just got the standard letter from barclays today:

 

sorry but the £1000 offer is only in full and final settlement blah blah blah.

barclays now have until monday and I can file judgement by default. I'll be getting up at 00:01 monday am!!

Ok I need help on my notice of issue it says defendant has until the 6th Nov to reply. Does that mean I can file for judgement at 00:01 on the 6th or at the very end of that day so like 00:01 on the 7th?

Hello there, you are at exactly the same stage as me!!! I phoned the court and Barclays apparantley have until 4pm on monday to do something!! barclays havent even acknowledged my claim!!!

I wouldn't get too excited or keen as to a precise judgement time, they will apply for setaside anyway, and probably get it.

I know - but I want to get things moving along as qiuckly as possible. Ill wait until later in the day to do it on monday then

I believe you can apply after 4pm on Monday and then it will be processed Tuesday morning though prepare yourself for it to be rejected as Barclays are well known for entering last minute (sometimes late) acknowledgements/defences. Just another of their boring delaying tactics

predictably barclays acknowledged the claim this afternoon, so got until 20th now!

They are lousy!!! They acknowledged mine today at 15.52!! When deadline was 4pm. My deadline is also 20.11.06:(

must have faxed it over or something as I called in the morning and nothing had come in the post... they don't want to waste a single day do they before paying out!! The guy at the court said they were fed up with barclays!!

glad it's been useful I've been trying to post as much useful information as possible - there doesn't seem to be a great deal on the latter stages in the FAQ - I guess banks were paying out earlier - not are waiting to the very last minute. Roll on the 20th, atleast I can get an AQ then get my court date and there is an end in sight at that point.

There is a template to filling out the AQ. I've just filed my AQ in my cahoot claim. This is basically what I've put

 

A) NO

B) YES - Dartford County Court. I, as a private individual with limited resources, are claiming against a company who carries on business in this location with huge resources, then the case should be heard locally to me.

C) YES

D) 0

E) NO

F) NO

G) I believe the case will last no longer than 1 hour. I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.

However, the continuing problem is (in common with the 100s of other cases currently being brought by other bank customers) that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith.

Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. I believe this would bring a rapid end to this litigation.

well Barclays have until monday to file defence so far they have only acknowledged. but I expect about 2pm on monday them to fax it over!

I'm in a similar position to you guys. I started my MCOL a few weeks ago, it was considered served on the 21st of Oct. I didn't get so much as a single offer from Barclays until after they'd acknowledged last week! It was for a third of what I've asked for, so I said 'thanks, but no thanks'.

 

They've got until Saturday the 18th to defend so we'll see. Only two days in advance of you both!
