Well, I finally got an answer from Lancashire Trading Standards advising me that NCO have confirmed that they will no longer be pursuing the alleged debt. However, there was no mention of the outcome of the phone calls. Perhaps if enough people complain then something maybe done. The contact details are:

I didn't actually do a thread as such. I was googling for NCO and AIC at the same time and came across CAG. I just initially asked for advice which I followed which was.

CCA Letter this was on 28th February. By 23rd April I hadn't spoken to anyone just their silly phone calls nor had they responded.

23rd April went to town and wrote to NCO and complaint to TS and OFT.

NCO did claim they were collecting on behalf of Creation but I wrote to Creation twice and they never replied. I assumed that NCO had bought the debt but this has never been confirmed, however, according to TS NCO are handing it back to Creation. Somehow I don't believe them.

hi guys,

 

paypal have just incurred a chargeback for an item I sold. The item was a classic car which i sold on ebay. the buyer claimed misdescription as it didn't pass its MOT in the UK. I am a UK citizen, but live in Thailand. This is where I shipped the vehicle from. I'm flabbergasted that the credit card company authorised this given the circumstances, but that's another story. The shipping costs amounted to over 1,200 pounds and as the vehicle is now deregistered in Thailand, it can't be returned.

 

As none of these circumstances were considered by paypal, or the credit card company, and there was never any suggestion that the vehicle would pass a UK MOT in the ebay ad, they will need to take me to court for the money they lost from the chargeback.

 

I apologise for my ignorance, but this is all completely new to me. Could anyone be a saviour and explain what I need to do when the debt collectors begin to contact me via, presumably my mum in the UK..

e.g. requesting a CCA agreement. Would this be relevant to my case?

 

Any handy help, hints or tips would be gratefully received in advance as I believe I'm in for a bumpy ride..

I don't intend on returning to the uk in the near future. with that in mind however, i don't fancy my parents being hassled by these people. from what i've been reading, they can be pretty tenacious. if my mum gave them my phone number in thailand straight off the bat, would that mean they wouldn't be able to contact her anymore? or better still, if she simply said i live overseas and haven't lived under her roof for over 10 years without offering contact info, would that suffice?

 

i'm also mindful of the fact that one day there's a chance i might return to the uk, so having a scarred credit record (if paypal/NCO could do that????) could get in the way of mortgage approval etc..

 

hmmmm.. i'm totally ticked off with the credit card company for not realising the implications of authorising a chargeback under such circumstances.

They would have difficulty obtaining a CCJ if you resided in Thailand. If they hassle you parents all they have to do is send them the telephone harrassment letter and inform them you do not reside in the UK. They can say you reside in Thailand but are under no obligation to say where. DCAs have NO legal powers whatsoever. In the unlikely event they got a CCJ then you would have no problem getting it set aside as you were unaware of its existance.. For £ 20 or £30 a UK Solicitor would make their lives hell by doing the letter for your parents. NCO are used to bully ordinary people but to get a solicitor resonding to them would probably cause them to mess their pants

I have recieved two post cards from NCO Europe saying they are coming round to my house, and today I had a knock at the door ( didnt answer it though), by the time I opened my front door the person had gone. What are the chances it was the rep from NCO ?????. Yes I know I do owe money to several companies, but I am not working at the moment, and the wages my husband gets go on rent, food etc. We have contacted a company that specialise in IVA"s and Bankruptcy and they suggessted that we take out an IVA, which means that all being well I should no longer be getting post cards and threatening letters. I mean its not that I dont want to repay my debts, its just that its impossible at the moment especially when the companies just WILL not listen!!!!.:evil:

First off, make an appointment with CAB to work out how you can start paying people back.

 

Second, phone your local Trading Standards and make complaint against NCO for their disregard of OFT guidelines for debt collection.

I am sorry I should have explained myself a bit better. We went to the CAB and they advised us to go into an IVA, but to find a company that gains no profit form having us as customers, so thats what we did. We had thought of going bankrupt but were worried about getting bank accounts, as my husbands wages are paid directly into the bank.

And yes, NCO cards only say they will call on Tuesdays.

 

 

On my card ( at the back in smallish print) it says

 

" NCO trading as RMA" and the address is listed as Preston, England

 

I am assuming they are the same company?.
