sorry to jump into this thread, but regarding the late payment (default charges) can you claim these back if these were on a persnal loan?

so on the charges for the missed payments and intersest can my daughter claim these back although the court have now placed a ccj on her??? if the charges are given back will these go off her balance owed or do the finance company have to pay her these??

Irrespective of any CCJ if there are reclaimable charges then you can go for them.

Its your call as to how you want those charges paid-our experiences tell that its not advisable to agree to any reconcilliation.

If you take it to Court they may even try to reconcile the payment if you win-but you dont have to accept that.

 

They are unlikely to agree to pay them back without you indicating Court action should they refuse.

 

We know Court action for return of charges can be daunting for some-but theres help here from many who have gone on to do it.

Congrat! Our threads for help appeared not to have been blessed by the wonders of Ell-enn. After two refusals we now got an appeal listed and need to send the Bundle asap. We need the skeleton argument and grounds of appeal to be blessed by legal experts or people with legal idea on powerful and complicated housing repossession case between HA and Tenant.

Initially you need to know what your charges are. You can request this information from your lender. Then you can either raise your initial complaint with your lender or if you dont feel confident in doing this yourself (I didnt!) you can contact the Financial Ombudsman Service and they can initiate the complaints procedure on your behalf (this is free!!!!) Hope this helps a bit.
