    • ae - i have no funds to appoint lawyers.   My point about most caggers getting lost is simply due to so many layers of legal issues that is bound to confuse.  
    • Lenders have a legal obligation to sell the property for the best price they can get. If they feel the offer is low they won't sell it, because it's likely the borrower will say the same.   Yes.  But every interested buyer was offering within a range - based on local market sales evidence.  Shelter site says a lender is not allowed to wait for the market to improve. Why serve a dilapidations notice? If it's in the terms of the lease to maintain the property to a good standard, then serve an S146 notice instead as it's a clear breach of the lease.   The dilapidations notice was a legal first step.  Freeholders have to give time to leaseholders to remedy.  Lender lawyers advised the property was going to be sold and the new buyer would undertake the work.  Their missive came shortly before contracts were given to buyer.  The buyer lawyer and freehold lawyers were then in contact.  The issue of dilapidations remedy was discussed..  But then lender reneged.  There was a few months where neither I nor freeholders were sure what was going on.  Then suddenly demolition works started.   Before one issues a s146 one has to issue a LBA.  That is eventually what happened. ...legal battle took 3y to resolve. Again, order them to revert it as they didn't have permission to do the works, or else serve an S146 notice for breach of the lease   A s146 was served.  It took 3y but the parties came to a settlement.   (They couldn't revert as they had ripped out irreplaceable historical features). The lease has already been extended once so they have no right to another extension. It seems pretty easy to just get the lawyer to say no and stick by those terms as the law is on your side there.  That's not the case   One can ask for another extension.  In this instance the freeholders eventually agreed with a proviso for the receiver not to serve another. You wouldn't vary a lease through a lease extension.  Correct.  But receiver lawyer was an idiot.   He made so many errors.  No idea why the receiver instructed him?  He used to work for lender lawyers. I belatedly discovered he was sacked for dishonesty and fined a huge sum by the sra  (though kept his licence).  He eventually joined another firm and the receiver bizarrely chose him to handle the extension.  Again he messed up - which is why the matter still hasn't been properly concluded.   In reality, its quite clear the lender/ receiver were just trying to overwhelm me with work (and costs) due to so many legal  issues.  Also they tried to twist things (as lawyers sometimes do).  They tried to create a situation where the freeholders would get a wasted costs order - the intent was to bankrupt the freeholders so they could grab the fh that way.   That didn't happen.  They are still trying though.  They owe the freeholders legal costs (s60) and are refusing to pay.  They are trying to get the freeholders to refer the matter to the tribunal - simply to incur more costs (the freeholders don't want and cant's afford to incur)  Enfranchisement isn't something that can be "voided", it's in the Leasehold Reform Act 1967 that leaseholders have the right to.... The property does not qualify under 67 Act.  Their notice was invalid and voided. B petition was struck out. So this is dealt with then.  That action was dealt with yes.   But they then issued a new claim out of a different random court - which I'm still dealing with alone.  This is where I have issues with my old lawyer. He failed to read important legal docs  (which I kept emailing and asking if he was dealing with) and  also didn't deal with something crucial I pointed out.  This lawyer had the lender in a corner and he did not act. Evidence shows lender and receiver strategy had been ....  Redact and scan said evidence up for others to look at?   I could.  But the evidence is clear cut.  Receiver email to lender and lender lawyer: "our strategy for many months  has been for ceo to get the property".  A lender is not allowed to influence the receivership.   They clearly were.  And the law firm were complicit.  The same firm representing the lender and the ceo in his personal capacity - conflict of interest?   I  also have evidence of the lender trying to pay a buyer to walk.  I was never supposed to know about this.  But I was given copies of messages from the receiver "I need to see you face to face, these things are best not put in writing".  No need to divulge all here.  But in hindsight it's clear the lender/ receiver tried - via 2 meetings - to get rid of this buyer (pay large £s) to clear the path for the ceo.   One thing I need to clarify - if a receiver tells a lender to do - or not to do - something should the lender comply? 
    • Why ask for advice if you think it's too complex for the forum members to understand? You'd be better engaging a lawyer. Make sure he has understood all the implications. Stick with his advice. If it doesn't conform to your preconceived opinion then pause and consider whether maybe he's right.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anyone on here ever registered for the above online service which is supposed to give you access to your credit report online. If so have you been successful in viewing the report? This service is charged at £5.99 per month (it's only £2 to get your report through the post) and I have registed twice and just get a "sorry this service is currentl unavailable" screen so I suggest if you're tempted - Don't. I have e-mailed the customer service department asking for a refund. I'll let post progress reports

good luck with that - i paid £2 four times and still didnt get the report!

 

called up and asked for a refund and got no responce, did get one copy of my file tho!...i cant be bothered to fight with them over £8

Oh! Thank goodness you posted this! I have had the same problem, but not with just Experian, but Equifax too!!!!!!!

I am unable to find a 'cancel subscription' for Experian, and i just coughed up 5.99 for it. Not a happy bunny!

 

Not only that, but with Equifax (who I tried after the problems with Experian) ask you lots of personal details about your debts, to verify who you are, and I answered them all, and it all went through ok, then they tell me this service isnt avaliable! AFTER taking all my personal details, my credit details, allsorts!

