    • whitelist - the same with mine....the battery had a mind of its own. i bought it for my Son...he'd shut it down and it would be completely off but the power light would either stay on or flash...also it wouldnt start properly, had cmos errors on boot and other stuff.   i bought it through HP store on ebay ..brand new. after 6 days of receipt i recieced an email from HP asking if i was happy...i returned an email saying no and that i want to send it back as it was faulty. after trying to sort it for a couple of months with HP not replying, not offering a solution etc i finally got passed tech support who confirmed it was faulty. i then had to return it to their factory. this is where its gets beyond worse...waited 3 times for parcelforce to collect - they didnt. in the end hp sent me a label which i had to take to the post office - not good as im disabled with mobility disability. then they asked for my bank account number to issue the refund. they hardly ever replied to my emails and it took over a month and a half to refund me once they had received the laptop back. no explanation, no progress emails, no updates. i kept emailing them on a daily basis as no one would reply to my emails through the website, forum, internal email addresses and even phoned 3 different departments who basically had no idea what to do or what was going on. on the forums theres ot customers who've had to wait 6 weeks , 2 months , over 2 months etc...it seems as though HP like to withold peoples money to earn interest on the money in their account. i spents days phoning and emailing them - even sent a recorded letter. at the begining i phoned citizens advice and they said i am entitled to put back into the same financial position as before i lost the out of pocket expenses ie: compensation for my time and recorded letter sent etc. ive started a martin lewis resolver case with them and basically in a snotty reply they told me im not entitled to compensation. i was just wondering if theres any .gov website or law/legislation that i could reply with and say "no your wrong - please compensate me"

    • Hello!  First timer on here, discovered this amazing site and threads on debt issues only yesterday. After never having a bad debt in my life, almost 2.5 years ago I was scammed by my now-ex partner who calculatingly manipulated me into taking out a bounceback loan, 2 personal loans and a credit card.  He took all the money via ruthless deception, every penny, as well as the car (bought with unsecured personal loan) and all my furniture, personal belongings and even most of my clothes as well.  I'd packed up my life to move to another part of the country with him, only to discover he'd scammed me and been clever about it, so he directed the removal truck to a location unknown to me (never saw my stuff again!), and car is registered into someone else's name.  All this happened abroad.  I have won a criminal case against him abroad and he has been given a custodial sentence (which he is appealing while on bail), but it is difficult to get financial reparation so I am left with over £40k of debt to my name in the UK.    I am in my mid-50s, and have no assets whatsoever, I still live abroad (renting) and cannot afford to return to live in the UK due to the debts and decreasing income. It's been devastating and I've been struggling enormously since it happened (Jan 2022).  I have been suicidal at times. I was making combined loan/cc payments of £1300 monthly for over two years, but I'm self-employed (sole trader) and my UK-based small business has suffered 70% loss of income since Oct 2023 due to changes affecting government funding for the market I provide services to.  My income is commission-based, and has reduced to an average of £1200 per month. As I currently live abroad (outside EEU), I am not resident in the UK for tax purposes and haven't been for more than 3 years (my work is done remotely outside the UK, even though my clients are in the UK and payment is received into my UK bank account).  That means I am not entitled to an IVA or bankruptcy options.  My only option in terms of a debt repayment solution is a DMP. I maintain a UK correspondence address (my mother's home) and use this for my bank account, loans, credit cards etc.  I have only informed HSBC (bank acc) and one loan company that I moved abroad and that the UK address is only a correspondence address (been scared of potential consequences of informing them, even though I don't know what they could be or if there would be any). My worst fear is being taken to court, bankruptcy, etc, and my bank account and income being controlled and all surplus income above basic needs being taken etc, when I literally have almost nothing in life at this stage and desperately want to try to rebuild my life somehow and have some normality again.  Perhaps even move back to the UK if I can afford to. I've contacted all my creditors except cc (it's an HSBC card so am concerned it would affect my bank account with them.  I also bank abroad with HSBC and have global-linked accounts with them).  All interest has been stopped on my loans since April (period of 4 months on two loans, 6 months on bounceback loan with Pay As You Grow option agreed).  Continued so far to pay at least minimum payment on HSBC credit card.  I spoke to PayPlan yesterday and they've worked out a DMP paying £289.50 per month for 11 yrs 7 months, with annual reviews - not signed up to it yet, and concerned about customer reviews I've read about them demanding double payments a year or so down the line and not making payments to the creditors for long periods, etc.  Frightens the life out of me trusting them with the limited money I have - I don't want to go out of the frying pan into the fire in terms of stress that could last years, going by some of the horror story reviews. Considering the DIY DMP option, dealing directly with my creditors myself.  But not even sure going down the DMP route is the best option.  What do I gain from doing that? Sounds like I will still end up with an arrears or even a default record on my credit file even with a DMP, and I will be paying money I really need to help me get my life back on track, especially as I don't even have a full state pension entitlement - would be better used to pay missing years into that, surely, if I do have some surplus?  Either way, with or without a DMP, I won't be able to borrow so how would a bad credit score affect me anyway?  Seems like it could be best to allow them to go to default in the hope that it can all be SB-ed after 6 years. At this early stage, I know I will benefit from advice here about what route to go down and pros & cons/risks etc of: a) DMP with PayPlan b) DIY DMP c) Going down the default route in hope of debts being sold to DCA and not paying anything further with result that it is all SB-ed after 6 years. Struggling to pay off the loans for the next 11 years @ £289.50 seems daunting and such a long time, when I really need every penny to restart my life, regain some dignity, restore my mental health etc... I hope someone here help me make the right decision at this point, before I've committed to anything or have paid lots of money for years with little dent into the loans.... Details : HSBC Bounceback Loan (unsecured):  taken Dec 2021, original amount £9000, 2.5%.  Currently owe £4950.  Monthly payment:  £159.  Not missed any payments, but agreed PAYG option in April - full holiday for 6 mths, restart payments at £73.00 in October, term extended to 2030. TSB personal Loan (unsecured) - taken Aug 2021, original amount £23,000, 9.2%.  Monthly payment £475.  Currently owe £14,550.  Missed 2 payments. Interest stopped since April, no payments offered or made.  Situation to be reviewed prior to default - which will be after 4 missed payments). Sainsburys personal Loan (unsecured) - taken Jan 2022, original amount £25,000, 8.6%.  Monthly payment £514.  Currently owe £14000.  Missed 2 payments.  Interest stopped since April, made 1 payment of £50.00 on 7 May (offered to pay £50/month until situation reviewed prior to default - which will be after 4 missed payments). HSBC credit card APR 18.9% - £6900 currently owing, continuing to pay at least minimum payment (£180/month), not contacted them so far. Applied for Starling bank account, as advised by PayPlan to have a separate a/c from my HSBC one as they would have the right to take money from my account to pay off my HSBC cc debt if I stopped paying that. Sorry this is so long and a big thank you for reading down to the end!  I hope the detail helps with advising me on best course of action and possible/likely consequences.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Contacted openreach directly as said prevoulsy and they normally do not talk to people like me, but I replied persistantly basically begging I needed help as both providers are blaming the other. I was given one snipet and have asked them to confirm whihc firm, but that the next works planned on my line are not untill 17/8 and that order is in place and that if I disagreed to get in touch with provider, fair enough.

