    • Evening all looking for bit of advice again , currently doing my own debt management , but think may have burgered up on 1 of the creditors (creation loan) had got sold to Intrum around nov 23 , it never went to default ( I thought it did  , now checking credit file , intrum is there and says 1 missed payment and doesnt say account defaulted can i let that go and intrum will default it? hope that makes sense what i have said

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi There,

 

I am about to make a claim against London Mortgage Co.

 

I was 'sold' a ppi policy for a £35k loan at a cost of £4200 which of course was added at the start of the loan in October 2004.

 

I repaid the loan in full in January 2006 and they charged me £1814 prepayment penalty but made no mention of refunding the ppi.

 

I am also self employed.

 

I paid them £518 for 15 months and still ended up owing them more than I borrowed at the end of it!!

 

I assume I add all of this info to my initial claim letter??:-)

Hi I have just received a letter from LLoyds Insurance agreeing to refund 3 PPI's. Two of them were with loans that are settled in 2004. One having been added to an 'new loan' and consolidated. I had small refund on that one. They have offered to refund plus interest. I have no problem with this. However, I still have a loan with them for £4015.73. I have been paying this since 2004 and they say I still owe over £3,000. The loan was 5 years. Off course the PPI was a single payment policy. They have agreed to refund the PPI plus interest. My problem is that they have stipulated that they pay this refund into my loan account. This loan is unenforeable. I have requested a copy of the loan agreement and they have not and the enforcement date expired in early July. Has anyone any advice on how to proceed. I would be very grateful.:confused:

Remember one thing - It's your money!

 

Insist that the refund is issued in the form of a cheque made out in your name, or paid direct in to a bank of your choice.

 

If they refuse, I would remind them that FOS might have something to say about their underhand tactics.

 

WRT the existing Loan. No valid Credit agreement - no enforceable debt. I would suggest starting your own thread in - http://www.consumeractiongroup.co.uk/forum/general-debt/

I've jus started trying to reclaim my PPI from LTSB and was hoping for some tips, so far they have offered me reduced amount with interest, but I cant seem to get them to clear how much interest will be added:mad:, mainly if it includes the interest on the whole sum from the start date of the loan, they are also insisting the payment is deducted from my loan:mad:, where as i want the money in my current account, has anyone got any ideas that can help!!!!!!!:?

Start a thread in the ppi forum, so people can see your story and help:D

 

It will not be seen on this thread. Your best bet is to read around other threads and you will learn this process, which is never easy. The main thing you need is persistance and determination.

 

As for the paying inot your loan account. All they are doing is taking from you and paying it back to themselves.:mad:

 

I would insist that it is money they should never of had in the first place, I would also claim the premium and interest applied and add on the interest at their contractual rate for the length of time they had it. End of:D

Hi All,

sorry to jump in your thread but would welcome some advice.

 

My Sis in Law had "Credit Card Repayments Insurance-Including Insurance premium Tax" which later changed its name to "Credit Card Repayments Cover"

 

Is this the same as PPI and if so, is it reclaimable if she was missold the cover?

Hello all. I've got T & C from HFC (2001) which states that self employment is covered as long as you're working 16 hours or more. The most I can work is 10 and a half (thats a 7 day week. I'm an enteratainer dontcha know:cool:. But a days work is contracted at 2 x 45 minute spots). So do I have grounds to claim?

Thanks for the information - am already to start my claim based on the fact that i was told it was absolutely compulsory to take the insurance at the point of the finance.

 

in fact I have 2 claims one for DFS (finance co Black Horse) and the other is for Citi card.

 

My questions are:

 

  • Do I claim against Black Horse or DFS given that DFS are the sellers of the policy?
  • I do not have the commencement dates of the DFS policy do I need the credit agreement? and if so how much is it?
  • In terms of Citi card the original card was taken out with the Associates which then were bought by Citi or became Citi not sure which, but can I only claim bank 6 years? I have the statements going back 6 years and there is still a carried forward balance of 5K.
  • Do I calculate the interest based on the bank charge scenario? and are they only obliged to give the interest back if enforced?

and finally has any one had any experience of either company?

Sorry if this has been asked but should a single premium ppi be cancelled automatically by the lender if the loan is defaulted.

Nice to see you over here,:D I can't recall anybody asking that question and I am not 100% sure. I would image the answer is yes, but in my experience I found one company did automatically cancelled the ppi on the default of the loan and took the rebate for themselves. Another ran for a year after they defaulted the loan, till I found out and then I insisted It was cancelled.:|

 

Did you ever receive any terms and conditions relating to the ppi. I never did as many others never did.:eek:

 

Are you looking into reclaiming back your ppi? If so good luck.:D
