I am in a dmp and about to change over to a new company from the one I am in now.

The new dmp company have said they can take on my debt with bristow and sutor.

Has anyone ever had a dmp that bailiffs actually accepted??

They advised me not to pay this month and have assured me that bailiff can NOT force entry despite the fact they have entred before and listed some goods.I am new here so sorry if i have posted in wrong section!

Hmm, is this a a fee charging DMP or a charity ?

I would be very chary about interrupting payments until a proper handover has been agreed and done.

Have flagged your query for further advice.. meanwhile, if it is a fee paying DMP, you might want to reconsider.. have a read of the article below.

 

The following has recently been brought to my attention and could prove very useful. Especially now the OFT guidance specifically states it's an Unfair practice to ignore a cashflow budget!

If you are experiencing difficulty in repaying your debts, CASHflow is a way for you to negotiate affordable repayments with your creditors. Before you can use CASHflow, you must have spoken to one of the free advice agencies licensed to offer CASHflow to their clients. The advice agency will start by talking to you about all of the options available, and can help you to decide if CASHflow is the right one for you.

 

If you decide to use CASHflow, you will be provided with all of the tools you need to be able to complete your own financial statement and negotiate offers of repayment with creditors yourself. This will enable you to stay in control of your situation, but still have support from an adviser at any stage if you need it.

 

You can contact a local advice agency to check if they offer CASHflow. You can find a list of free advice agencies that are near to you by searching for a money adviser in England or Wales, Scotland, or Northern Ireland.

Can only echo the sentiments of the site team on fee paying DMP's - I'd be very wary of any "advice" they give you. Personally, I'd be inclined to pay until you have some form of confirmation that they have accepted the new DMP.

I understand the whole fee paying thing but many free dmp

Do not take in bailiff fees.. Hence why this one.

It is one of the most well known ones and I asked the ? About what if they dont accept? They then told me they have many they have dealt with and there is no problem

As they have special advisors that deal with bailiffs who will get them to accept.. Although i am a bit wary of missing this months payment what is the worst the bailiffs will do?

Am i asking for trouble?

Please, have a word with National Debtline tomorrow before you make any decisions to hand over money to a fee paying DMP.

 

Thankyou I have tried that with no joy :( problem is the bailiff payments.currently paying £200 a month plus £170 to my current dmp .

The new dmp has said they will consolidate the 2.

So thats my dilemma...no free dmp company will take on bailiff fees as its related to council tax!.i just wondred if anyone has had ANY company that has taken on bailiff fees.

CT is a priority debt and they would have to reduce all other non-priority debts to a minimum level. I suspect your account with the Bailiff will have barely touched the sides because of all the extra fees they will have added. I would be very wary of any dmp that tried to include this.

 

You say you have 4 LO's - do you know how much etc each is. You should contact the Council for the following info:

1 - how many Liability Orders they have against you

2 - the dates they were obtained

3 - the addresses they were for

4 - the period of time each covers

5 - how much each one was for

6 - how much is still outstanding

7 - the dates they were passed on for enforcement

 

You say you have asked for a breakdown of their fees did you send something similar to this:

 

"From:

My Name

My Address

 

To:

Acme Bailiff Co

Bailiff House

 

Ref: Account No: 123456

 

Dear Sir

 

With reference to the above account, Can you please provide me with a breakdown of the charges.

 

This includes:

a - the time & date of any Bailiff action that incurred a Fee.

b - the reason for the fee.

c - the name(s) of the Bailiff(s) that attended on each occasion a Fee was charged.

d - the name(s) of the Court(s) the Bailiff(s) was/were Certificated at.

e - the date of the Certification.

 

This is not a Subject Access Request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.

 

I require this information within 14 days.

 

Yours faithfully

 

Ripped off customer"

 

If they have levied on goods - when was this done and can you list the goods exactly as described on the Notice of Seizure? For how long have you been paying B&S?

Yes i got the template of here..i sent it yesterday just awaiting the reply.

I have been onto council and the liabilty orders they told me add up to the total debt.

Have been paying b and s for around 2 yrs..maybe 1 and half cant rmbr exactly but will know for sure when get the breakdown i know the 1st liabilty order was in 2007 ish.

My hubby had such a long conversation with the dmp people about this and just found out he has already given his card details to them for 1st payment! :0. Silly i know!

But they were totaly convinced they would take it on!

We even asked them what if they dont accept?? They again assured us they would as they have dealt with this kind of thing before including high court enforcments and house repossions etc Now im feeling a bit foolish :(. have we made a big mistake? Should i just risk it and see what happens?

We are now thinking maybe let the dmp take there payment and then just pay bailiff what we can afford? Until we know for sure..is this maybe a better thing to do?

Although bailiffs will probably moan they got less than there normal amount this month! Sorry to go on but usual payment is due next week!

If you pay less than the agreed amount I will guarantee you will very quickly get a letter telling you the payment arrangement is cancelled and you have to pay in full. They will also organise another visit to yourselves where you will be charged a "Van" Fee of up to £200. If you can I would pay what you are supposed to and reduce your other payments.

Daddyboo you are best advised to follow ploddertom on this one as the dmp company won't consider what shenanigans B&S will do when their new arrangement breaches your agreement, as PT mentions, they will consider the arrangement broken ,you are in default and they will start adding more fees to the debt, and mess up everything.

We could do with some help from you.

You have more than one Liability Order and you need to request a full and DETAILED breakdown of the fees charged by the company so that you can ensure that tey have not charged "multiple fees" for enforcing more than one Liability Order.

 

Can you post a list of the items that may have been levied by the bailiff.

 

If you can provide the above info, then regulars on here can then give advise you accordingly. UNTL THAT TIME, it is most important that you continue paying at the SAME rate as previously agreed as otherwise, the bailiff company will have reason to pay a further visit and this time, add an "attending to remove" fee to the account and this will have a significant effect on the amount that is currently owed.

 

I am sorry to say but the advise from the DMP at this PRESNT TIME is wrong.

Daddyboo, why don't you set up a DMP with CCCS or Payplan (both free), then just continue your payment arrangement with the bailiffs?

 

Someone might correct me here, but I'm sure they'd both take the Council Tax arrears payments into consideration as priority debts when calculating what you can afford to pay to your other creditors. I'm trying not to be completely doom and gloom for you here, but paid for DMP plans generally aren't very good (to put it mildly) - at least with CCCS or PP the whole of your payment goes to your creditors. Once you've got some breathing space by setting up a DMP with them, the regulars here could probably help you set up a self-administered DMP for yourself.
