Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

    • The property was our family home.  A fixed low rate btl/ development loan was given (last century!). It was derelict. Did it up/ was rented out for a while.  Then moved in/out over the years (mostly around school)  It was a mix of rental and family home. The ad-hoc rents covered the loan amply.  Nowadays  banks don't allow such a mix.  (I have written this before.) Problems started when the lease was extended and needed to re-mortgage to cover the expense.  Wanted another btl.  Got a tenant in situ. Was located elsewhere (work). A broker found a btl lender, they reneged.  Broker didn't find another btl loan.  The tenant was paying enough to cover the proposed annual btl mortgage in 4 months. The broker gave up trying to find another.  I ended up on a bridge and this disastrous path.  (I have raised previous issues about the broker) Not sure what you mean by 'split'.  The property was always leasehold with a separate freeholder  The freeholder eventually sold the fh to another entity by private agreement (the trust) but it's always been separate.  That's quite normal.  One can't merge titles - unless lease runs out/ is forfeited and new one is not created/ granted. The bridge lender had a special condition in loan offer - their own lawyer had to check title first.  Check that lease wasn't onerous and there was nothing that would affect good saleability.  The lawyer (that got sacked for dishonesty) signed off the loan on the basis the lease and title was good and clean.  The same law firm then tried to complain the lease clauses were onerous and the lease too short, even though the loan was to cover a 90y lease extension!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

tbh, i am so glad it is out in the open, it has made my other half address his problems - which i wont go into on here - these problems were the reason i carried on claiming as a single person - and i feel a weight has been lifted from my shoulders after a very panicked weekend.

 

on a more serious note, i want to emphasise how many claims they must be checking and correcting - and the majority of these that is ALL they are doing - CORRECTING - i seriously doubt any one will be going to prison unless they have majorly denied / made up false people / laundered serious amounts.

 

i am so glad that i found this forum, i looked at another but felt if a posted there i would of been eaten alive.there are some good threads here, keep up the good work.

they said they had to back date it to the start of my claim which was july last year, even though i said he had only been here a couple of months they said the credit file showed longer so they had to do it that way, i felt it was best just to go along with it, if i denied it they would of looked further into it and the process probably would of taken longer (probably) and i just wanted it sorted.

 

he was a really nice chap, you could tell they were snowed under. i think they were just happy that i came clean - less for them to do maybe?

 

i then had to ring the 0845 number to make new claim, it will be back dated 3 months for some reason?

 

we will be getting a lot less and obviously the overpayment will be coming out of it too, but the sense of relief is immense for me.

 

i am sure it will be ok for you too,keep us updated, i reckon there will alot more posts like this in coming weeks/months due to the HMRC's new checks,so it would be good to give other worried people our stories!

 

 

i only joined today but was reading as a guest over the weekend, i do hope folle reads this - i was quite concerned about her.

Good news Cranberryjuice. Yours does seem to be the way the story goes with tax credits the majority of the time. It's just a shame that it can take longer to sort out for other people. It's good that it's getting sorted now because come april they will only have backdated your claim 1 month & not the 3.

Hi my case I think is a lot more complicated and they have gone back to years worth of claim s I presume you have read my thread ! Do u think I will be ok ! My stuff was sent today myself and my x have been separated many years no divorce ! Got a morg etc and he lives in london ! The only evidence I have got of that is a 2 landlord letters and his mother has written a letter ! Can't do much ! Just sit and wait ! Wht do u think my outcome will be ! X

folle, i have been popping back in to ee how you are, glad you came back.

 

right, at the top of your first letter, did it say which claim dates they were looking into?

 

mine said 2010/2011 and then 2011/2012 - this is when i thought to myself 'oh sh!t'......but he only said to me about the current years claim.

 

i take it you are disputing it?if so it could be more complicated. i suppose mine was different becaue i admitted it ?

Thanx for that I went to the cab and they wrote a letter I have not disputed the fact he has been here as he use to come weekends to see his daughter I am disputing he lives with me ! My stuff was sent in today !I have letters from where he has been staying ! Mine were the years 2010to2011 and 2011 to 2012 cab said this was normal ! Cab man said if they don't believe me they will send me an overpayment claim most probably! I have got prison out of my health ! But cannot believe I am under the care of mental health services ! Everyone has assured me I won't go to prison! Thans for caring xx

I hope they get mine sorted soon ! I am an absolute wreck ! Has anyone else got a complicated situation like mine ! If they don't believe me I guess I will have thousands to pay back ! It makes u wonder if this planet is worth living on ! I have a beautiful daughter she keeps me going ! X

Noodledoole I could not get on your thread am a bit thick at this sort of thing ! I am still low ! Been signed off work for another 2 weeks ! I don't know how I am going to get through this ! My family I know I have had a breakdown well my sister does but not the reasons behind it ! Breakdown is mild ! I really wish this was over is a bloody nightmare xx

Hi folle, I recieved a letter from them re overpayments. They have reduced my overpayment to if I had made a joint claim and not a single claim so looks luke that is the end. I will have to call them to arrange a payment plan.

 

Keep us up-to-date on how u get on, I'm sure it will b fine for u!

Hi I have not heard anything yet ! I don't know what they will say to me ! My x earns to much to make a joint claim ! They received my stuff wed so it will prob be a while before they contact me I have beensigned off work for another2 weeks edmj! I feel for u ! I just want some sort of reply so that I can get on with my life ! It has effected aLl aspects of it ! Mentally and physically and my it is now beginning to effect my daughter which does not seem fair ! Keep me posted everyone good to have some support x

I'm such a stress head and a born worrier.

Work was awful today I was so distracted.

I'm going to try and enjoy my weekend ... Easier said than done.

I haven't got as far to speak to a case worker yet.

I got my letter last Saturday phoned Monday and was told I would be called back because of high volumes of calls and was told the same again on Tuesday.

So it's all yet to come for me and it's doing my head in not knowing what to expect.

It's all a mess.

When did u send your stuff in??
