Hi All,

i have an outstanding debt with cahoot which has been passed to these. i pay £25 per month, this month i must have underpaid by £5. Last night i got a call from apex saying santander were after legal action over £5. They wanted me to do inc/exp over the phone and were unhappy when i refused. Something stinks about this threamt, think they are just after an increase, don't have a problem with that just object to being threatened.

any opinions much appreciated as usual.

Tell them to sling their hook if they ring again, just laugh and put the phone down.

Your right not to give them such personal and confidential info as your I&E, not only over the phone but in any form, they are not legally qualified or suitably trained to ask for such information.

So what you underpaid by £5 whoopy doo daa, I wouldn't be paying them £25 a month anyway, they'd be lucky to get £5, and only then after I had made certain they were legally allowed to collect.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

yea sounds like the usual we want more con.

i'd make sure they have a valid cca

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Good advice already given. They would look pretty foolish in front of a Judge when you are making payments, it is up to you how much you pay, and a Judge would almost certainly consider such action and waste of Court time and could come down on them pretty heavily. Threats is all they are. Please make sure though that they have the right to collect this money, as BB say, can we assume you have gone down the CCA route?
