  1. Hi everyone, I have been away for sometime now but I am back and ready to continue with my struggle to get what is rightfully mine. The last mail I received from Halifax advised that as a result of the pending test case they cannot and will not doing anything with regards to my claim for charges which total over £6000 excluding interest charged. I must confess their letter has bothered and confused me. Please I need help on what to do next and also since the amount I am claiming is over the limit handled by the small claims court, what other options can I follow?
  2. Hi everyone its Joemarket again. I am still having problems reclaiming my PPI from Capital One. So far I have received a letter plus a copy of what seems to look like their current terms and conditions guiding the issue of credit cards. This is in response to the CCA (which indicates my acceptance to take out PPI on my credit card) request I made in July 2007. They have stopped deductions of PPI from my account not with my concent. I am not sure what to do next. Can I go to the court to reclaim monies that has been wrongfully taken from me?
  3. Hi everyone, I have a CCJ registered against me in 2005 after I failed to keep up payment on a car loan - financial pains.... The car was repossessed and sold at auction at a reduced amount .....but still owed the finance company huge amount. The loan amount included PPI premium which I now know was mis-sold to me at the time my car loan application. The debt was bought over by another company to whom I have been ordered by the court to a set amount until the loan is paid off. Sorry for my never ending story. My questions are; to whom should I send a CCA letter to?, whom can I claim my mis-sold PPI premium from? if I succeed in claiming my PPI back based on a mis-sold can I get my car loan company to remove the CCJ as I have always disputed the amount owed? Please urgent help needed to help me solve this.

  5. Hi Please can any one help as I am totally confused about how to claim back my ppi from Capital One card. I had found out about ppi payments on my card account when I requested and obtained my statement from Capital One. They accept there is no signed agreement but claimed it was sold to me over the phone when I took out the card with them. My question are; without a credit agreement, can this be legal binding? Any help/advice will be much appreciated
  6. Hi all you wonderful people! It all started when I learnt I could claim back my charges from CAG website. Phoned up Capital one to request statement of charges. Thanks to their "efficient" I got my request within 5 days. Scanning through my statements I discovered with shock to note the numerous payments debited from my account re- Payment Protection Insurance. No wonder my monthly payment was high. Quickly! I calculated charges for late payment, overlimit charges and a total of £723 had been deducted for PPI payments. But I can't remember signing up for a ppi. Credit limit £600! Sent out a preliminary letter for refund for charges and ppi. Got an offer for part refund of charges (£394 - refund requested was £1,164 excluding interest). Oh! the Financial Ombusman recommended £12 for late credit card payment is their reason plus their good gesture. PPI refund? no I had taken up the insurance over the phone. Over the phone? I cannot remember taking up such financial responsibility just over the phone. Can I claim my money back? where do I start the game. Their "advise go to the ombusman if you wish". Urgent help pls.
  7. Hi Jo Thanks its good to know someone is listening. So far I have sent 2 letters and have received 2 replies. S.A.R. letteer and the preliminary letter to request repayment of charges and their reply of "additional work".
  8. Hi Everyone, Help Please! I received a letter from Halifax basically saying I quote "We apply these charges because when customers have insufficient funds in their account to cover a payment they ask us to make, this means additional work for us". I can't believe it cost £39 to inform me of a failed direct These charges has totalled over £6000 in the last 6years. No wonder I am always so broke - making monthly contribution to Halifax Plc. To the point! I am now at this stage but do not know what the next step is. I want to go all out to grab bank my money.

Sorry to be bothering you all but I have just received a letter from Halifax rejecting my claims for the monies ( just over £6000) they took from my account in the last six years. To them the monies are in proportion to the work/cost of administering charges to my account. I don't believe them so I have decided to fight for my money. But I need help as to what I have to do next. The rejection letter came in just 6 of the 14 days I had given them. Please urgent help required.
  10. hi there everyone, I have just received a letter from capital one rejecting my request for a refund of my ppi. I just received my six year statments capital one when I noticed the monies debited from my account for ppi payment. since I could not recall purchasing a ppi I wrote and requested a copy of my original credit agreement. They cannot provide such agreement as the ppi was sold over the phone. I wonder if this is legal. Capital bank has directed I could write to FSA if am not satisfied. I am not sure what to do next. Please can anyone help!
  11. Thanks a million times for hints I received from this site towards reclaimimg my ppi from Blackhorse. I had taken up a loan with them for £20000 in July 2005 plus a £9000 ppi as a strict condition to having my loan approved. I did tell them even in writing that I did not require a ppi. The laon plus ppi was paid back in full in January 2007. Anyway from advise receive after I joined this site I wrote a letter requesting full payment of my ppi. I am very excited as today I got a phone call from blackhorse promising to pay back my ppi within two weeks - just can't wait to see how far their verbal promise will go. I am not sure what the next step will be but I plan to go all the way with them should they fail. I have letters to show my various attempt to cancell the ppi two weeks into the life of my loan agreement with them. Fingers cross and thank you every one. With Halifax I still await my statement from them.
  12. Hi everyone, Still waiting to receive my 6 years statment from Halifax but cant wait to read the latest on Tom Brennan's case. The preliminary hearing was on the 21st of May 2007. Any news on this yet? please help.
  13. Can anyone please help! I took up a £20,000 secured loan with Blackhorse Finance in 2005. I was also sold a PPI even though I had made it clear I did not need the insurance protection. Anyway, I had 30 days to cancel if I wanted he adviced me. Couple of weeks into my secured loan I sent a letter to Blackhorse Finance to cancel the PPI. This was followed by a phone call to my "Account Manager" who confimed the receipt of my mailed - my account will be adjusted he promised. I made two payments (including PPI installments but refused to make further payment as no adjustment had been made to my monthly instalment. As a result I received a defualt order and a threat to lose my house if payment was not received. Made full loan payment in January 2007 including PPI. Can I still reclaim my money? How please help!
  14. Thanks Vebb you have just made my day with your bank charges win over halifax. I thought with the court ruling last week banks will take courage and stop paying out. I am a customer with halifax and have had 100s deducted from my account every month on bank charges. I applied for my statement but have been told to wait for 40 days plus nights! I still have hope.
