    • when did they (who) inform you there was a 'police case' and when was this attained? i will guess the debt is now SB'd as it's UAE 15yrs. have you informed the bsnk ever by email/letter of your correct and current address? you can always ignore anyone else accept the bank,  Block and bounce back all emails. Block any text messages  Ignore any letters unless it's: - a Statutory Demand - a Letter Of Claim - a Court Claimform via Northants bulk.  
    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Daniella, I also feel like you do. This woman must have been driven to insanity to kill her child. I have three children, and have been suicidal at times because of debts, and my ex husband's actions but what stopped me was my children.

 

However if this lady thought that there was no other option but suicide, and she had no assurances that her son would be looked after I can understand why she thought killing him too would be better. That doesn't mean that I approve of what she did, far from it, but this woman was under enormous pressure.

 

I hate not being able to give my girls all the things I want to. I wish I could do more with them, and give them all the things that their friends have, but its just not possible and so we try to be as happy as we can with what we have.

It is easy to say, but it is all about keeping things in perspective. Debt is not the major part of our lives, although it can seem so at times.

 

My daughter, now 25, remembers her childhood with great happyness, I am glad to say. She remembers great times sharing time with the family, talking at length late into the night, listening to music with me, talking about all sorts of different things and reading. Boy did she read.

 

She has never mentioned enjoying the latest toy, dvd player, tv, hifi or any other expensive goods. The fact is that our children remember the good times and not the things in life, as do we if we think back. We get wound up in having to provide the latest of everything for our children, when in fact they don't realy care long term.

 

Life has to be enjoyed, no mater what your circumstances. It's no rehersal. No bank or debt collector should be allowed to take one minuite of your time from you, so don't let them.

 

I cannot begin to comprehend the mind of that poor woman, killing her own child, but I will not judge her while not knowing all of the facts.

 

There are few things certain in life. You will be born, You will die, You will pay taxes along the way. The other bits are yours to make of them what you will and best enjoy them while you can.

 

We all go through times in life, trying to survive on pennies, but that does not define life. There is so much more if we look. Admittedly dificult to find at times.

I'll look at the website, but I doubt if I'll qualify. If you are self-employed or have your own business you seldom do, but thank you anyway for that. I did ask the Court but they said I didn't as far as their fees were concerned.

 

I've heard about 'buddy' system before and will check it out. I can cook!! I wish someone would come and look after my sadly (shamefully) neglected garden which was my pride and joy before all this started.

 

I'm truly sorry everyone for my moan this morning but when I first read about this case when it happened my first thought was that I bet it was down to debt, and reading the reports which confirmed that really made me weep.

 

I'm also very sensitive to this kind of situation as my sister and an ex-boyfriend to whom I was still close also killed themselves (though not due to debt).

 

Sorry again everyone for what now looks like a self-indulgent moan.

You aren't moaning Daniella, you are talking and that's what this site is for. To support each other and express opinions and facts that are relevent to the site.

 

Don't give up on the grants available just because you are self-employed. A few are open to anyone regardless of your status or situation. My OH is self-employed so I know how difficult it may seem but you don't get help unless you ask and persist.

 

Although I can't agree on the news article because only one person knows the truth and they aren't able to defend themselves here, all we can do is try to stop it happening again by being supportive and looking out for signs.

 

Perhaps we can look at getting a network up and running through the Buddy System that will offer time, effort or skills in return for the same, without an exchange of money.

 

I think a few of us know people that have committed suicide for various reasons. What can we do other than carry on living? Can't change the past but wish we could. Now I'm getting down in the dumps ..best dust meself off and move swiftly on..

 

I'm glad you are feeling a bit better today. You are hard working and sound like a great Mum whose daughter loves her very much. Don't mention cooking though..spent hours making chicken stock and I wonder..was it worth it? Pass me an OXO cube ...

When I first read DD's post it brought home to me what this site is all about - much more so than all the requests for help. I think because it was from the heart.

Thank you for all your kind wishes and very good advice.

 

My daughter is actually by nature a very happy little person, and I thank God for that. It was parents' evening this week, and she is doing very well, and they said how happy and cheerful and smiley she was, so I must be doing something right. :)

I really do think that the lack of assurances about her son's future wellbeing contributed to her decision. Imagine if any of us said to someone in our family or a close friend, "Would you look after him/her if anything happened to me?" and they wouldn't say they would. The very fact that she was asking meant she had serious concerns that they wouldn't look after him. On top of everything else. Poor thing. She was clearly insane.

 

Just a thought about suicide. When most people say, "I wish I was dead", they don't mean it. What they really mean is, "I wish I was happy."

And today yet another woman has been killed by a train after Lloyds pulled her family business's overdraft.

 

I remember a particularly miserable bank manager saying about 25 years ago when I had a problem: "The bank is happy to give you an umbrella while it is sunny, but when it's raining they'll take it away." Bas**rd. He thought this was the funniest thing in the world, but actually it sums them up.

 

This lady has left two small children.

More than any other bank or DCA, it's Lloyds TSB I'd like to see wiped off the face of the earth. Chiefly because of stuff like this.

 

Another one gone LTSB? Well done, you're at least equal with Westcot and Aktiv Kapital now.