 

Hang on 17/8. If tesco were sorting my line wed/thurs next week wouldnt openreach have given my a prior date?

 

Is 17/8 a cease order from sky I wondered, but then the openreach person described it as a transfer !!!!! That could only be sky going to tesco as I wanted, but hang on, hang on why not untill that date, its going on and on.

 

I have read the openreach site and llu services extensively during the night, they have certain products such as timescales for repairing errors or sorting faults and these according to them need better adhearing to, but are getting there. Now my line surely if raised as urgen issue when promised would have had times multiplied over to have been sorted by now.

 

Are tesco looking after me really? I dont know. They metioned a week ago about a new line and said normally this could take weeks but they would hurry it along at director level as my case was urgent. Where can I see my case is being treat as urgent?

 

I feel forgive me like I am being fobbed off. Even if their are legal issues relating to prevous takeover it can be shown as incorect in that sky made an error according to tesco, so why would I have to wait for weeks?

Well tesco rang me back as promised again and will get back to me tommorow. Appatanlty sky did take over my whole line and the problem is they wont admit responsibility. They will ring me to let me know if wed/thurs is realistic or not tommorow, but they do seem gehuine in wanting to help me. Does make me wonder what the openreach engineer was doing at the exchange a couple of days after me reporting sky had slammed me to them and tesco, removing sky bits maybe? Just a guess which is probably wrong, but been so tired with theis conspiracy theories are going mad in my head.

 

Ive held on pretty well with this as do have mental problems, but anyone including the tesco rep today said if this had happened to him he would be banging his head.

 

Just keeping fingers crossed that maybe 17/8 is a completion date or similar sort.

