    • Yep let us have a good laugh eh from today’s Telegraph 🤣😂🤣 the rest must try harder    Farage won Friday’s election debate, a poll finds Nigel Farage won Friday night’s seven-way BBC election debate, according to a poll.  A snap poll of 1,031 voters by More in Common found most thought Mr Farage won the debate, followed by Angela Rayner. Mr Farage received 25 per cent of the vote while Ms Rayner received 19 per cent. The Green Party’s Carla Denyer was the third most popular with 11 per cent, Stephen Flynn for SNP received 10 per cent and Penny Mordaunt, the leader of the House of Commons, took 7 per cent of the vote. Daisy Cooper, the deputy leader of the Liberal Democrats and Plaid Cymru’s Rhun ap Iorwerth took 5 per cent and 2  per cent respectively. The debate saw Britain’s main seven political parties clash ahead of the general election on July 4.  Mr Farage, who returned to frontline politics for Reform this week and is standing as an MP in Clacton, challenged his political rivals on immigration and net zero policies.
    • Hi CAG Team, I'm seeking your skills and help for a NtK my partner received through the post earlier this week. To give a little backstory, my partner and I, along with our young children (4 and 7), decided to go on a camping holiday about 3 hours away from us. We took a car each because we didn't have enough room in one car. We arrived at the services at very similar times as we followed each other the whole way. So, two cars. My partner has received this NtK, but I haven't. This NtK dropped through the front door on Wednesday, June 5, 2024.  We both parked in the Burger King car park, not in BP; we got out, all went for a toilet break, got some food from the BP garage and returned to our cars to eat.  After eating, we took the kids to the toilet again before leaving to complete our journey. I didn't notice any parking restriction signs and can't get back to the location due to how far away it is. I noticed another person had an issue here and reported it to you, and they managed to get the fine dropped. See below. To me, it looks like they have cameras at the complex's entrance and exit. I'm not sure if they own the land/car park by Burger King, so I'm not sure if this is a legal contract or not.  I find that 30 mins limit at a Services that serves hot food to be ridiculous and unfair, especially as we had kids to feed and water.  And the fact that I didn't receive the same NtK despite us driving in and out together is just crazy. This is the location - I also uploaded a map image. Google Maps MAPS.APP.GOO.GL ★★★☆☆ · Restaurant   1 Date of the infringement 24th May 2024   2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 29th May 2024   3 Date received 5th June 2024   4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] N   5 Is there any photographic evidence of the event? Y - Only entering and exiting the complex/land.   6 Have you appealed? [Y/N?] post up your appeal] N   7 Who is the parking company? MET   8. Where exactly [carpark name and town] BP Blue Boys, Tonbridge TN12 7HE   For either option, does it say which appeals body they operate under. POPLA Anyway, I hope you can help me out with some guidance on how to proceed with this. Let me know if you need anything else. • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi zarlak

I get the impression you have to wait until they get the message as they are always unhelpful to start off with. There are some posts on the forum for their head honchos email address a guy called errol damelin, writing to him seems to work sometimes.

Hi

Email your offer to [email protected] Quote your Reference number and give them details of how much you want to repay over what length of time. Tell them that you know of other people who have been sent very generous offers of settlement figures by them and that you are also interest in taking up this offer.

See what they say in reply. They should get back to you in a couple of days.

I also found Wonga quite easy for some reason, at lot easier than some peeps on here.

I kept getting the misssed payments emails so I kept replying with an offer of payment. After getting no response i forwarded the emails to [email protected], [email protected] and [email protected] always saying the same thing :

1. The number of emails I had sent trying to resolve the matter

2. The fact I will not enter into a verbal conversation over the telephone

3. The payment arrangement I was offering, which was over a 12 month period and would only be made by standing order

4. I would not be paying any more than the loan amount and the original amount of interest

5. And a small paragraph regarding how ineffective their customercare department was in helping me in my financial crisis.

After email number 5, in a 5 day period they accepted. I have it all in writing, its on my account on wonga.com and ive not heard anything since. Happy days.

Hi did u had the repayment plan in writing and what did they told u how will u be making payments??

Regards

Yes, I had it written down exactly as you had in your post above. The payments were made via standing order as also agreed in their Payment Arrangement email.

O thats why maybe,

Do you think the money has reached them on time before the deu date.If i had to make a payment on the 15th and the amount leaves my account the 15th it will reach late there. What i have done is i had requested them to change the date to 16th wich they agreed straight away.I have another account wich i rarely use.I gave them the details for that account and as soon i get paid on the 15th i go and put the amount in the other account.

Have a word with them they are from monday to friday there.

I never received a letter or call from them again.

Finally managed to come to an arrangement with Wonga, although it was hard work!

I took Nortel's advice from the post above and insisted I would only pay back the original loan plus one months interest by standing order.

They were looking for £742 from me for a £200 loan but have now agreed to accept the £200 plus £66 interest over 2 months as full settlement of my loan.

Thanks Nortel for your post above - I recommend anyone who is having problems with Wonga takes this approach.

Playing them at the email game giveds you a lot of ammunition, if they send emails saying you have breached your agreement send them a copy of the statement highlighting the payment to them.... simple! You will have proof by the email trail you have tried to come to an agreeement should they dare try the court route.

I just made a payment plan with them to pay off an outstanding debt,I had to phone them as all emails went unanswered, when i asked for the details to be sent to me in writing they refused and said they couldnt do it,

Im just worried that they wont keep there word and take more than what was arranged ,

HiI have made an arrangemement with them but did not give them my card details. I got them to give me their bank account details and have arranged to pay them that way, so that they cannot take money out when they feel like.I actually found these easy to come to an arrangement unlike some of the other payday loans I have recently had to contact in order to make an arrangement.
