I have tried replying to their emails in the past but they dont seem to get them or acknowledge them. Should I just email them the text from the one removing the right for a doorstep visit?

What complete and utter GARBAGE, ''Formal Appointment Request'' indeed!!!

A letter springs to mind to The Compliance Manager. Motormile. DO NOT PHONE!!!!!!

Dear Curr or Madman,

 

I refer to your ridiculous letter demanding an appointment for one of your doorstep agents to attend at my property I now FORMALLY inform you that NO SUCH

APPOINTMENT WILL BE MADE.

 

Should your agent attend the property he/she/it will be ordered to leave and their failure to comply will result in their physicall removal from my property using

any necessary force.

 

All rights implied or explicit for any agent, representative of Motormile are withdrawn and any attempted vist will be considered harassment.

I sent a WOIRA by recorded delivery and had a non-sensical letter from one of the in-house slugs telling me that they won't stop pursuing me (threats indeed) and basically ignoring the fact i have told them with clarity the WOIRA in their case will never be revoked.

 

However, further to this letter, it's evidently ruffled some feathers in their dirty stinking sewer tricks department, as every few days Ive had a 'doorstep challenge' text , i'm half expecting someone to turn up with a pack of DAZ and ask me to show my pillow cases ... then last night, a doorstep text ... at 10.30, which really pi$$Ed me off, then another this morning, however, i found out that you CAN send texts back although they never reply AND lo and behold, you can actually ring the text mobile as it's linked to a landline phone, so evidently they have some kind of automated calling system to dupe you into thinking someone from a mobiles calling you, clever, but not that clever as they now have a massive Achilles heel in their system, you can RING the mobile and it diverts to a phone, so quick as a flash I rang last night and left a sarcastic message quoting my 'M' reference number and 6 digits, basically daring them to make a home visit, this resulted in this mornings text message.

 

So, lets give the **** suckers a taste of their own medicine and wrap them up in nuisance calls, the mobile number to call is 07702873738,(also syas ext 225) just ring say you're ringing in reference to Mxxxxxx and you'd like to make arrangements for payment, make sure your number is withheld so it can't be traced, and start to tell them you'd like to pay 100 a month (gets the juices going) and then before you hang up just repeat their mobile number so they ring themselves, they're that stupid they'll do it. I've just done another one and some silent ones, see how they like their own weapons against them. Scumbags. Overload their message system so any genuine calls HAVE to sifted for, they'll be 'outraged' as the possibility of losing money.

They know full well breaching a WOIRA sent by rec del is a stupid move, even the clown department at TV Licensing aren't that brave, in fact they produced a policy document to deal with such letter as only a warrant of execution from a magistrate under statutory powers can break a WOIRA, it really is THAT powerful, if everyone who had a letter from a DCA replied with a WOIRA they'd all be shafted.

so looks like one of the directors is nearly bankrupt then with an IVA, does that make him a fit and proper person to be a company director with finance? I think not, perhaps time the OFT were advised of this low life parasitic leech and his mate and ask for a formal investigation, better still contact SFO and see if they have any ongoing investigations, most owners of debt buying companies and DCA are crooked and bent directors with a shady history in either illegal money lending or the security industry. Lets put these scumbags out of business and hurt their pockets viciously.

People do send that to DCA's, however the DCA's still threaten to come and in some cases still turn up.

also the company accounts look dodgy, 2009 a/c showing cash in bank 500 quid nearly and owing nearly 200k to creditors? wtf? WELL dodgy if you ask me. i thin also that their CCA licence needs investigation to see whether it can be revoked.

I completely agree with you there. However, many thousands of debtors send the letter, but have no intent on following up on their words. Which is why DCA's keep doing it over and over. The debtor is scared or too lazy to take the CA and their reps to court, even though its pretty much an open and shut case for them.

 

DCA threatens to come, debtor issues a WOIRA. DCA breaks WOIRA instructions and teh debtor slinks away scared and dismayed.

 

Too many people think a simple letter will work, when in reality, the DCA's get those letters thousands of times a year, and they know from experience, they are rarely, if ever followed up on.

I'd have no hesitation to follow up, but you are correct, their lack of respect for due legal process is the issue, relying on intimidation and bullyboy tactics to reduce a debtor to a sorry state so they cough up, i go the other way, the more hassle i get the less change of a solitary penny in the post (well, id send them a penny red!) really are low life vultures preying on the vulnerable and needy in society.

I had a letter from one of their friends telling me they were most upset that they were FORCED to trace me and I would be taken to court in 7 days with no notice.... that was a couple of months ago now and nothing else has turned up. I've been at this address for about 3 1/2 years now and at the previous one for 3 years so anything they may be chasing is statute barred. I will send a prove it letter if necessary but I think it is a 'bait' for them to bite hard.

 

I've never had any direct dealings with MM and therefore am not their 'customer' so therefore they are hearing nothing from me.

I spoke to MMF and offered them £30 a month,

they said that this is below their normal level for acceptance and said that I should speak to Money Action Group who are some sort of debt management company who they are linked to?

 

And that if I did this they would put my account on hold for 4 weeks.

 

So i have done that and MAG have been phoning me constantly but i havent spoken to them yet.

 

Actually in the text it says Kensington so i'm a bit confused

 

I think £30 pm is fair as I went to court over another payday loan of roughly half this amount (£450) and have to pay £10.27 a month...

 

Any ideas?

haha "normal level of acceptance". WHat the hell are they talking about. They have to accept whatever amount you can prove you can pay.

 

Also, if you want to go to a DMP to help you, use payplan. As you said, they are trying it on to get more than you can realistically afford to give. Repeat your offer and state that it is a final offer and no further correspondance will be entered into until they accept, and should they cosider any further debt collection methods, you will be using their email/letter as proof that they are not adhering to OFT debt collection guidelines.

Report MM to the OFT and Trading Standards, they are not supposed to be passing you onto one of their 'sister' companies. Money Advice Group are part of Kensington Finance (or so I am led to believe) and would try to get you to go into a DMP with them.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Definitely lodge a formal complaint to the OFT&TS, that is a MUST.

 

If £30 a month is unacceptable, then try £15, if that is also unacceptable then £7.50.......all the way down to £1 a month, they will learn to accept what debtors offer, if their greed, which knows no bounds, gets the better of them, then they lose.

 

And as you have already found out first hand, talking to these children over the phone gets you absolutely nowhere, so DON'T DO IT!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I had the misfortune of working for these muppets for a few months (2nd job, extra cash).

 

We did get told to accept whatever was offered, but people are obviously holding out for commission.

 

I hated every minute working there.

See, thats just plain wrong and needs to be outlawed. Making commission of other peoples misfortune is just despicable.

Tell them that if they stop adding interest you will pay £30pm otherwise it's a tenner.

 

If they argue be firm.

 

If they won't accept it, make the offer in writing, saying that is all that you can afford along with the first payment. If you don't have details of how to pay, ask for them for the future payments (standing order / electronic payment etc, not direct debit)
