    • when did they (who) inform you there was a 'police case' and when was this attained? i will guess the debt is now SB'd as it's UAE 15yrs. have you informed the bsnk ever by email/letter of your correct and current address? you can always ignore anyone else accept the bank,  Block and bounce back all emails. Block any text messages  Ignore any letters unless it's: - a Statutory Demand - a Letter Of Claim - a Court Claimform via Northants bulk.  
    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes :) im meeting her at 10am, meeting due at 10.30. Am soooo relieved cos i am one of those nervous talkers if im not sure what to say. This gives me time to kno what to say, cos even tho i will tell truth i dont wanna go into everything unless im specifically asked. And i will know before what evidence they have. Dont want to deny something in a moment of panic if im caught unaware then let them show me solid evidence n then contradict myself itms

I think i feel worse cos ther soo much grey area in regards with how much time etc u can spend away from home etc, which makes it so hard. Cos although i know i dont live with him, im questioning whether will it be seen as that. If that makes sense. But all will b revealed tomorro, n camt wait to kno what they have to say to me, n any evidence they think they have. Arrrgggghhhhh roll on tomorro! Am taking some sleeping tabs tonight so i can get a decent sleep, 3 hours in 2 nights isnt helping my state of mind lol

 

Yep, I hear ya. you are going to be fine, even more so now you have a solicitor to go with you, how did you swing that!??

Just rang round frantically lol and was very lucky i guess. I just truly hope this is just tying up some loose ends in regards to when i lived with bf when leg broke, and why i didnt cash cheques. I really hope thats it n all this worry of people reporting me, being followed and my whole life out on the table isnt as bad as im imagining : /

Totally reasonable to be imagining people watching you, I gave the bloke getting out his car when I took the kids to school yesterday evils, even though mine wasn't to do with the living with someone issue. LOL seriously. It's basically paranoia because you have been accused of benefit draud. And the horror stories you read. But most of them come to nothing, it's just they are quite happy to seek reassurance on places like this, but fail to let people know what actually happened in the end because they got the outcome they wanted. Way of the world unfortunately.

Yep, same here, no matter what had happened to me today or what hapens in the future, because it's not over til the fat lady sings for me after all! I will be on here boring the pants off people with results lol

I dont like to think anyone is taken to court because of something they said under pressure under an IUC when they are innocent. Unless the interviewer I had today was lying, which is always possible with people that are trained to try n catch you out, there is loooooads of vulnerable people being prosecuted for things they didn't understand in the first place but implicated themselves on tape due to fear. You only have to read the Child poverty action group to see how many people live in fear of these authorities & end up in debt due to paying back over payments that they cant afford. It's getting shocking.

Good luck. You will be fine, & I am so glad you're going with a solicitor. Will keep an eye out for your return, if anything like me you have to ring round family to let them know what happened first. But I reckon you'll be ok. Juts remember, no waffling! Just answer the questions lol Although I struggled with that, took a lot of restaint to keep me gob shut :madgrin:

Good luck today Wizzer. You will be fine, especially now you have a solicitor. Is she a specialised one or a regular one? Lots of deep breaths, and let your sol do the talking. And at least you know what they have BEFORE you go in so you will be more confident of your answers.

Couldve gone better : / they had evidence of me changing schools which I did, hardly any use of electric, and a neighbour telling them I was hardly ever there :/ so not good really :( doesn't look good :( they sed it being sent off to a decision maker. Dunno if what I sed got me in more trouble. The lady interviewer was not very friendly after interview I sed thank u and she just looked away :/ she thinks I'm guilty! So hope she doesn't Hav a say innit!!!! I'm just so scared now and hope for best!

Solicitor thought I went ok tho n sed I may Hav to pay bk the money for wen I was staying with bf wen broke leg, which I don't really understand cos they Hav proof I informed them of this :/ And they noted that I did :/

To be honest it still doesn't look like they have a cast iron case to go on. And no, it's not going to be her choice what happens. The fact they know now you have a solicitor involved they'll also know they will need more to go on that what they have so far to take you down!

What's your neighbour like! So it was the neighbour that rang them?

I Hav no idea who told them, neighbour just sed that to an officer who came about something else! It's just a nightmare! I can't afford to pay anything bk and am just scared I will, argggghhhhhhhh!!!

Just read through this thread from the begining again. So you changed your childrens school in preperation of moving in together in april. Of which you had informed the benefit dept of, by cancelling your claim. You dont have any shared bills, they haven't produced evidence of anyone coming & going from your house, no evidence of you only collecting post from yours, & you dont use much electric because you're skint, hence the reason you went bancrupt.

You know what, I am no expert, but that reeeeally doesn't sound like anything that would be enough to find you guilty of fraud in a court. You let them know about stopping at the BF when you broke your leg. I expect what the solicitor means there is there is probably a time limit you can be away from home before the benefit stops (which I am not sure of what that time scale is) & that's why he is saying you may have to pay that back.

But the living together thing? I cant see them getting a conviction out of what they have yet. The IUC was to see if you will admit to it I am betting. x

Looks like the did a bit of research :( I didn't even know that they looked at a person electric.

 

I believe you can appeal the DM, but sounds like your solicitor is expecting it to go against you.

 

Did the solicitor talk about the likelihood about any further action they might take apart from a repayment?

No she sed it went well other than that :/ oh I dunno I'm still confused but at least I will b coming off all that 1st April n won't Hav to watch myself or anything anymore x

 

That is a good thing. They will never be anything but hassle, benefits, until they bring in the universal benefit system. I wont touch housing benefit until that happens. Youngest is still at school until another 3 years, so I may get it again through the new system, if it's been phased in by then, but not until then.

My goal now is to up my work hours. Your goal is to let your solicitor deal with anything else from them now, because you're no longer claiming anything off them anymore, they haven't got anything definite to go on. If they ask you to another interview, if it was me, I would decline. But that has to be your choice.

The stopping away from home thing should be fine for you in theory because you weren't away longer than 12 weeks were you. And you had a good reason for being away & you let them know.

That's it, tried to catch me out twice, once cos for some reason official receiver put bf name down on bankruptcy website but luckily I brought a letter from them and my bankruptcy application which had my address on, also with driving with broken leg (driving my kids to school) it's my left leg n I drive auto so that deflated them abit.

The trouble is by changing schools she will have signed she lives at that address.

They will use that to show she admits to living there, and the other bits to confirm that.

 

If she wasn't moving in with him, I would agree that could be a downer. But 'I have put the adress as this one as I am moving in there in april, we haven't been living together'

I dont think the other bits are concrete enough, personally? I'mnot a judge or jury though. But if I was on jury service on this day I wouldn't say any of it is enough to go for guilty.
