    • 2 foot of sea level rise   The Thwaites Glacier — dubbed the “Doomsday” glacier because of the grave impacts for global sea level rise if it melts — is breaking down “much faster” than expected, according to a peer-reviewed study published on Monday in the academic journal, Proceedings of the National Academy of Sciences. Using satellite imagery, scientists determined that widespread contact between the glacier and warm ocean water is speeding up the melting process. The climate crisis is interrupting natural processes across large parts of the continent, according to the Antarctic and Southern Ocean Coalition. The glacier, roughly the size of the United Kingdom, could cause global sea levels to rise more than two feet if it melts completely, according to the study. “Thwaites is the most unstable place in the Antarctic and contains the equivalent of 60 centimeters of sea level rise,” study co-author Christine Dow said in a statement. “The worry is that we are underestimating the speed that the glacier is changing, which would be devastating for coastal communities around the world,” she continued.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

YAY, we seem to have hit their achilles tendon with this one, they were so adamant they could 'freeze bank accounts just like that and you could do nothing' that we can quote this case if anyone else has had the misfortune to roll over and let them take the proverbial....

 

Don't forget to ask about interest on the frozen funds.

 

Perhaps somebody could also have words with the court to 'review' all HFO cases over the last 18 months for the same error.

Glad to see that the victory fever has flourished throughout the ranks !! So I am reliably informed by "A", Barty Boys face in Court was one of total disbelief. They thought that they had it in the bag. Lets hope that the Learned District Judge at WCC who has clearly seen through this mob will take steps to ensure that common sense prevails at least at Wandsworth. I am also reliably informed that HFO are putting through FCO's by the boxfull, and further informed that when they take cases into Wandsworth, it is by the bundles. Sadly, some of these innocent folk are not finding thier way here, and are just in fact paying up and shutting up, much to HFO's delight. Well Barty Boy, it looks like Christmas is cancelled for you - no cut of the prize ! I am convinced that we now know who BB actually is within thier outfit !!

I cannot see how they can come back, their only option would be to admit an error, otherwise they would be admiting to something else.

 

I actually hope they don,t discontinue.

ive written to wandsworth asking them for information concerning any Prosecutions entered by Barts Mob, to date they have not replied ,so i think i will follow it up with another letter this time to the justice dept and ask if they have any input to these unlawful court hearings ...see what turns up

Patrickq would also be interesting to find out how many HFO cases are won by default.

 

As Sillygirl says its time we looked at getting ALL HFO's cases pulled and reviewed - based on the known fact that they are producing dodgy documents as evidence in a Court - as procedure.

They are also issueing claims with an added 12% interest refering to terms & conditions - when in fact this is never the case. Another abuse of the Law.

 

As evidence was provided yesterday as to the amount of HFO claims going through the system it is clear that those who find this site - and gain help - are just one bag of ice cubes on top of a freezer cabinet full.

 

While the good work goes on here to help those that find this site we must also begin to focus much more in other directions too.

 

It's time to turn off the freezer.
