    • Hi,    I'm almost done. One question is should I include a header with " Claimant's Trial Documents" or something similar and include a copy of my WX from the trial since that has the claim form defence and documents that were relied upon at trial so that the judge can see that? or should I assume they will already have those documents on the file and so simply include a short statement of case to show the case I intend to prove at the appeal should permission be granted. Since I've made a shorter concise statement of case setting out what I intend to prove at an appeal hearing I'm thinking maybe removing the header of "Documents/Exhibits for use for Permission to Appeal   " since the permission to appeal focuses on the grounds of law and so I'm thinking of just having   Appellant's documents Statement Of Case Skeleton Argument    Then a seperate category named Trial Documents Claim Form Defence Claimant's Witness statement Exhibibts to Claimant's trial witness statement   I'm wondering you think would be better, only because I don't reference a single exhibit in my appeal statement of case since I am just explaining the undeveloped points of law around why the judge is wrong since the  statement only focuses on permission, not the outcome of the appeal so there is no reference to any exhibits?   Or should I just remove exhibits and not add trial documents or exhibits on the understanding the judge will already have the trial documents and that if permission is granted I then include them in my appeal bundle.   Thanks   N/B My statement of case doesn't have the claim form or defence or any witness staements in. it is simply a short 4 page document setting out the claim history and the points I intend to prove at the final appeal hearing should permission be granted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm sure it asks on the DLA form if you have had a medical for any other benefit in the last 3 months.

 

I see, I filled my wife's DLA forms out in June and I did not notice that. That said it would only effect new claims, I wouldn't have thought it would effect old claims. I've been on DLA since about 1996, and haven't heard or seen anything about my ESA forms (never had a medical) affecting it.

 

I can understand it can be (and often is) very worrying. Especially considering all the negative press and reports about it. I'm sure it didn't help my heart condition.

Wonder whether it makes a difference bit when I was first signed off and incapacity reviewed my details they signed me off for 10 years at the time I was surprised but I didn't really realise the extent and progression of my illness they obviously did suppose I was in denial then always hoping I'd get better sadly this was not the case and ten years is way off - will contact welfare rights tomorrow and have got contact details for dial - anyone got any idea how long they take to review these forms once returned - Merton trying hard to put it out of my mind! !!

Hi onestressed woman I can only advice you on what I know for certain, if your review goes against you your DLA will stop until it has been heard at appeal. My Sister has just filled in her review form and failed to keep DLA, she has appealed and been told her money will stop, my Niece is in the tribunal court next week trying to get DLA back for her Son, the money she was receiving for him stopped last December. This is only advice on my experience with friends and relatives if theyve gone to appeal their money has stopped. I have been told of people keeping a reduced amount of payment whilst appealing so might be down to a matter of circumstances, Good Luck... I got my DLA award for life in 1993 so I have never had to go through this process.

hi all,i think getting suppporting evidence to submit with your claim for esa is sometimes easier said than done,i`m about to be changed from income supprt/incapacity and have received the dreaded form,i cant find anyone to help me fill it in,have rang birmingham city council ,no appointments available,i`m stuck,and regarding supporting evidence,my biologics nurse specialist,my physio and my consultants secretary have all said they no longer give out such supporting evidence unless requested by dwp,does anyone know of anyone in the sutton coldfield area who could help me fill the form in

We are all in the same boat here ...I filled in my ESA book ! put down all my illnesses and sent forms and copies of x-rays done 2mths prev to my asessment

I ha even sent in one of the letters in 2010 when my review came up I had a letter from them in 2010 saying no need for doc notes again I hav`nt had to dsend them infor the last 4yrs since I had an assesment then and passed with no probs.

This year I got 6 points and have worsend not only with severe depression but other stuff as well...again my doc was disgusted when they had not written to him as they did the last one...atm the DM has said she will reconsider and I have until the 21st Nov when she is back from hols to send in more stuff ...but i did put down in detail what i suffered from on the form and when I got my medical report back it was as though the doc had not read the forms and what I told him had been under reported as well he also out down results to the examinations that I had not done as he never asked to me to do them and 4 I refused as I was in so much pain from the first one....it`s unbeleivable as the DWP have all your records from the past when you first start claiming and if they read them and found them out there would be no need for this for many of us.......sorry to rant on but I am in stressed out and ready to well those of you who know what severs depression is like will know !

My new letters once again from the docs are goin off today with a blunt comment on the bottom of my Doc`s one that prior to assessments they should be contacted !!!

 

Gonna go now have had my rant to myself hope you all don` t mind ...I have a thread on here for my ESA started and other threads that are not helping :// GRRRRRRRRRR ESA ://////////////

Hello there. Have you contacted the local CAB or Welfare Rights, who might be linked with the CAB depending on your area? Also I believe DIAL can help.

hi honey bee,i`v rang the council about welfare rights,no luck there ,they said they have no appointments available showing on there screen,birmingham tribunal unit that helped me last time is not providing that service any more,and the cab in my area has closed down,do you have a link for dial,every time i google it i come up with dial a phone,problem is i`v spent that long trying to find someone to help me i`v now only got 2 weeks left

Well got letter from atos saying they are coming very shortly to assess me - I did contact dial and they tried to reassure me that everyone is getting these and not to worry - easier said than done with all you hear about the medicaal reviews :-(

 

Since I opened the letter I have had serious chest pains psychosomatic probably but shows these things are not good for your health !

 

Wondering Once medical has been carried out how long is it till it is reviewed by DLA in fact is it reviewed by them or is ATOS review the full stop ?

 

Stressing like mad can't move neck killing me right arm blew up like a balloon in my sleep last night on top of everything else and this bloody letter

Hope it all goes well for you I have just sent my reconsideration letters back with more evidence from mental health and gp so now iI am waiting once again to hear from them....my assessment at the medical centre was done 14th sept and had a tel call on the 21st Oct from the dissicion maker herslf to inform me I had only 6 points ....after I had brake down on her and spoke to her she gave me until the 21st of Nov to send more info from gp and mental health ...grrrrrrrr

 

Iv`e done that much to the disgust of my med team as they should get the medical advoce from gp etc .after all the scoring list states its done on ...your questionaire / medical advise from GP and assessment .

 

Know what you are going through I have had 2 meetings with my mental health in the last 3 weeks due to the effect this is having on me.

 

chin uo as they say you are not alone and have a rant on here I do don`t think anyone minds as we are all going through the same stuff

You need 15 points in the past I have had 2 assessments under the old scheme and had no probs at all as they did it following the correct procedures this time I am worse have more problems but they did`nt follow the correct procedure and the dr. did not take into consideration ny mental health probs ( I did no rocking so I have no mental health problems !!!!! GRRRR !!!) ...once you have had your assessment wait a couple of weeks and then phone the DWP up and ask for a copy of your medical report that has been done they are obliged to send it to you mine took 2 days but it could vary ......

 

You will not be able to do anything until you have had a letter or a phone call from the decision maker !

If you do not get the 15 points then ask them to give you time to get more evidence for a reconsideration ....the reconsideration is not a tribunal it`s asking for more time to prove you have what you have !!!!

 

Really makes my blood boil these things would not happen if they followed the procedure and looked and read your questionaire I found this out as when I asked the Discission maker what the dr had put about my mantal health I was told.. none apparent ! even though a letter was in my file that I am on the severe list and have other issues ...

 

I`m saying try to not worry pot calling kettle really but just tell the truth and answer what is asked if the assessor underreports as in my case you will be able to see which areas once you have the medical report in your hands .

 

good luck ...i`m in waiting mode again feeling as if i`m about to be hung :(
