  1. after a IUC with Jobcentre....The investigation was closed and I recieved a letter from them. two days later I have recieved a letter dated the date of letter of dwp from hm revenue comploance asking me for all the same as what your being asked for, otherwise my money will be stopped/. Bank statements, phone bill . tenancy aggreement. and gas and electricity bill. I had legal advise and was told to send the evidence they require and explain anything that is in joint names and the reasons why. I was with my ex 12 years and split up 4 years ago, yet im being accused of him living here, he pays his own bills, rent etc...the only joint things are tenenacy which was taken out 6 years ago, which i can n ot take off and he refuses, and a bank accoutn which he does not use. Im guessing that his Self Assessment he has put my address on...but that's not my doing as he has been told to change his address and i return to sender. Not sure what will happen but i will keep you posted.

I had a letter about benefit fraud, as ltahaw, i got through this and investigation was closed by the jobcentre, I then recieved a letter from Inland revenue two weeks ago saying I ignored a letter from them..i did not and phoned and was asked the panel of questions as like above...Now they are asking for 3 months bank statements, gas and electricity bill, phone bill , and tenancy aggreeement! im about to disclose the information to them but am worried slightly as me and my ex have been split up 4 years, the bank account is joint and the tenancy but this is because i cannot remove him without him doing so and aggreeing. Im guessing that dwp has passed on info from my IUC and hoping to stick us together as a couple. I have neighbour statements, a boyfriend whom im expecting with and also other statements from people. If says if I do not supply this information that my child tax credit will stop...any ideas..what to do or the legislation on this....It really is ludicrous. Since the dwp accusation of LYTAHAW I have filed for divorce as I do not wish this harrassment to continue...any ideas people or advice would be great.

  4. It sounds like you were very lucky to get good results...I have no recordings...so no such luck here! Thanks, Erica replied at the bottom on this thread. It was at an IUC that evidence was provided which included bank transfers between my ex account and mine ( LTAHAW)- Not the case but another story. It was mentioned to my solicitor that this £80 if child maintenance was not being taken into account Despite my notifying them. Just happy as it's just IS and not HB & CT benefit aswell.
  5. Thanks Erica for your invaluable advice...this will really help me with sorting out my situation. I have not been told yet how much the overpayment will be as of yet. The worse case Im looking at is paying it pack....although I notictified them and feel it's there error as I informed them by telephone..im going to have a sturggle prooving it. (unfortunately)! The worry of it not affecting housing benefit was my big concern as the last thing I need is rent arrears on top of an OP.

If I am correct im sure the rules of Child maintenance rules changed in April 2010, meaning if claiming Income support ...this would be disregarded by Housing Benefit, Income Support and Council Tax. Before April 2010 the rules are that you are allowed to keep £20 whilst in reciept of Benefits... Which brings me to asking my question.... I have been told that I may have incurred an Overpayment on Income support because they have not taken into account the maintenance I was recieving. Should this decision be based on the new rules or the old rules of Child maintenance and as I informed them by telephone...what grounds would I have to appeal this? I hope someone can help as they are trying to say I owe roughly three grand.
  7. I can not find anything to do with the legislation on Child Maintenance appart from April 2010 it changes and is not counted..but before April 2010 your aloud to keep £20 p/w if on benefits. Just need to find out how....if they say an Overpayment now..would it be the old rules as that's when the op would be..or would the new rules replace it?
  8. So an overpayment if suggested...would not effect my current hb/ct claim? Also it would be retrieved back through my current IS claim which is currently running? It's a shame that knowone knows whether the new Maintenance rules count or the old rules? Thanks for your help...any ideas how I may find out about that?

Thanks Jadeybags Think I will definitely be going for that then, being nervous I can imagine could have a negative impact....im told it's the language of how they ask the questions...is it true that if you give full-disclosure that the recorded tape can be used to play a yes/no but not the full explanation? Also, They are suggesting that a period of overpayment in IS as they have not counted maintenance payments in 2008?.....Is this decision based on the new rules or the old rules? as I thought as of last year the law changed and april 2010- saying it does not affect your benefit entitilement. I did tell them about it, but how do I proove a phonecall. Im now thinking im may end up with an overpayment of 3K! If this were to happen would this affect my current request to move meaning would this OP go on my current rent account making me in arrears?