 

I tell you if sky come near me again I will make use of a hot rod (gest of course, but makes me chuckle the thought):)

Ofcom now involved :) I have to ring them back wednesday and they will have all the infor relating to my line over last few weeks. They said from the info I gave it sounded like sky, but obviously they had to see for themselves and judge and then let me know how I can come after them.

 

So will have to wait for line to be put in by tesco hopefully the 17/8 was a misconmunication from openreach I do hope. You see if sky admitted fault it would have been easier to send an engineer out and bum bump I would have been back over again, but they wont so needs new line xx

 

Gonna get them for this, cue wicked witch laugh xxxxx

Contacted ofcom 11:06 got a reply from sky 11:26 or thereabouts. Now probably coincidence due to I had sent them an email saying I was going to ofcom. But they have now suddenly ;) realised sky has taken over my line. They say they cancelled the order and that it was done against the wishes of both me and sky, arrr diddums, so they cared that much that they couldnt have seen this a week and a half ago when I was begging for help, nope when I mentioned ofcom.

 

If sky were so sure it was not their fault and the works which obvioulsy refer to openreach done, why would they blame tesco?

Why would then not apologise and say they were doing all the could to rectify the error?

Why would cable and wireless/tesco and openreach come to the conclusion the cease order had not been cancelled?

 

Remeber tesco new to telecoms compared to sky were able in the case of a customer leaving sky for them and then for whatever reason changed mind and cancelled order, able to see later or that a cease order needed cancelling that obvoulsy appread on their, I would guess as a pleb, their openreach account maybe, and so as to not inconviniece the customer they did their job.

 

SKY LET ME DOWN AND PUT ME AT RISK AND THEY KNEW I WAS DESPERATE, THATS WHAT TRULY DISGUSTS ME XX

OK, the the huge things that some silly bankers get (have to run spell check over the word banker... sure there was a W in there somewhere!) but as most telesales staff get a bonus for signing people up, they don't care if they supply the correct package, just the one that gets them the best pay packet!

Sky now email me saying sky is not responsible for their supposed order cancelled being acted on still. Now remember apparantly according to cable and wireless the cease order was still in place and had not been cancelled.

 

Anyhow I have just emailed micheal ritchies office and pointed out that forgive me if I am worng, but sky contract openreach, I dont ;) therefore any errors whihc inconvinience me are the responsibility of sky to sort. They inturn could take on openreach if there was a responsibility there.

 

Now why oh why do these companies fist use the fobb off mode and blame current provider, not forgetting my line has gone down twice, then they say we have taken over your line, but not our fault.

 

I use the argument of the diy store selling a complete kitchen package and the contractor who does the included fitting in the package bodges it up and ruins the kitchen. There are cases where a consumer comes asking for help after being told said diy store is not responsible and take it up with the contractor. The contractor is obvioulsy then being scarce and customer distressed and beggs diy store to help who again fobbs off. Of cours we know that the diy store is responsible for the actions of the contractor they engaged.

 

Sky used openreach adn whatever comes of this or that, sky are responsible as the work was carried out regarding a sky order, whatever they say.

I know ofcom wednesday, but to be seen to be reasonable as sky have admitted they took my line wether according to them with their permission or not, I have sent quite a few emails. One refering them to their legal dept over the issue of contractors adn fobbing people off, one to various review sites I am posting my whole saga, only they can decide wether I post sattisfied with outcome or not.;)

 

I know I have mental issues okay but I get by. Things like this where I have held on reasonably as anyone else would for so long, when even my own inbuilt bull ***t detector has activated and they still think they can say not our fault despite them having my line. In these cases it makes me unwell, I cannot sleep, I cannot let go untill get the feeled deserved apology. It goes back to childhood and my fight with my father and the injustices a police officer on the child protection squad can be allowed to not even be prosecuted for child abuse. That would drive anyone round the bend, but you have to let go. You mentally learn to cope as best as possible untill uncaring unresponsible companies who think one person doesnt count act the way they do and my injustice detector and bull****detector go into overload, I dont think I am over the top here.

 

Sorry is an amazing word, but sorry in acceptance you did wrong and will put right in that recompense and compensaton anyone would expect. Sorry we took over your line compounded by it was not our fault, is again bull****, no less and I dont think I will get well again till they sort it out, baring in mind my line now will stay dead till 17/8. xxxxxxx

I paid the orignal fee to sky 10/6, this saga or my chasing them up on this or that they have promised and not done, has been going on since then. Imagine anyone 10/6 to 17/8 of such hastle, hecky thump. I believe thats two months of my life sky. :(

Just talked to tesco who said due to manpower issues with openreach and sky not earlier admitting line with them, that the earliest time work was planned for new line was to be 16/8. Now as sky have admitted what happned, though say not their fault but refering to openreach obviously(oh I could cry for them, not) that the line can be restored 17/8 as listed by openreach yesterday.

