Sent Student Loans a S.77 CCA request, their 12 days is up on Friday.

I've spotted a get out for them as the Act states that Section 77 doesnt apply to non-commercial loans.

 

Do student loans (with interest set at the Retail Price Index inflation rate) count as "commercial" loans?

 

Cant really see it myself. Doh!

 

I believe, but could be wrong that student loans have different regulations.

phewwww that letter took some writing, somebody at Lloyds TSB is not going to like little old tam in a couple of days :eek:

 

Lets sit back and see how they handle the bombshells I threw into the 3 pages of that letter :D

 

Whats the odds they issue a final response letter and try and call my bluff ?

 

For the LloydsTSB men in black I am a terrible poker player because I NEVER bluff.

I would imagine that the devasation that this bomb is going to cause may see a few of the banks filing for bankruptcy.Can't default a bank will I have and come the 1st of Feb the N1 go's in.Then after that it may be the baliffs:)

25 Licensee to be a fit person

 

(1) A standard licence shall be granted on the application of any person if he satisfies the Director that—

 

(a) he is a fit person to engage in activities covered by the licence, and

 

(b) the name or names under which he applies to be licensed is or are not misleading or otherwise undesirable.

 

 

(1A) The Director shall refuse an application for the grant of standard licence made by a consumer credit EEA firm if all of the activities described in the licence are activities for which the firm has permission, or could obtain permission, under paragraph 15 of Schedule 3 to the Financial Services and Markets Act 2000.

 

(1B) If an application for the grant of a standard licence—

 

(a) is made by a person with permission under Part 4 of the Financial Services and Markets Act 2000 to accept deposits, and

 

(b) relates to a listed activity,

 

Yeah! taking the p out of the consumer

 

the Financial Services Authority may, if it considers that the Director ought to refuse the application, notify him of that fact.

 

(1C) In subsection (1B) “listed activity” means an activity listed in Annex 1 to the banking consolidation directive (2000/1 2/EC) or in the Annex to the investment services directive (93/22/EEC) and references to deposits and to their acceptance must be read with—

 

(a) section 22 of the Financial Services and Markets Act 2000;

 

(b) any relevant order under that section; and

 

© Schedule 2 to that Act.

 

 

(2) In determining whether an applicant for a standard licence is a fit person to engage in any activities, the Director shall have regard to any circumstances appearing to him to be relevant, and in particular any evidence tending to show that the applicant, or any of the applicant’s employees, agents or associates (whether past or present) or, where the applicant is a body corporate, any person appearing to the Director to be a controller of the body corporate or an associate of any such person, has—

 

(a) committed any offence involving fraud or other dishonesty, or violence,

 

(b) contravened any provision made by or under this Act, or by or under any other enactment regulating the provision of credit to individuals or other transactions with individuals,

 

(bb) contravened any provision in force in an EEA State which corresponds to a provision of the kind mentioned in paragraph (b);

 

© practised discrimination on grounds of sex, colour, race or ethnic or national origins in, or in connection with, the carrying on of any business, or

 

(d) engaged in business practices appearing to the Director to be deceitful or oppressive, or otherwise unfair or improper (whether unlawful or not).

 

 

(3) In subsection (2), “associate”, in addition to the persons specified in section 184, includes a business associate.

 

 

26 Conduct of business

 

(1) Regulations may be made as to—

 

(a) the conduct by a licensee of his business; and

 

(b) the conduct by a consumer credit EEA firm of its business in the United Kingdom.

 

 

(2) The regulations may in particular specify—

 

(a) the books or other records to be kept by any person to whom the regulations apply;

 

(b) the information to be furnished by such a person to those persons with whom—

 

(i) that person does business, or

 

(ii) that person seeks to do business,

 

 

and the way in which that information is to be furnished.

Halifax BOS - that was a naughty mistake - and they try minimise this stuff?

 

Only last week my hubby had a phone call at work to tell him he'd a letter on the way to him with some other persons name and details on it!!! The other person had got a similarly "reversed details" letter too with my hubbies details on it !!! Nothing like "client confidentiality" is there?

 

And we are supposed to have faith and respect for these companies? This last few months my view of the industry has really changed. The more I read - the more disgusted I am with what goes on in these companies.

Trouble is Term, it's not us that decides if a person is a fit person, its 'the director' (sounds like an evil character from a B movie) and that's when politics come into it. Just look at the whole OFT fiasco over charges.

 

I think it will be a very hard slog of monumental proportions. I admire your spirit and determination. If you need any assistance just shout. I'm sure there will be several of us who will be there to support you.

The original thought is an interesting one though - we could have much more of an impact as a group than as a collective share of ideas and knowledge. We're months if not years away, but I recon we're going to need a bit of structure if we're ever going to become a political force. You never know, Bankfodder may yet be Prime Minister!