I guess I was lucky that I had a solicitor to go in with..so today they had no evidence off me whatsoever, although i found out that they have bank statements and informant statements , luckily I have bided myself a bit of time...for now...( god it feels like im doing something wrong even though Im NOT!! I was hoping for it all to be done and dusted but now I have to wait until another appointment is re-arranged. Im hoping that " Flumps, Jadeybags, Nystagmite" may be able to advise me on my next step in regards to the No comment, prepared statement or full disclosure with regards to the next IUC date? I hope your appeal goes well, do you have a soliciter now? and what do they expect you to live on meanwhile....does that mean housing benefit and council tax benefit too? I hope not! Are you entitled to anything/ help from anywhere? how are you paying your bills? Im so worried for both of us!
  11. I went for my IUC today, as was sent a letter saying I had a partner, LTAHAW ! It's not true. Managed to get a soliciter after reading your post. The soliciter went in to see what evidence they were prepared to disclose..they had a joint bank account, my single account and my ex ex partner's bank account. there were transactions that totalled about 3k over 4 years, also they had told my soliciter that they had informant statements, ( did not show them) and then they confirmed that they had no videos, photo's or have they watched my property...if they had they would see it not true. my ex was invited but did not turn up! he supplied me with letter confirming his alternative addresses during the last 4 years, inc his curent where he pays his own bills. now, they are implying that the £80 was not declared...now i know that I called inland revenue at the time. So based on this evidence, my soliciter is suggesting that i do not furnish them with any evidence yet, has posponed the interview in hope to rearrange. he said that I could say No comment, give a prepared statement, or full disclosure? I really do not want an overpayment, rules on Maintenance have now changed and are a private aggreement? My ex partner left me in alot of debt,,overdraft on joint bank account etc...but is there a way out of this? help lol

Update: Went to the Jobcentre, they interviewer tried to get me in asap...without my soliciter. solicitor went in there to find out what information that they had...which was joint bank statement, my ex's bank statements and the equivalent of 3k going into my single account from his account. (which was declared) ..but they are using that to class as as LTAHAW. They also confirmed that they had no photos, videos...but did have a informant statements...that's all they were willing to disclose to my solicitor. we went into the room to discuss everything while interviewer went out. next thing I know is that the lady interviewer said times up we need to start. they had other things in a folder...not sure what. Soliciter is saying there are three approaches to use at interview....No comment- then they have to ask away all the questions and proove he lives at my home( which he doesnt) , A prepared statement , which is...answering the allegation on tape and soliciter reads it out, and then there is full disclosure ...which is they ask what they like and I have to answer all the questions. He is basically saying that I should do a prepared statement which gives them the answers to the accusation of LTAHAW but nothing else. A new appointment is to be arranged withing the next couple of weeks..meanwhile I need to gain bank statements and income details etc.... What do you think I should do?

  14. Thanks hun, i'll update you all tommorrow afternoon after my interview! I did not realise you get the head's up before you go in if you have a solicitor...that's good as I have brief and detailed statements to back up my case...so he can decide what he wants to use/not use! My bf has printed off a years worth of his phone statements showing that we communicate everyday too, so that should help....my hands aching as im 80 % of it...which surely will help towards the face they are trying to class me and my ex as LTAHAW! Thanks for your advice people, speak tommorrow xx

Well, tommorrow is my IUC, Im crapping myself ..even though i do not feel I have done anything wrong! my ex who was invited aswell is not going to turn up...I spoke with my solicitor and he says it would be better and as it's me who is claiming benefits and is interviewed first...if he dont turn up then actually he would be doing me a huge favour. I am bringing a letter from his landlord comfirming that he does live at his address and proof of his rent payments etc....hopefully that will help? Im a little sceptic as although i have spoken to solicitor briefly on the telephone ,..he says he will meet me there half an hour before and not to hand in any paperwork that I have gained. Does anyone know what questions they will ask? if it's LTAHAW is the accusation....I just want to be prepared for the interview as Im struggling to see what else I can bring in to gove them to help with my case.

  18. the fact that you are having your partner staying 3-4 days a week is alot, that also you say you are still in a relationship, and he contributes to the household bills...I feel is different to the situation I am in although, their are simularities. I think that you definately would be classed as living together. I would personally see a solicitor. Where does your partner live most of the time? does he pay his own rent and council tax and bills, can he proove this? The fact that you are still 'a couple' says it all! good luck with your IUC.

  22. I have just looked and the nearest mailbox is half an hour away from my address.I shall contact him tommorrow and say Im going to send it to a personal mailbox if he does not change addresses etc.
  23. If it was me Id accept the fine and just pay especially if I was unclear of what may happen in the sense that you could incurr more charges. Everyone has clearly had different esperiences with this company, so for the sake of a hundred quid...you may aswell pay it! If you go the other way, the amount of grief and stress, letter writing, solicitors and incurred cost...is it cost effective or worth the risk?

I have had several debt collectors and companies when he has not been making payments on time and recently his bank, i do tell them that he does not live here and provide his mobile number. post still gets sent here despite that fact. i have tried to call and speak to people but they will not speak to me as its data protection act and he would need to call himself. Mailbox..I have not heard of that? Any body know how as that would be a better solution? I will then suggest that to him by phone tommorrow.