 

Me, is not stupid ;) It would have been obvious to sky from their own records that they had my line. Or not too hard to ring the so called portal dept, sooner than a week and a half later as supposed done today, hhmmm.

 

Tesco are pleased that at least sky have said they have the line, this has been the bug bear in gettin me help, because so much effort has gone into trying to point out to sky what they probably already in my opinion knew and therefore it dragged it on for me.

 

I have had no replies to emails from them since they admitted they had it but not their fault, Reminds me of a naughty kid admitting to smashing the vase, but that it wasnt there fault, must have been a gale of wind or something blew through the house instead, hhhmmmm, kiddies eventually well some of them learn best to help and fess up and an apology always goes a long way, thats why I have two lovely kids. Their mum is not an ogre.

 

Sky have been playing with my line on and off for two months since the very keenly took the money 10/6. They simply have not the telecom experience to back up the customer when someting goes wrong, or simply could be put down to once got your money, they dont care. Up to them how its interpreted by how they treat people like me.

 

Therefore I do not feel sky should hold a telecom license.

 

What you got to say SKY, youve had enough references to this thread?

My son wants sky to know that his record score on modern warfare 2 including a group of mates in america is vastly being caught up and superseeded, they his friends think its great and funny that he can do not a thing about it and obviously my son does not see it as amusing.

 

He considers sky as responsible for ruining his summer holidays so far. I PUT IT TO SKY THAT I HAVE HAD TO DEAL WITH SAID KID AND ITS NOT PLEASANT WHEN BEING TOLD ME INVOLVING SKY IN OUR LIVES HAS RUINED HIS. YOU MIGHT THINK WHAT ITS NOT AS IF THE END OF THE WORLD, BUT IT IS ON MODERN WARFARE ACCORDING TO SON. :(

My son wants sky to know that his record score on modern warfare 2 including a group of mates in america is vastly being caught up and superseeded, they his friends think its great and funny that he can do not a thing about it and obviously my son does not see it as amusing.

 

He considers sky as responsible for ruining his summer holidays so far. I PUT IT TO SKY THAT I HAVE HAD TO DEAL WITH SAID KID AND ITS NOT PLEASANT WHEN BEING TOLD ME INVOLVING SKY IN OUR LIVES HAS RUINED HIS. Trouble is he wants to and Ive had to stop him :) :) Funny enough he gets angrier than me. I have had a quieter time not hearing him screaming at others for killing him on line funny enough, it has to be heared to be believed, but I would forgive that anytime than to see him being funny with me picking up the phone and slamming it down repeatedly saying still no line xxxxx Yep son Ive gathered that.

 

Didnt help I suggested he could spend more time for preparing for next year at school, oops should have kept quiet :) xxx

 

You know these kids come home from school, loads of them locally obviously, you hear them say speak to you soon and then a few minutes later they are all online shooting away at each other. Friendly ha ha. Says he wil stop saying hes bored not going online if I buy him a new game, hhhmmmmmm

 

Seriously though hes a lovely boy, they are all the same, but boy he knows how to conn a game out of mum xx Wonder how many cuppas I will get? :)

I think the repeatedly picking up the phone and a parott doing phone impressions would work well there

Offta, office of telecoms adjudicator who liase between companies and openreach have just replied to a rather desperate email from me a few days ago.

 

You see due to sky stonewalling me and me not sleeping I had been begging for help all over. Whilst they say they cannot help end users and link me to ofcom, which thankfully I have done on monday and will be again tommorow, it was very nice what they said.

 

They have took my case details and are going to raise it on their own internal forums which I suppose is the forums others have refered to in that telecom companies must talk on it and get advice themselves or update on glitches etc, I presume.

 

So I hope anyhow that other companies learn when something like this happens even the one at fault, best is to apologise and keep customer involved rather than fobb off after saying openreach have confirmed nowt to do with us, than after ages openreach confirm they have the line ;)

 

I said an apology goes a long way and added sky have been messing with me for by 17/8 nearly two months. If openreach are not at fault, they might like to reply to the forum, how do they feel when telecom company says yes we have her line, but it not our fault :):)

 

Anyone have access to the otta forums please keep an eye for little old me xxxxxxxx

How many companies have work carried out on their behalf and say not our fault to the end user, me?

Arnt you supposed to take some responsibilty on my behalf and then chase any errors, if they exist of course?

 

Why are you not replying to my emails sky?
