    • Thanks DX , true I was reading it as my own licence when I can now see it is the VED thanks for the clarification. As for the payments that does make sense and I will give them a call today. I have to watch the date as I have 21 days from the 29th May to respond to plea of guilty or not.
    • This is the latest response from IDR. I know exactly what has happened - I left Qatar in 2006 leaving behind card debt of QAR13,000 (unintentionally, I thought it was paid off). When I visited Qatar for a weekend in 2012, I was blocked from leaving the country - ended up having to go to the Court, met with the bank and negotiated a settlement  - they wanted about QAR90,000 in total and supposedly agreed on QAR40,000 to settle completely. Unfortunately, I only have a pay-in receipt for that and no confirmation the whole debt was settled: I was so focussed on getting the exit ban lifted. I left and I have visited Qatar since then with no issue. My concern is that the statute of limitations will run from 2012, rather than 2006. Should I continue to ignore or explain to IDR that I don't agree there is an existing debt? IDR 10062024 redacted.pdf

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I've been receiving letters from Capquest re a Next Directory account and

 

thanks to reading the helpful posts on CAG I sent them the CCA request letter recorded delivery on 1st June.

 

I received the following letter back dated 3rd June:"

 

Further to recent contact wtih our office and your request for further information in relation to the above account,

we would confirm that your account is now on hold for 28 days whilst we obtain the information required.

 

If you have any proof of payments or correspondance that would assist with your query,

please forward these documents, with a brief covering letter to our Collections Administration department,

so that we can resolve this matter as soon as possible."

 

Obviously I didn't assist them and sent nothing.

 

Then I received this letter dated 8th June:"

 

Further to your recent correspondence and in order to process your communication further,

we would request you provide the following information by 17 June 11 to assist us in resolving this matter.

 

Proof of residence at the time this account was opened: 1st December 2008

 

Your assistance would be greatly appreciated.

 

Please note this is not a demand but a request.&quot

I'm not going to kindly assist them by sending them anything and interestingly

I'm pretty sure that the account was opened well into 2009.

 

Do I send them this letter from the library and then what?

 

Or do I wait?

 

Help, confused myself reading too many forum posts.

Hi there

 

In my view, if they are chasing you for a debt they should be aware of their facts. I don't think you should be giving them assistance.

 

You're telling me Mr dca that I owe you money...you prove it. If you cant provide me with a valid document under a s77/78 request, you aint getting anything.

 

My advice...ignore their request.

You don't have to send them anything.

 

You have made your CCA request, they have a timescale within which to fulfill it.

 

If they don't, send them the Account In Dispute letter --> http://www.consumeractiongroup.co.uk/forum/content.php?436-Failiure-to-provide-a-copy-of-the-agreement-within-the-prescribed-timescale

then ignore them

Hi

 

Thanks to the help I got on CAG a couple of years ago I sent Capquest a CCA request with postal order re a Next catalogue account.

 

That was 1st June 2011.

 

They sent two letters asking me to provide them with any info I could, which I didn't do,

and I sent a letter on 18th June 2011 saying they have failed to comply with my request.

 

they sent a letter on 29th June saying the account was on hold while they waited to hear from Next.

 

The next I heard from them was in November 2011,

the usual money demand letters with no mention of CCA.

 

The latest now is that Past Due have started to send letters saying Capquest have appointed them to recover the money.

 

What is my next step?

 

I have drafted a letter to Past Due saying the account is in serious dispute and to hand it back to Capquest (as per a letter template on CAG).

 

Do I wait and see what happens or do I contact Capquest?

 

One last thing,

 

I read on here this evening that since 2007 CCAs do not have to be signed

so does that mean in theory a DCA can produce a fake CCA?

PO Box 550, Manchester M5 is NOT an address for Capquest. I have received several letters addressed to a former occupant of my home, with the "CDR, PO Box 550" return address. I contacted Capquest by phone after reading this thread, but they confirmed that this return address is NOT related to Capquest.

I contacted Capquest by phone after reading this thread, but they confirmed that this return address is NOT related to Capquest.

 

I wonder why they put it on their envelopes then?

Perhaps your letters are from DVSL who use the same PO. box. Oh wait a minute, they're capquest in disguise.
