    • Well we can't predict what the judge will believe. PE will say that they responded in the deadline and you will say they don't. Nobody can tell what a random DJ will decide. However if you go for an OOC settlement you should still be able to get some money
    • What do you guys think the chances are for her?   She followed the law, they didnt, then they engage in deception, would the judge take kindly to being lied to by these clowns? If we have a case then we should proceed and not allow these blatant dishonest cheaters to succeed 
    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

6 weeks on after my tribunal i have contacted them regarding the time it is taking and i was told it says nothing on the computer and haven't received notice off of the tribunals service stating i have won, so they have someone calling me tommorrow regarding this. Maybe they will ask for me to fax them the copy i have of the tribunal notice to them? any advice before they call? i don't want to wait any longer as being told 3 different stories i have become slightly in debt from the wait so i need this sorted asap.

Bloody hell, this is getting utterly ridiculous.

 

There seems to be a huge issue with post getting to the right office in recent months and it only seems to be getting worse.

 

I'm hoping that in your case, they have received the notification but that they just haven't entered the information into the computer system as yet and that is why the call centre are saying it's not received (this is quite common).

 

When the person from ESA calls you tomorrow, this will be someone from the office processing your claim. Ask them outright if they have the notification. If they have, ask how much longer it will be before you receive your payment. If they will not commit to an answer, ask to speak to a team leader - you have given it 6 weeks which is long enough.

 

If they haven't got the notification then providing you can send a fax, then tell them that you would like to fax them your copy of the notification and request they provide you with the fax number. If there is any issue with this, again ask to speak to a team leader. (also ask for an approx timescale).

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. If requested, I will provide a link where possible to relevant legislation or guidance, so that advice provided can be confirmed and I do encourage others to follow those links for their own peace of mind. Sometimes my advice is not what people necesserily want to hear, but I will advise on facts as I know them - although it may not be what a person wants to hear it helps to know where you stand. I don't know if this is helpful, but I won my ESA on August 19th. I rang 3 times to hurry them along, as was in desperate financial situation. Told twice that they'd not received notification, even tho' I called the Tribunal office who sent it a second time. Was so furious that this was taking so long I emailed Iain Duncan Smith and my MP. Heard nothing for a while but then about 10 days later I got a call from the office who were dealing with my claim (think it was Leicester). Had a long conversation with a very apologetic chap, who asked me to go over the details of my calls to various offices. He said that it was quite clear from the notes on the computer that the notification got to them on on August 23rd (tho' I'd been told categorically on 2 occasions after this that they'd not received it yet). Anyway, more apologies from the man, then he said they'd send me a payment (amount not specified although it turned out to be £25) for the mess they made of things and my inconvenience.

 

My emails were really only to point out to those "in charge" that those of us who have had to appeal regarding ESA have already been through very stressful and difficult times, not to mention problems with their ongoing condition/sickness, that we often have to wait a very long time for the appeal to be heard (in my case 2 years!) and it just isn't fair right to make people wait for so long when they have been found to be entitled to this money. My back payment arrived within a few days of this telephone call.

thanks for the information mate. im waiting for the call and i will stress the situation i am in and offer to sennd the notification via fax tommorrow because i cannot wait any longer for them to send letters etc to different services. i think waiting 6 weeks this friday is lonng enough. i was told today it had nothing to do with my tribunal on the computer.

alrite so they rang me @ 11am and she said she is going to look for my file and call back....she never did. i rang them myself and told they hve no notification of my tribunal. i called the tribunal service and was told they sent the notification shortly after the tribunal but they will be sending it again....what the hell is going on!

I'm having the same problem. Won the IS tribunal back in September, ever since they've been saying they haven't received the notification. It has now been faxed to them 4 times and posted to them 5 times and yet they still say they haven't got it. Went to my local jobcentre today and asked them to put a copy on my file and also fax it to the relevant department. They did all this whilst I waited and i'm still being told they don't have it. I've now made an official complaint and asked my mp to become involved. The lady on the phone has now told me twice to stop calling them. So I shall keep calling them and calling them until they are so sick of me they actually get off their bums and sort it out!

good on you! i am going to make sure that this friday it is sorted because if it isn't i am going down to the actual address on my letter and demanding they sort it on that day and then if no result i will go to citizens advice to get them to call up and perhaps persuade them in someway! i refuse to wait any longer. the fact i was told somebody would call me then when they did she told me she would call back with my information....never did happen.

Did they give you a 3 hour callback? If so, you have to ring tomorrow and complain cause they didn't call you back. I've had to do that loads of time recently and each time i'm put through to the manager of the call centre who then contacts the manager of the department who was supposed to call you back. Nine times out of ten they'll call you within minutes of that call. Don't give up, keep hassling them. Keep records of all contact you've had to make and just keep complaining. Believe me they will get fed up of it soon enough.

thanks for this information....i'm not naturally a moaner but i feel tommorrow i need to be! i called the day before at the end of the day and she said she would leave a note on the system so tommorrow i will be called between 9 and 12 and i was, she then called me and said she would call back when she has found my files/documents which she never did....i am going to phone them tommorrow and ask to put in a complaint about this and while i am on the phone, ask for the fax number to send them my actual copy...

This happened to me on my last appeal. It was almost 2 months before I got notification that I had won till the DWP updated it on their system. Was a nightmare trying to get through to them. It will get resolved, just got to hang in their in the meantime. It is a complete and utter joke, that in this day and age such a simple notification can take so long to make.

I called today and have said that on the computer it says it is now done and m money will clear by Monday. If anybody wins a tribunal,'call up the tribunals service after a week or so and ask for it to be resent. I had mine resent a day or so ago and got my local mp to chase it up.. Finally :) all the bet

currently waiting on the payment now, they said on my account it was processed now and that it will take 2-3 working days, (that was wednesday i called) so maybe today it goes in?? i thought it was always instant but doesn't suprise me if they find another way to delay it with the bank a extra few days

Glad to hear you got it sorted! I also have managed to get my backpayment sorted out since I threatened them with my mp! Can't believe how quickly my MP has replied. I got a letter from him yesterday saying he has sent a letter to the district manager of jobcentre plus and they will be in touch shortly. Should be getting my backpayment on Monday! Still in shock that it's taken over a year to sort this out but I plan on complaining and getting something done about this!

 

Glad you're getting it all sorted. My advice to anyone waiting a backpayment. Threaten them with your mp, they will soon move x

Can you not ask them to look again at your claim? I'm not sure what happens with esa as I don't get that. They put me back on income support as i'm unable to work. I suffer with seizures which can't be controlled and they happen at any time without warning so have to have someone with me at all times. Can't even be alone with my kids, yet they still stopped my money last year. Grrrr! I would contact them again and ask them to look at the claim again as you can't work x

Hi norby. When I won my IB appeal, they sent a series of payments to my account. Usually if not always, the money was there before I got the letter saying they were paying. Have you checked your bank account?

hi HB, i haven't left the house since wednesday so it most probably is in there...just having a fault with my debit card thats all....i tried paying a bill and it declined so i am assuming it hasn't yet? maybe it takes a short while because it is over a certain amount?
