  1. Yes - I am not sure of the rules, I think they would have to bring a new Claim but TM didn't own your alleged debt did they? I would still complain, address to TM, and ask why you are receiving nasty emails from someone you have never heard of? Then go to FOS unless you get a satisfactory response. Still worth complaining particularly to FCA - this lot are looking very suspicious. MotorMile are another Payday loan buyer recently sanctioned by FCA for some dubious practices, suspect we have another one. The more notification FCA get of odd behaviour from a particular address - the more likely they are to investigate.

Ist Stop Recoveries Ltd of Unit 16, Thompson Rd, Whitehills, Business Park, Blackpool FY4 5PN changed their name to Clear Recoveries in May 2016 telephone 01253 603951 (the Legal one ends 55) they are part of Clear Companies Group registered at Unit 16 also. You must report to FCA immediately, this is a standard email which is probably used widely by these clowns. FOS will only take a complaint after you have sent a letter to the company and waited 8 weeks. I would write to Clear Companies Group and point out out that action was started by !st Stop but you have now been contacted by TM (same address) and threatened Send by Recorded post if possible and attach copy of email. Be careful as your case was struck out not discontinued but they did not try and challenge it at the time, not sure if they can start again, others will know. They are unlikely to reply, they don't seem to like letters. Keep copy of letter and email.

  5. Yes Unit 16 is Ist Stop now Clear Recoveries - I got the same email but from 1st Stop - they don't use solicitors. Who is the sender?
  6. Please check who the email is from. I imagine that 1st Stop/Clear Recoveries still hold the debt and are at the bottom of this unless they have sold it on (which they should have told you about). It is 'misrepresentation' I got one of these and I imagine a lot of others have when there is no CCJ. Phone FCA immediately on 0800 111 6768 and report them - if they get enough complaints they will take action. There are some issues over Clear Recoveries license also. Write a letter of Complaint to the sender, if no reply wait 8 weeks then report to FOS 0800 023 4567.

I feel that I have to post this as I am being harassed by this crew and so are others on this forum, I appreciate your help: Name of the Claimant ? 1st Stop Credit Recoveries Ltd Date of issue – 22nd Feb 2016 I believe that defence needs to be submitted by 25th march by 4pm - note new date - dx What is the claim for – 1. 1st Stop Recoveries Ltd claim this amount in respect of an unpaid loan funded by Uncle Buck Ltd. The defendant failed to abide by the terms of the contract. 1st Stop Recoveries purchased this debt from Uncle Buck and subsequently sent a notice of assignment of assignment to advise. 2.The defendant has failed to respond to any correspondence or Communication from the claimant thus denying the Claimant any opportunity in assisting the Defendant in attempting to bring the matter to an amicable conclusion. What is the value of the claim? £902 plus fees Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? Payday loan When did you enter into the original agreement before or after 2007? After Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. 1st Stop Credit Were you aware the account had been assigned – did you receive a Notice of Assignment? No Did you receive a Default Notice from the original creditor? No Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments? October 2014 I could not afford it and was advised by an advice worker for my landlord (council housing) to cease payment due to rent difficulties What was the date of your last payment? None but 5 previous loans replayed to this lender Was there a dispute with the original creditor that remains unresolved? Not sure, I am making a claim as the lending was not properly assessed. Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? Yes, the response was to repay and they would relend on the next day. If you have not already done so – send a CCA Request to the claimant for a copy of your agreement - Done Send a CPR31.14 request to the solicitor named on the claim form for copies of documents mentioned/implied within the claim form. There are two different versions - one for Loans/Credit cards the other for Current accounts- Done to claimant, no solicitors

Hi Guys I am in the same situation as you Bailey, so sorry to admit this folks but got in a bad situation with Uncle Bucks in late 2014 culminating in one I could not pay and 1st Stop Recoveries have also now sent me a Court Claim which I am also defending. I have sent CPR and CCA requests and will defend this plus submitting a claim to Uncle bucks regarding the facts that they did not carry out full affordability or credit checks.also allowed me 5 loans over 5 months. When I rang them in month 4 to try and decrease the payments, they suggested I just repay the loan and take another one out the same day! Is this familiar.Have you had a series of loans from them? Actually, in my years on CAG it is very rare for Payday Lenders to take Legal Action, they normally just harass people. Anything else I can to do to help on this Bailey, I will do

  11. Hi Are you still making payments on this Lemon to anyone? If so stop now And is the outstanding amount about £400 or £800? Personally I think that you have paid and suffered enough - don't send anything to Link as they have no information to enable them to claim this money from you, they have just bought a 'debt'. They are unlikely to take legal action and if they did this would be easy to defend as you can take it back to the original court Did you previous send a SAR to anyone? I really also think that you need to send a PPI claim to Welcome as you say that you did claim on this and were refused - therefore there must be a reason why PPI was not appropriate. Welcome do exist and you can claim PPI payments from them ( they are one of the worst offenders). You do no not need a lot of information - just the account number and your details, no documents required and this is money for you, it will not be taken off this dodgy debt. Also please collect any documents on this claim and send to [email protected] of the FCA who is comiling information on Turnbull and co