 

I am NOT HAPPY. AllI wanted to do was to view my credit report! How do I get my money refunded from Experian?

I have used both sites and not had a problem.. You do get the service unavailable message after a certain time of night but otherwise i have had no probs.

5th Jul 06 - Prelim sent to Halifax

20th Jul 06 - LBA sent (no response)

7th Aug 06 - Offer of £297 recieved. (declined offer)

10th Aug 06-revised date to submit moneyclaim (financial constraints prevented this action)

1st Sep 06 - Moneyclaim filed and issued

1st Sep 06 - recieved 2nd offer of £892 (after claim submitted)

5th Sept 06 - moneyclaim Acknowledged online

Thanks for that but I hve tried numerous times during the day too, I will try again a few times and see what happens.

 

If I don't have any luck, think I'll put this one to the OFT bacause while we are all aware of dodgy websites taking money for nothing, I think these companies should be above that!

What are they telling you is "not available" If you mean your credit file that's rubbish. Demand it again (without giving the jobsworth on the other end of the phone your details AGAIN, your not asking for any details your giving them) Failing that tell them you will be sending them a SAR to include details of your latest communications with them, plus a DPA notice to cease using your data.

Thanks for the info, this is an online service it's telling me that the service is temporarily unavailable - not my report. I have just tried again and still the same, may have to try within office hours but it will be Thursday before I can do that!

There online service says it is unavailable if they are unable to verify your details or you forget your password 3 times or other anomolies, so give them a call tomorrow.

Hiya - yep this happened to me. Could access it the first time when I registered but not after that. And they continuied to charge my card despaite me emailing them.

 

I complained and moaned etc. Got a refund.

 

And just to annoy them - I used the free service agin in a couple months this time I printed out a copy of my report for my records.

Yup they aren't a lot better than the companies they serve & THESE people can affect all our lives...........Dam disgrace I say

 

The Regulator should put them to a much higher standard but doesn't. They let them get away with murder & I wonder why!

Like most of these companies they don't know anything, least of all all the legislation they are supposed to adhere to.

 

I am just about to take Experian through the small claims for refusing to correct mty credit file even though I've given them all the evidence. Its quite a serious data error too so I might just go for defamation too.

Hi all just to confirm having spoken to customer services to cancel my membership that this site has been having teething problems :o 2 years worth it is also being updated.

As far as I am concerned their site was designed to rip people of, they have achieved this by making it very very difficult to navigate around and trapping people into the membership, I do IT for a living so know how to navigate around websites and it is only because of this that I could even find the login screen LOL or find out how to cancel. If you want to cancel contact them on 0800 6569000. There is also the credit score page at no point does it give you the option of unticking the pay a further £5.95 box on this page complete rip off site

If you send £2 by post and ask for a credit listing they do not get a chance to ask all sorts of questions, e.g. your emailid, what you had for breakfast. I suspect the online (allegedly for free) Experian report is a carot dangled in front of consumers, primarily to pry more personal info out of them.

 

Be assured the info anybody gives them will be encoded onto their database and kept there for goodness knows how long. Has anyone had experience of being sent harassment emails, after he or she innocently gavie his emailid to Experian/Equifax?

This reminds me of a story.

 

A criminal was on the run in USA and the police couldn't find him in the vastness of the continent. But they knew he was a keen Boy George fan, so the police advertised nationwide offering free tickets, to be sent to anyone who wanted to attend Boy George's concert in person. The fugitie took the bait, and was hooked and hauled in.

 

So do not respond to free tickets, or free Experian.

 

Boy George thought it was not complimentary to him that "4 out of 5 criminals like Boy George".

Although if trying to access the service between midnight and 01:00 then you get the error that the service is unavailable, other than that no problems at all...

Also don't respond to free surveys which offer a little bonus at the end

 

Also be very careful if completing an online application to borrow money especially if it's one that boasts they can get you a loan no matter what your credit record

 

Some of these firms/brokers are not what they appear to be...& you'll never get loan

I have been trying to cancel my membership for 2 weeks. Tried emailing and was told I had to call. So I telephoned the number given and I cannot get through at all. So I have told them it they do not cancel my account I will get a solicitor to do it for me. I have tried calling at different times on different days for the last 2 weeks and no one answers the telephone. The emails they send just keep giving me the same number so I am unable to cancel my account and they are going to keep taking £5.99 (or so they think)!!!

Abbey - £539 pending - !!!WON!!!

Halifax - £676 pending - stayed at court

2nd Claim with Halifax - £168 pending

Lloyds TSB - £780 (sisters) !!!WON!!! - Filed waste of costs order (on hold)

Barclays - Barclays filed crap defense - on hold

 

AND THE BANKS ARE STILL CHARGING!!!!!!!

 

How very dare you!!

I used Experian online about 2 years ago. I had a quick look round to see if anyone else was cheaper but decided to go ahead with the report. At the time, it was £5.99 to view my credit report and then there was a further report which was available for something like £8.00. I don't think I chose to do that.

I only wanted to view the report once and so no reason for me to carry on with my subscription.

 

I did have to phone the number that was online and speak to a rep - and they were willing enough to cancel the membership.

 

I had no issues with them. But as i said, it was roughly 2 years ago.
