      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

just been sent a final notice for £730.00 i owe on a abbey account , under what i owe them they are saying estimated court fees and costs £135.00.

also i have had a statment from abbey stating my balance which is £730.00 now the snag is that when i rang Abbey to arrange a standing order they said the debt as been sold to wescot , what should i do thanks for any help.

Is any of this comprised of charges? If it is then claim them back from Abbey and tell Wescott that they have been scammed by Abbey as they have been sold another charges related debt.

 

The rule about debts which are sold on is that they can sell on the rights but not the liabilities. This means that if you are owed any money by Abbey, then you get it from them. If Wescott sue you then you defend on the issue of charge.

no Abbey don't owe me any charges basically i tried to set up a standing order to Abbey to pay off the money i owe , now they said i will have to pay wescot which i am not happy about , Abbey said the account is with wescot .

you should ahve also recieved a correctly served Default Notice, and Notice of Assignment.

 

What did you recieve regarding this matter ?

 

 

i received a final notice from wescot stating if i don't pay the £730.00 within the next 14 days the following action may be taken.

 

instruct a door step collector to visit my property to collect payment: or issue cort action for payment of outstanding balance plus statutory legal expenses.

 

if court action is taken your debt could increase :

 

outstanding balance £730.00

 

estmated legal costs £ 130.00

Usual Westcot drivel, I love the way these companies get everything in the 'wrong order'. Statutory legal expenses - thats a laughable one!

 

I would write back with the following.

 

Please can I have a final statement showing how the amount of £730.00 was arrived at so I can check my records.

 

Please note that court costs cannot be added to a debt until it has been to court, any attempt to inflate the alleged sum owed by this means constitutes a fraud and I am sure your company would not want to be involved with the Fraud Squad.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

the debt is 3 years old but i was paying it off then stopped , then abbey sold it to wescot they do ring and dont answear 01482 483281 i just ignore it ..

That is wescots number if you want to answer it tell them all calls are recorded as you are sick and tired of getting calls for the previous owners of the telephone number. My favorite tricks also include using a whistle down the phone or some like was on Mrs Doubtfire.

then what you need to do is write a cheque or get a postal order and send it to them each week month or whatever in the covering letter put the account number etc.

Know the Law! Its on your Side!!! Have you noticed on your paperwork from them it says Your ouststanding balance is. Nowhere does it say Bill/ invoice...

Thats because payment is optional by Law!!! If some one sends you a bill then its lawfull for you to pay it. A demand for money of this type is a Legal fiction!!! Its in Blacks Law dictionary!!!

By law they cannot send you a bill!! therefore you are not bound to pay it!!! They are hoping you dont know the law and will mistake the demand for a bill!!!

People kill themselves over things like this. All because the debt advice people are gaged and cannot tell you this. its said to give the consumer an unfair advantage.

Been there done it come out the other side a different person!!! One who now knows...
