put your phone on silent ring, so you are not disturbed and delete all messages from these and other unwanted pests. No-one has the right to hold your phone number or call you at home if you tell them not to. There are other things that your phone provider can do but they will be able to tell you and it varies with each one. Another thing to do is to register with a couple of on line agencies that protect you from these calls. You can also have yourself removed from the phone book and reject all none registered numbers and silent callers. You can have them prosecuted for nuisance calls and you do not have to deal with them. Another trick I found worked was to answer and put the phone off the hook with them still attached to it for a couple of hours: they did not phone again, or put the automated message on for a day or two that does not accept any calls. They will give up when they cannot get hold of you at all. Send them a registered letter telling them not to contact you again and that you will prosecute them if they do not leave you alone. They will soon go away.
