    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

    • Yes, it was, but in practice we've found time after time that judges will not rule against PPCs solely on the lack of PP.  They should - but they don't.  We include illegal signage in WSs, but more as a tactic to show the PPC up as spvis rather than in the hope that the judge will act on that one point alone. But sue them for what?  They haven't really done much apart from sending you stupid letters. Breach of GDPR?  It could be argued they knew you had Supremacy of Contact but it's a a long shot. Trespass to your vehicle?  I know someone on the Parking Prankster blog did that but it's one case out of thousands. Surely best to defy them and put the onus on them to sue you.  Make them carry the risk.  And if they finally do - smash them. If you want, I suppose you could have a laugh at the MA's expense.  Tell them about the criminality they have endorsed and give them 24 hours to have your tickets cancelled and have the signs removed - otherwise you will contact the council to start enforcement for breach of planning permission.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

not sure if this is in the right place as im new so sorry if its not!

 

hi people i really need some help and advice.

i have 5 catalogues and have been charged ridiculous amounts of late payment fees over the past 2 years but more to my horror i have been getting charged2 sometimes 3 times a month for

1.late payment fee

2.being in arrears on the account

3.for them sending me a letter stating i owe them money

now to me being charged £12 to send a letter through my door is absolutly ridiulous. i have rang all 5 catalogue companies asking to send me all my statements from all accounts from statement 1 to the present day and have been told its going to cost me £25 to receive this information.

i basically want to know can i recaim these charges and if so how do i go about re claiming them.

if anyone has a link to a form that can be filled out online this would be great.

Once you get your statements, total up the charges and put them on a spread sheet and send a prelim letter to your account holders, asking for your charges back, they will more thank likely fob you off saying their charges are fair ect.

 

Just edit this prelim letter to suit...............Send it recorded delivery.

the reasons for some of their charges is ridiculous and am so not happy but i am not one to leave it so lets hope it goes in my favour.

i have a catalogue with 5 different companies and i applied for the accounts online and did not sign anything.

does anybody know if i have a credit agreement with them or not as i believe i havent due to not digning anything.

 

need to know asap plz

sadly in case you think that will get the debts written off.you've been paying too much attention to the crap these reclaim co's advertise.

 

even if the agreement does not exist or is un-en, it is not some magic bullet that wipes debt out.

 

give us more info and there maybe otherways to help like unlawful fees and mis-sold PPI

i have 5 catalogue companies and am in the process of awaiting a reply from them after i sent a sar letter to them.

 

i have been asked that under the catalogues terms and conditions about the charges was it stated what charges i was going to get.

to be honest i dint read the terms and conditions to do with charges.

i ticked the box online when i opened the account and agreed to the terms and conditions so will this affect me re claiming any charges back as i have been getting charged £36 a month in charges and still feel this is wrong and unfair???

well basically i have been getting charged 2 sometimes 3 times a month on my catalogues these charges have been for

1. missed minimum payment

2. late payment fee

3. debt collection telephone call

4. sending me a letter

5. being in arrears on my account.

 

every month i have rang them and tried to explain that i can only make the payments when i get paid and unfortunalty i get paid after the date they want their payments. i feel being charged £36 a month is absolutly ridiculous and being charged £12 to send a letter through my door is a joke.

 

i have sent them a subject of access letter asking for all my statements i know that i have had one catalogue since 2008 and they can only tell me of charges dating back from 2009 and that has totalled to £144 so god knows what the year before charges were and wht charges total upto on all 5 catalogues.

 

i am awaiting reply from the sar letter i sent them and once they have sent me my statements i think i need to put them on a spread sheet and send them a preliminary letter

 

i need to know though if ticking the terms and agreements box could possibly affect the proces of me aybe claiming these charges back???

i want to get this sorted and try to claim my charges back but im getting nowhere with them what do i do from here?

They legally have 40 days to send you the SAR information. How many days has it been so far? It is good you have the proof they received it, but they are known for dragging it out. Chances are you will soon get a nice bundle in the post. If not there is a letter in the template library you can send them, but for now I'm afraid it is just a waiting game.

My son has five accounts with them and is arrears on them all,he got a letter after making a complaint saying he would not get charges back on any account negating and requirement to send letters requesting charges back, so every time a £12/24/26 gets applied he goes staight to court charging them a further £25 court fee on every charge and 8% court fees, its a good idea as they cant win in court and wont turn up or settle before hearings so the balance will eventually be paid off with the court fees, hes moved to switzerland and will return for any hearing dates so should be hillarious when after the first couple of cases the judges start awarding wasted costs orders against littlewoods.

i have added up all the charges and would like to know where do i go from here?

also i want to know if i am able to claim back any insurance payments and also the monthly interest i was charged on items!

 

any help would be much appreciated.

as for the PPI, yes you can reclaim that too + interest

you cannot reclaim the interest charged on your purchases, [thats how they make their money] but you can reclaim any interest [at their purchase rate] they have charged you on any unlawful charges & on the PPI.

this you calculate on a monthly basis using:

from the date of EACH charge [or monthly ppi payment] to the date of your claim

If you look in the step by step guide in my signature, it will tell you what to do now, also the letters are there. You need to send them the prelim letter and a spread sheet of the charges. All explained in the guide.

hi all,

i have now totalled up all my charges and i need to put them onto a spread sheet but i have not got a clue how to use microsofts spread sheet and cannot seem to find a spread sheet on this site. i have looked in the library but there doesnt seem to be one there. please could some one help me i need to get this sorted as its stressing me out and im in the process of moving!

You just put the charge reason, the amount, and the date you received it.

 

The 8% interest will automatically add for you in the interest column.

The simple spread sheet is the best one to use.
